However, the Jan. 7 order issued by another federal district court in the Smith\/Means case remains in place.<\/h3>\n<p>By Mary Hightower<br \/>U of Arkansas System Division of Agriculture<\/p>\n<p>Jan. 24, 2025<\/p>\n<p><strong>Fast facts<\/strong><\/p>\n<ul>\n<li>SCOTUS overturns lower court ruling<\/li>\n<li>Separate federal injunction remains in place<\/li>\n<\/ul>\n<p>FAYETTEVILLE, Ark. \u2014\u00a0If the Corporate Transparency Act had a theme song, it would probably be \u201cThe Long and Winding Road.\u201d<\/p>\n<p>The legal switchbacks for CTA, a law intended to dampen financial fraud, are happening across two primary court cases, Texas Top Cop Shop v. Garland, and Samantha Smith and Robert Means v. U.S. Department of Treasury.<\/p>\n<p>On Thursday, the U.S. Supreme Court ruled in favor of the Treasury Department, overturning an injunction put in place last month by a federal court in Texas in the Texas Top Cop Shop case. However, the Jan. 7 order issued by another federal district court in the Smith\/Means case remains in place.<\/p>\n<p>\u201cYesterday the Supreme Court stayed the injunction that prohibited enforcement of the CTA as challenged in the Texas Top Cop Shop case, reinstating reporting requirements until the litigation has finished,\u201d said Elizabeth Rumley, senior staff attorney for the National Agricultural Law Center, part of the University of Arkansas System Division of Agriculture. \u201cIf this were the only case at issue, that would have been the end of the story.\u00a0 However, early this month another federal district court judge had considered the issue and issued a second injunction, which was not affected by yesterday\u2019s ruling.\u201d<\/p>\n<p>The bottom line is this: \u201cas of Jan. 24, the Corporate Transparency Act is not enforceable,\u201d Rumley said. Business owners should note, however, that this injunction could be lifted or other circumstances could change at any time.\u201d<\/p>\n<p>If you\u2019ve following along at home, here\u2019s the timeline:<\/p>\n<ul>\n<li>March 1, 2024 \u2014 a U.S. District Court in Alabama,\u00a0<a href=\"https:\/\/www.uaex.uada.edu\/media-resources\/news\/2024\/march\/03-07-2024-ark-nalc-corporate-transparency-act-update.aspx\">suspended the law\u2019s<\/a>\u00a0requirements for plaintiffs in the Business United v. Yellen case.<\/li>\n<li>3, 2024 \u2014 U.S. District Judge Amos Mazzant issues a nationwide injunction in the case of Texas Top Cop Shop, Inc. v. Garland.<\/li>\n<li>23, 2024 \u2014 In Texas Top Cop Shop, Inc. v. Garland, a three-judge panel of the U.S. Fifth Circuit Court of Appeals reinstated the law\u2019s reporting requirements.<\/li>\n<li>26, 2024 \u2014 In Texas Top Cop Shop, Inc. v. Garland, another three-judge panel of the U.S. Fifth Circuit Court of Appeals vacated their colleagues\u2019 decision three days earlier, reinstating the stay until after the appeals on the merits of the case had been heard.<\/li>\n<li>Jan 7, 2025 \u2013 U.S. District Judge Jeremy Kernodle issues a nationwide injunction in the case of\u00a0<a href=\"https:\/\/nationalaglawcenter.org\/wp-content\/uploads\/2025\/01\/Smith-v-United-States-Department-of-the-Treasury.pdf\">Samantha Smith and Robert Means v. U.S. Department of the Treasury<\/a>.<\/li>\n<li>23, 2025 \u2014\u00a0SCOTUS\u00a0<a href=\"https:\/\/nationalaglawcenter.org\/wp-content\/uploads\/2025\/01\/01232025scotus_top.pdf\">lifts the injunction from<\/a>\u00a0the CTA case of Texas Top Cop Shop, Inc. v.
