COVID-19:\u00a0USDA\u00a0Announces
\nFifth Round of Food\u00a0Box\u00a0Purchases<\/span><\/b>\u00a0<\/span><\/p>\n

On January 4,
\n2021, the\u00a0U.S. Department of Agricultu<\/span>re\u00a0announced<\/span><\/a>\u00a0a
\nfifth round of\u00a0food\u00a0purchases of $1.5 billion for the Farmers to
\nFamilies Food Box Program.\u00a0 <\/span>The funding
\nfor this fifth\u00a0round was provided through the\u00a0COVID-19 relief funding
\nlegislation signed into law on December 27, 2020, the\u00a0Consolidated Appropriations Act<\/span><\/a>\u00a0(see
\n\u201c$900 Billion Appropriations Act Includes $13 Billion in COVID-19 Relief for
\nAgriculture,\u201d\u00a0ALWR\u2014week ending January 1, 2021<\/span><\/a>).\u00a0\u00a0USDA
\nwill\u00a0solicit offers from more than 240 suppliers<\/a>
\nwith previous\u00a0Basic Ordering Agreements\u00a0(BOA)\u00a0and issue awards
\nby January 19, 2021.\u00a0\u00a0USDA states that it will amend the BOA
\nto\u00a0include pre-cooked seafood products, which may now be combined
\nwith\u00a0pre-cooked beef, pork, chicken, and turkey,\u00a0along with\u00a0egg
\nproducts,\u00a0to satisfy\u00a0descriptive
\nweight\u00a0designations.\u00a0\u00a0USDA has also\u00a0specified that, in
\naddition to cheddar and other previously specified cheeses, the food boxes
\nmay\u00a0contain\u00a0\u201cother hard, semi-firm, [and] semi-soft cheese,\u201d
\nincluding\u00a0Blue, Brick, Colby, Edam, Gorgonzola, Gouda, Gruyere, Monterey,
\nMuenster, Parmesan, Provolone and Romano.\u00a0\u00a0Food box deliveries
\nwill\u00a0begin after contract awards are issued and will continue through
\nApril 2021.\u00a0\u00a0<\/span><\/p>\n

\nCourt to Hear Small-Refinery Exemption Appeal<\/span><\/b>\u00a0<\/span><\/p>\n

On January 8,
\n2021, the Supreme Court of the United States\u00a0<\/span>granted<\/span><\/a>\u00a0a petition\u00a0for writ of certiorari\u00a0to
\nhear\u00a0an appeal of a January\u00a024,\u00a02020\u00a0<\/span>decision<\/span><\/a>\u00a0from the U.S. Court of Appeals for the Tenth Circuit
\nwhich invalidated the
\nEnvironmental\u00a0Protection\u00a0Agency\u2019s\u00a0(EPA)\u00a0grant of renewable
\nfuel standard (RFS) small refinery exemptions.\u00a0\u00a0HollyFrontier
\nCheyenne Refining,\u00a0LLC, et al., Petitioners v. Renewable Fuels
\nAssociation, et al.<\/u><\/i>,\u00a0No.\u00a0<\/span>20-472<\/span><\/a>.\u00a0(For background on the Circuit Court\u2019s decision, see\u00a0\u201cCourt
\nof Appeals Invalidates EPA Grant of Renewable Fuel Standard Waivers,\u201d\u00a0<\/span>ALWR\u2014January 30, 2020<\/span><\/i><\/a>.\u00a0 <\/span>The\u00a0petroleum
\nrefiners who filed the petition seek determination from the court of whether a small
\nrefinery\u00a0must have\u00a0been granted \u201cuninterrupted,
\ncontinuous\u00a0[RFS]\u00a0hardship exemptions\u201d for each year\u00a0dating back
\nto\u00a02011\u00a0in order to receive a current\u00a0hardship exemption from
\nthe renewable fuel standards.\u00a0 The court also granted leave to The
\nAmerican Fuel & Petrochemical Manufacturers and Countrymark Refining and
\nLogistics, LLC to file amicus briefs.\u00a0\u00a0Oral argument dates have yet
\nto be set.\u00a0\u00a0<\/span><\/span><\/p>\n

Crop Insurance: COVID-19\u00a0Crop Insurance\u00a0Accommodations<\/span><\/b>\u00a0Extended<\/b><\/span><\/p>\n

On December 30, 2020, USDA\u2019s Risk Management Agency (RMA)\u00a0<\/span>announced<\/span><\/a><\/span>\u00a0extended deadlines for\u00a0<\/span>various
\ncrop insurance<\/span><\/a> requirements<\/span>\u00a0in
\nresponse to the COVID-19 pandemic.\u00a0 Specifically,\u00a0the ability\u00a0of
\nApproved Insurance Providers (AIP) and agents\u00a0to\u00a0send\u00a0electronic
\nnotifications\u00a0and\u00a0utilize\u00a0digital\u00a0signatures\u00a0with
\npolicyholders\u00a0for sales closing,\u00a0 production reporting,\u00a0and
\nacreage reporting deadlines\u00a0has been extended through July 15, 2021.\u00a0
\nAlso,\u00a0the\u00a0<\/span>accommodations<\/span><\/a><\/span>\u00a0for organic certification allowing reporting of certified
\norganic\u00a0acreage, replant self-certification\u00a0(increasing\u00a0the
\nacreage of\u00a0self-certification replant inspections\u00a0from 50 to 100),
\nand assignment of indemnity\u00a0(allowing use of digital signatures and
\nwaiving witness requirements)\u00a0have been extended through June 30,\u00a02021.\u00a0\u00a0Additionally,\u00a0producer
\nsignatures may be accepted after the expiration date until August 2, 2021.\u00a0<\/span>\u00a0<\/span><\/p>\n

National Agricultural Policy:\u00a0New Legislation Establishes Ag Interest
\nRepresentation on Drone Advisory Committee<\/span><\/b>\u00a0<\/span><\/p>\n

On
\nDecember 31, 2020,\u00a0<\/span>S.2730<\/span><\/a><\/span>, known
\nas the \u201cDrone Advisory Committee for the 21st Century Act\u201d\u00a0was signed into
\nlaw.\u00a0 The law\u00a0establishes\u00a0that the\u00a0thirty-five member\u00a0<\/span>Drone
\nAdvisory Committee<\/span><\/a><\/span>\u00a0\u201cshould\u00a0[include]
\nto the extent practicable. . . direct representatives from county and tribal
\ngovernment, agriculture, forestry. . . rangeland, [and other rural]
\ninterests.\u201d\u00a0\u00a0Members are appointed to the\u00a0committee\u00a0by the
\nU.S.\u00a0Department of Transportation\u00a0Secretary\u00a0upon recommendation
\nof the Federal Aviation Administration (FAA) Administrator\u00a0to advise both
\nagencies,\u00a0and serve\u00a0two-year terms\u00a0\u201cat the pleasure\u201d of the
\nSecretary of Transportation.\u00a0\u00a0FAA recently issued a\u00a0<\/span>solicitation<\/span><\/a><\/span>\u00a0for
\nnominations to the Drone Advisory Committee in June 2020.\u00a0 <\/span>On\u00a0January 5, 2021,\u00a0DOT Secretary
\nElaine Chao\u00a0<\/span>appointed<\/span><\/a><\/span>\u00a0several

Organic Agriculture:\u00a0US and\u00a0UK\u00a0Organic Equivalency Agreement\u00a0Effective
\nJanuary 1, 2021<\/span><\/b>\u00a0<\/span><\/p>\n

On January 1, 2021, the\u00a0<\/span>organic
\nequivalence arrangement<\/span><\/a><\/span>\u00a0between
\nthe United States (US) and the United Kingdon (UK)\u00a0became effective,
\nallowing\u00a0crops, wild crops, livestock, and processed products certified as
\norganic\u00a0in\u00a0each\u00a0country\u00a0to
\nbe\u00a0reciprocally\u00a0labelled and sold as organic\u00a0in both
\ncountries.\u00a0\u00a0Previously, the UK operated under the organic equivalency
\narrangement between the\u00a0<\/span>US and
\nthe European Union<\/span><\/a><\/span>.\u00a0\u00a0The\u00a0US-UK\u00a0agreement
\nonly applies to products\u00a0either\u00a0raised\u00a0or which received final
\nprocessing or\u00a0packaging\u00a0within\u00a0the certifying country.\u00a0
\nProducts from aquatic animals and animals treated with antibiotics are
\nineligible\u00a0for export to the U.S. as certified organic.\u00a0<\/span>\u00a0<\/span><\/p>\n
