{"id":46617,"date":"2025-01-25T11:33:35","date_gmt":"2025-01-25T11:33:35","guid":{"rendered":"https:\/\/peraltafinancing.com\/activist\/some-thoughts-for-civil-libertarians-on-fighting-the-far-right-on-campus\/"},"modified":"2025-01-25T11:33:35","modified_gmt":"2025-01-25T11:33:35","slug":"some-thoughts-for-civil-libertarians-on-fighting-the-far-right-on-campus","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=46617","title":{"rendered":"Some Thoughts for Civil Libertarians on Fighting the Far-Right on Campus |"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>In recent weeks two\u00a0public figures with far-right views\u2014Breitbart provocateur Milo\u00a0Yiannopoulos and white supremacist\u00a0Richard Spencer\u2014have made headlines with high-profile visits to American campuses, while their opponents on the left have made headlines by trying to derail\u00a0those appearances.<\/p>\n<p>With both\u00a0Yiannopoulos and Spencer planning more campus talks, and with campus organizing on the rise in the wake of Trump\u2019s victory, such\u00a0protests, and the free-speech debates that accompany them, are going to gain much more attention in the coming months. As a civil libertarian who is also an anti-fascist, I have some thoughts on the issue that other civil libertarians might want to bear in mind\u2026<\/p>\n<p><strong>Off-campus individuals have no right to speak on campus.<\/strong><\/p>\n<p>Professors, students, and staff are members of the campus community, and their ability\u00a0to speak on campus without constraint is essential to fundamental principles of free speech and academic freedom. Outsiders\u00a0aren\u2019t in the same category.<\/p>\n<p>When speakers\u00a0like Spencer and Yiannopoulos come to our schools, they come as invited guests. Such\u00a0invitations are privileges, subject to campus rules and to the preferences of relevant decisionmakers. It\u2019s not a violation of their free speech rights for us to refuse to host them, or to discourage others from hosting them.<\/p>\n<p>It\u2019s not a violation of the First Amendment or of principles of academic freedom to oppose\u00a0giving Nazis a soapbox.<\/p>\n<p><strong>The right to invite a speaker is meaningless without\u00a0the right to change your mind.<\/strong><\/p>\n<p>Organizations like FIRE frequently raise alarms about <a href=\"https:\/\/www.thefire.org\/resources\/disinvitation-database\/#home\/\">disinvitations of campus speakers<\/a>, but there\u2019s nothing intrinsically wrong, from a civil libertarian perspective, with rescinding an invitation to speak. If an invitation has been extended without a full understanding of the issues\u00a0involved, or without consideration of all relevant perspectives, there\u2019s nothing sinister in withdrawing it.\u00a0Likewise, there\u2019s nothing inherently sinister in encouraging others to change their minds about extending such invitations, even where such encouragement\u00a0takes the form of protesting the invitation.<\/p>\n<p>It\u2019s also worth bearing in mind that many \u201cdisinvitations\u201d aren\u2019t disinvitations at all. If a speaker cancels\u00a0because their planned appearance\u00a0has brought them negative publicity, or to avoid embarrassing the host institution, that\u2019s not a disinvitation, and it\u2019s not a\u00a0violation of anyone\u2019s\u00a0free speech rights.<\/p>\n<p>Shining a spotlight on the views and acts of an invited speaker is legitimate behavior, and if the speaker decides to withdraw in the face of such publicity, there\u2019s not necessarily anything\u00a0wrong with that.<\/p>\n<p><strong>The right to protest\u00a0is an essential component of the right to free speech.<\/strong><\/p>\n<p>Protesting a speaker is an act of free speech, and the right to protest must be defended by civil libertarians even when the protest is indecorous\u00a0or unruly.\u00a0It\u2019s not an infringment on a speaker\u2019s rights to challenge them, even if that challenge is uncivil. Sometimes incivility is exactly what a situation calls for.<\/p>\n<p>It\u2019s crucial\u00a0to be alert to infringements on the free-speech rights of protesters, even hecklers. When campus officials have protesters arrested, they are leveraging the power of the state against expression they disapprove of in ways that chill free speech far more powerfully than most hecklers.<\/p>\n<p><strong>Extending invitations to harassers has costs.\u00a0<\/strong><\/p>\n<p>Milo Yiannopoulos was banned permanently from Twitter in July because of his long history of coordinating harassment campaigns against other users of the site, and he has recently used his platform on at least one campus to engage in <a href=\"http:\/\/nymag.com\/thecut\/2016\/12\/milo-yiannopoulos-harassed-a-trans-student-at-uw-milwaukee.html\">similarly abusive behavior<\/a>. At UW Milwaukee in December, he put up\u00a0the name and photo of a transgender student from that campus on a large screen behind his podium, then proceeded to spend the next several minutes abusing and deriding her, referring to\u00a0her as \u201cit,\u201d calling her \u201ca man in a dress,\u201d and making a variety of cruel and ugly\u00a0remarks about her.<\/p>\n<p>There\u2019s nothing obviously illegal about this nastiness\u2014it\u2019s\u00a0Yiannopoulos\u2019s right to engage in squalid, repulsive\u00a0behavior. But again, universities have no obligation to provide a platform for it.<\/p>\n<p>And they <em>do<\/em>, I believe, have at least some obligation, when\u00a0they consider hosting speakers, to take into account\u00a0their propensity for such behavior and anticipate its potential consequences. Yiannopoulos\u00a0left UW Milwaukee\u00a0that night, but his target remained to face the consequences\u00a0of his actions.<\/p>\n<p><strong>People like Spencer and Yiannopoulos aren\u2019t looking for debate.<\/strong><\/p>\n<p>Booking controversial speakers on campus is often defended as an opportunity for dialogue, but dialogue isn\u2019t\u00a0what these figures are after. They\u2019re looking to build their base and their brand\u2014to rally supporters and harvest attention.<\/p>\n<p>When\u00a0someone\u2019s public persona is based on shock and \u201ctransgression\u201d\u2014on violating\u00a0social norms\u00a0for the sake of notoriety\u2014actual\u00a0dialogue isn\u2019t in their interest and should not be used to justify their presence.<\/p>\n<p><strong>Not all\u00a0questions raised by such speakers are\u00a0as\u00a0easily resolved.<\/strong><\/p>\n<p>Having said all this, I recognize that some difficult issues\u00a0remain. While I consider it appropriate for universities to refuse to\u00a0bring such figures\u00a0to campus, for instance, I generally believe that student organizations deserve broad deference in booking speakers. Though I think the rights of hecklers should be granted\u00a0far more weight\u00a0than they\u2019re typically afforded, there does come a point at which the exercise of those rights limits others\u2019 ability\u00a0to exercise theirs.\u00a0And although\u00a0the right to\u00a0protest vocally, even rowdily, is worthy of strong defense,\u00a0there are circumstances in which\u00a0such\u00a0protest crosses a line into\u00a0physical intimidation or harassment.<\/p>\n<p>These are thorny questions that pose\u00a0conflicts between reasonable\u00a0claims. But they\u2019re not questions that can be engaged in a productive way\u00a0unless the rights of protesters are given due weight and issues of speakers\u2019\u00a0rights are disentangled from issues of institutional policy.<\/p>\n<p>Spencer, Yiannopoulos, and their ilk hold extremist, overtly bigoted views, but they are not fringe figures\u2014they represent an ideology and a political movement that is on the ascendancy in the United States and in much of Europe.
