This year is no exception. Employers and payroll service companies are required to withhold the Wage Tax from all eligible employees and to report wage, salary, and tax withheld to the IRS, state, and City of Philadelphia in the form of a W2.<\/p>\n<p>NOTE: Because of COVID-19 pandemic and the financial difficulty that has caused for so many this year, the city issued\u00a0<a href=\"https:\/\/www.phila.gov\/media\/20201105092132\/Wage-Tax-non-resident-COVID-19-guidance-110520.pdf\">new wage tax policy guidance<\/a>\u00a0on November 4<sup>th<\/sup>, 2020.\u00a0 If you were told to work from home by your employer in 2020, you may not have to pay the Philadelphia city wage tax. Learn more in our <a href=\"https:\/\/pwrcpa.com\/philadelphia-accounting-blog\/covid-19-tax-implications\/\">COVID-19: Tax Implications for Philadelphia Residents and Workers<\/a> post.<\/p>\n<p><em>How much is the tax?\u00a0<\/em><\/p>\n<p><strong>Residents pay 3.8712% on wages. Non-Residents who work in the city pay 3.5019 %.<\/strong><\/p>\n<p><em>When is the tax due?<\/em><\/p>\n<p>Due dates vary depending on how much wage tax is withheld. It varies from weekly ( $16,000 or more withheld each month) to quarterly (less than $350 withheld each month).<\/p>\n<p><em>What happens if I don\u2019t pay or don\u2019t pay on time?\u00a0<\/em><\/p>\n<p>If your employer fails to withhold this tax, you are still required to pay it. Interest is due on any unpaid taxes at the rate specified by <a href=\"http:\/\/www.phila.gov\/philacode\/html\/_data\/title19\/CHAPTER_19_500_TAXES_AND_RENTS\/19_509_Interest_Penalties_and_.html\" target=\"_blank\" rel=\"noopener noreferrer\">Philadelphia Code 19-509<\/a>. Rates are steep!<\/p>\n<p><em>Do you have any tips or suggestions?\u00a0<\/em><\/p>\n<p>Individuals do NOT have to fill out a W2. Your employer should provide all parties, including you, with a copy by January 31 or face a penalty.<\/p>\n<p><em>Where can I get more information if I need it?\u00a0<\/em><\/p>\n<p>From the <a href=\"https:\/\/beta.phila.gov\/services\/payments-assistance-taxes\/business-taxes\/wage-tax-employers\/\" target=\"_blank\" rel=\"noopener noreferrer\">Wage Tax page on the City of Philadelphia website<\/a>.<\/p>\n<h2>Business Income and Receipts Tax (BIRT)<\/h2>\n<p><em>What is it?<\/em><\/p>\n<p>The Business Income and Receipts Tax or BIRT is the renamed business privilege tax. It\u2019s a two-part tax on revenue based on a business or individual\u2019s gross receipts and net income.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-1551\" src=\"https:\/\/pwrcpa.com\/wp-content\/uploads\/2020\/12\/BIRT-tax-2020-philadelphia.jpg\" alt=\"2020 BIRT tax rate Philadelphia | cash register | daletaxservice.com\" width=\"1024\" height=\"683\" srcset=\"https:\/\/pwrcpa.com\/wp-content\/uploads\/2020\/12\/BIRT-tax-2020-philadelphia.jpg 1024w, https:\/\/pwrcpa.com\/wp-content\/uploads\/2020\/12\/BIRT-tax-2020-philadelphia-300x200.jpg 300w, https:\/\/pwrcpa.com\/wp-content\/uploads\/2020\/12\/BIRT-tax-2020-philadelphia-768x512.jpg 768w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><\/p>\n<p><em>Who has to pay it?\u00a0<\/em><\/p>\n<p>Every individual, partnership, association, limited liability company (LLC), and corporation engaged in a business, profession or other activity for profit within the City of Philadelphia must pay this tax. You must file, even if you did not earn a profit.<\/p>\n<p><em>How much is the tax?\u00a0<\/em><\/p>\n<p><strong>Current BIRT rates are 1.415% per $1,000 on gross receipts, and 6.30% on taxable net income.<\/strong><\/p>\n<p><em>When is the tax due?\u00a0<\/em><\/p>\n<p>April 15<\/p>\n<p><strong>Taxpayers who owe $5,000 or more for the BIRT\/NPT are required to pay those taxes electronically.\u00a0<\/strong><\/p>\n<p><em>What happens if I don\u2019t pay or don\u2019t pay on time?\u00a0<\/em><\/p>\n<p>Late payments are subject to interest and penalty charges. There are no extensions for tax payments, but you can apply for more time to file your return if needed.<\/p>\n<p>Your Commercial Activity License (CAL), the license all for-profit businesses need to conduct business within Philadelphia, can be suspended or revoked if you haven\u2019t paid your taxes. If you don\u2019t pay on time, you may have to suspend business operations until you do pay.<\/p>\n<p><em>Do you have any tips or suggestions?\u00a0<\/em><\/p>\n<p>The BIRT can be allocated if some of the business is done out of the city. \u00a0The BIRT also allows for a statutory exemption of up to $100,000 of gross receipts.<\/p>\n<p>Filing the BIRT in the first year requires payment for the current and following year.<\/p>\n<p><em>Where can I get more information if I need it?\u00a0<\/em><\/p>\n<p>For more information about BIRT, visit the <a href=\"https:\/\/beta.phila.gov\/services\/payments-assistance-taxes\/business-taxes\/business-income-receipts-tax-birt\/\" target=\"_blank\" rel=\"noopener noreferrer\">business, income, and receipts page on the City of Philadelphia site<\/a>.<\/p>\n<h2>Net Profits Tax (NPT)<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-1361\" src=\"https:\/\/pwrcpa.com\/wp-content\/uploads\/2016\/11\/hiring-small-business-cpa-worth-it.jpg\" alt=\"business owner calculating numbers to help decide whether hiring a cpa is worth it\" width=\"450\" height=\"268\" srcset=\"https:\/\/pwrcpa.com\/wp-content\/uploads\/2016\/11\/hiring-small-business-cpa-worth-it.jpg 450w, https:\/\/pwrcpa.com\/wp-content\/uploads\/2016\/11\/hiring-small-business-cpa-worth-it-300x179.jpg 300w\" sizes=\"auto, (max-width: 450px) 100vw, 450px\"\/><\/p>\n<p><em>What is it?<\/em><\/p>\n<p>The Net Profits Tax (NPT)\u00a0is imposed\u00a0on the net profits from the operation of a trade, business, profession, enterprise, or other activity by:<\/p>\n<ul>\n<li>Philadelphia residents, even if their\u00a0business is conducted outside of Philadelphia.<\/li>\n<li>Non-residents who conduct business in Philadelphia.<\/li>\n<\/ul>\n<p><em>Who has to pay it?\u00a0<\/em><\/p>\n<p>Businesses must pay the Net Profits Tax if they are organized as:<\/p>\n<ul>\n<li>individuals (sole proprietors);<\/li>\n<li>partnerships;<\/li>\n<li>associations;<\/li>\n<li>limited liability companies (LLCs); or<\/li>\n<li>estates or trusts.<\/li>\n<\/ul>\n<p>The rental of property, in most cases, is considered the operation of a business.<\/p>\n<p>Corporations are exempt from the Net Profits Tax.<\/p>\n<p><em>How much is the tax?<\/em><\/p>\n<p><strong>The NPT tax rate for 2020 is 3.8712% of net income (for residents) or 3.5019% (for non-residents).<\/strong><\/p>\n<p><em>When is the tax due?\u00a0<\/em><\/p>\n<p>April 15 and June 15 of each tax year<\/p>\n<p><em>Do you have any tips or suggestions?\u00a0<\/em><\/p>\n<p>The Net Profits Tax is remitted <em>in addition<\/em> to the Business Income and Receipts Tax (BIRT). The NPT does NOT take the place of the net income portion of the Business Income &amp; Receipts Tax (BIRT). That said, you may be able to take a credit on the NPT based on the amount of tax owed from your BIRT.\u00a0The NPT tax gets a credit of 60% of the BIRT Tax paid on net income.<\/p>\n<p><strong>The income-based rates are 0.5% lower than standard rates. If you are eligible, residents pay 3.3712%, non-residents 2.9481%.<\/strong><\/p>\n<p>A return must be filed even if a loss is incurred. Also, be aware that <a href=\"https:\/\/beta.phila.gov\/services\/payments-assistance-taxes\/paying-city-taxes\/interest-penalties-and-fees\/\" target=\"_blank\" rel=\"noopener noreferrer\">delaying or making a mistake can be extremely expensive<\/a>. <strong>In addition to interest rates of 6% per year, you can also be charged a 1.25% penalty fee each month that your return or payment is late.<\/strong><\/p>\n<p>These rates took effect on January 1, 2014.<\/p>\n<p>There might be an opportunity to reduce the amount of tax you owe.
