In 2024, investment arbitration in Latin America saw significant activity and notable developments. In addition to seeing a steady increment in arbitration cases, 2024 witnessed important legal reforms and evolving trends that are reshaping the region\u2019s approach to investment and investor-State dispute settlement (\u201cISDS\u201d).<\/p>\n<p>This Year in Review explores these key developments.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Steady Surge in Arbitration Cases<\/strong><\/p>\n<p>In the last two decades, investor-State disputes have gone from the first treaty-based ISDS case in 1987 (<a href=\"https:\/\/www.italaw.com\/sites\/default\/files\/case-documents\/ita1034.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\"><em>AAPL v. Sri Lanka<\/em><span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a>) to <a href=\"https:\/\/investmentpolicy.unctad.org\/publications\/1303\/investment-dispute-settlement-navigator-full-isds-data-release-as-of-31-12-2023-in-excel-format-\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">1344 publicly known<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> cases as of December 31, 2023. South and Central America, along with Caribbean states, were involved as respondents in <a href=\"https:\/\/www.tni.org\/files\/2024-10\/ISDSALC_2024_ENG-report.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">380 cases<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a>, representing 28.5% of publicly available claims globally.<\/p>\n<p>On August 18, 2024, the International Center for Settlement of Investment Disputes (\u201cICSID\u201d) released its latest edition of <a href=\"https:\/\/icsid.worldbank.org\/news-and-events\/comunicados\/icsid-releases-caseload-statistics-2024-fiscal-year\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">ICSID\u2019s caseload statistics<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> for the fiscal year of 2024 (FY2024 runs from July 1, 2023-June 30, 2024). By mid-year, ICSID had registered 24 cases, a number comparable to those reported in 2023 (as reported in our <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/01\/13\/2023-year-in-review-latin-america-and-investment-arbitration\/\" data-wpel-link=\"internal\">Year in Review 2023<\/a>). ICSID reported that in FY2024, South America accounted for 19% and Central America and the Caribbean for 12% of all cases, totaling 31% of registered cases of the Latam region.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Legal Reforms<\/strong><\/p>\n<p>In 2024, Mexico elected its first female president, Claudia Sheinbaum. This election has lead to various reforms and political changes. In October 2024, the <a href=\"https:\/\/mexiconewsdaily.com\/politics\/mexico-energy-reform-bill\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">Mexican Senate approved<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> a federal energy reform that enshrines state dominance in the electricity sector within the constitution. This reform overturns previous legislation that allowed private investment in Mexico\u2019s energy.<\/p>\n<p>In contrast, Argentina\u2019s Congress approved, on July 8, 2024, <a href=\"https:\/\/www.boletinoficial.gob.ar\/detalleAviso\/primera\/310189\/20240708\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">legislation<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> that creates a new investment regime. <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/nahila-cortes\/\" data-wpel-link=\"internal\">Nahila Cortes<\/a> <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/12\/28\/argentinas-new-foreign-investment-regime-key-considerations\/\" data-wpel-link=\"internal\">explained<\/a> in detail the general aspects of the regime and what it means for the country. In sum, the law creates a new regime for owners of large investments in different sectors such as mining, technology, energy, and oil and gas, and offers significant tax and custom benefits, along with foreign exchange incentives. The law sets up a dispute resolution mechanism, allowing the State to agree to arbitration through national legislation. It permits unresolved disputes to be submitted to arbitration and includes ICSID as one of the mechanisms.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Emerging Trends and Challenges<\/strong><\/p>\n<p>At the beginning of the year, <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/01\/14\/tendencies-in-investment-arbitration-in-latin-america-current-issues-and-challenges\/\" data-wpel-link=\"internal\">Benjamin Silva<\/a> reported on the tendencies in investment arbitration in Latin America discussed at the seminar \u201cTendencies in Investment Arbitration in Latin America: Current Issues and Challenges\u201d organized by <a href=\"https:\/\/www.camsantiago.cl\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">CAM Santiago<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> and sponsored by the <a href=\"https:\/\/alarb.org\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">Asociaci\u00f3n Latinoamericana de Arbitraje (\u201cALARB\u201d)<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> and <a href=\"https:\/\/icsid.worldbank.org\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">ICSID<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a>. The speakers noted a rise in cases within the region, attributing the primary cause to political and institutional deficiencies (referring to it as the \u201creal detonator\u201d). Additionally, they highlighted the growing number of Latin American investors serving as claimants in investor-State disputes.<\/p>\n<p>One of the emerging trends discussed was the sophistication and evolution of Latin American states\u2019 defenses, which have largely been focused on the \u201cstate\u2019s right to regulate\u201d. Different states have also resorted to procedural mechanisms, more common in newer treaties, to dismiss frivolous claims.<\/p>\n<p>Another topic of interest is the discussion of Environmental, Social, or Governance (\u201cESG\u201d) principles and ISDS. Earlier in 2024, <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/felipenazar11\/\" data-wpel-link=\"internal\">Felipe Nazar<\/a>, <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/silviadepaz11\/\" data-wpel-link=\"internal\">Silvia de Paz<\/a>, and <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/mariadearcos11\/\" data-wpel-link=\"internal\">Mar\u00eda de Arcos<\/a> <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/02\/25\/isds-and-esg-friends-or-foes\/\" data-wpel-link=\"internal\">noted<\/a> an increasing number of arbitrations involving issues such as environmental permits, green incentives, social licensing requirements, and corruption. In their post, they demystify the skepticism surrounding the relationship between ESG and ISDS concluding that foreign investment, particularly in developing countries, is needed for a sustainable future.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Notable Developments and Case Law<\/strong><\/p>\n<p>The year 2024 witnessed several developments and notable decisions that addressed fundamental principles of international investment law that continue to shape investment protections and state action.<\/p>\n<p>\u00a0<\/p>\n<ul>\n<li><strong>Colombia: Mixed Decisions<\/strong><\/li>\n<\/ul>\n<p>Colombia received positive and negative decisions. A key case on states\u2019 environmental protection rights was decided in Colombia\u2019s favor. As <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/05\/25\/red-eagle-v-colombia-colombias-decisions-to-protect-paramos-do-not-constitute-a-violation-of-the-minimum-standard-of-treatment-vis-a-vis-an-investor-with-no-vested-right\/\" data-wpel-link=\"internal\">reported<\/a> by <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/estefaniacontreras1\/\" data-wpel-link=\"internal\">Estefan\u00eda Contreras<\/a> and <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/jesusvillegas\/\" data-wpel-link=\"internal\">Jesus Villegas<\/a>, in <a href=\"https:\/\/icsidfiles.worldbank.org\/icsid\/ICSIDBLOBS\/OnlineAwards\/C7148\/DS19402_En.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\"><em>Red Eagle v. Colombia<\/em><span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a>, the tribunal ruled that Colombia\u2019s decisions to protect protected ecosystems such as the <em>p\u00e1ramos<\/em>, do not constitute a violation of the minimum standard of treatment vis-\u00e0-vis\u00a0an investor with no vested right.<\/p>\n<p>The <em>Seda<\/em> award was also positive for Colombia; it analyzed the functioning effect of security exceptions. <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/kilian-wagner\/\" data-wpel-link=\"internal\">Kilian Wagner<\/a> <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/10\/07\/angel-samuel-seda-and-others-v-colombia-new-pathways-in-the-application-of-security-exceptions\/\" data-wpel-link=\"internal\">analyzed<\/a> the decision in <a href=\"https:\/\/www.italaw.com\/sites\/default\/files\/case-documents\/italaw182199.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\"><em>Angel Samuel Seda and Others v. Colombia<\/em><span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a>. The tribunal found that Colombia had invoked the essential security interest exception under the United States-Colombia Trade Promotion Agreement and dismissed the Claimants\u2019 claims. Kilian observed that the award contributes to obtaining a clearer understanding of the implementation of exception clauses, although it leaves several issues unresolved.<\/p>\n<p>More recently, the tribunal in <a href=\"https:\/\/www.italaw.com\/sites\/default\/files\/case-documents\/italaw182444.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\"><em>Telef\u00f3nica v. Colombia<\/em><span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> found that the State was liable for a breach of the state\u2019s obligation of fair and equitable treatment provisions contained in the Colombia-Spain bilateral investment treaty (\u201cBIT\u201d) awarding the claimant approximately USD 380 million. Colombia <a href=\"https:\/\/www.defensajuridica.gov.co\/saladeprensa\/noticias\/Paginas\/271124.aspx\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">filed for annulment<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> claiming, among other reasons, a serious departure from fundamental rules of procedure. Colombia\u2019s loss led the <a href=\"https:\/\/www.presidencia.gov.co\/prensa\/Paginas\/Iniciativas-del-Gobierno-para-ajustar-clausulas-de-arbitraje-en-tratados-internacionales-241125.aspx\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">Government to take steps towards<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> renegotiating arbitration clauses in various free trade agreements and changing the international dispute settlement mechanism, which could include denouncing the ICSID Convention.<\/p>\n<p>Finally, on the enforcement context, the Supreme Court of Colombia refused to recognize an ICSID award against Venezuela, citing that the ICSID Convention does not supersede customary international law regarding immunity from execution. Based on public information, this is the first time that the Supreme Court decided on a petition to recognize an investment award. <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/mvmunevar\/\" data-wpel-link=\"internal\">Maria Victoria Munevar<\/a>, <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/felipe-mutis-tellez\/\" data-wpel-link=\"internal\">Felipe Mutis<\/a>, and <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/vburiticab\/\" data-wpel-link=\"internal\">Valentina Buritica<\/a> discussed the decision <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/09\/14\/colombian-supreme-court-denies-recognition-of-an-icsid-award-against-venezuela\/\" data-wpel-link=\"internal\">here<\/a>.<\/p>\n<p>\u00a0<\/p>\n<ul>\n<li><strong>Ecuador: Long Awaited Awards and Public Consultation<\/strong><\/li>\n<\/ul>\n<p>On March 27, 2024, a tribunal issued its Phase II award in the <a href=\"https:\/\/jusmundi.com\/en\/document\/pdf\/decision\/es-ecuadortlc-s-a-v-the-republic-of-ecuador-laudo-fase-ii-wednesday-27th-march-2024\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\"><em>EcuadorTLC S.A. v. Ecuador II<\/em><span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> case. As <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/11\/22\/ecuadortlc-ii-a-shift-in-investment-arbitration-through-the-own-acts-doctrine\/\" data-wpel-link=\"internal\">analyzed<\/a> by <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/gustavo-prieto\/\" data-wpel-link=\"internal\">Gustavo Prieto<\/a>, this arbitration arose from a contractual dispute between Ecuador and an oil consortium over the early termination of an agreement. In an interesting decision, the tribunal found that Ecuador could not re-litigate the matter based on the estoppel doctrine (<em>teor\u00eda de los actos propios<\/em>), which prevents parties from acting inconsistently with their prior conduct.<\/p>\n<p>On April 21, 2024, the government of Ecuador conducted a referendum and public consultation on various issues, including a question regarding whether citizens agree that the Ecuadorian State should recognize international arbitration as a method for resolving disputes related to investment, contractual, or commercial matters. <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/datoscano\/\" data-wpel-link=\"internal\">David Toscano<\/a>, <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/gaortega\/\" data-wpel-link=\"internal\">Gabriela Ortega<\/a>, and <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/searrieta\/\" data-wpel-link=\"internal\">Sebastian Arrieta<\/a> <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/06\/22\/did-ecuador-just-renounce-international-arbitration-the-aftermath-of-a-complex-referendum\/\" data-wpel-link=\"internal\">reported<\/a> that 65% of the population rejected the referendum. Despite the result, the referendum result does not alter the international arbitration framework. However, it reveals public opposition to a politicized view of international arbitration. In a related matter, the authors <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/03\/16\/ecuadors-constitutional-court-does-it-again-declaring-a-treaty-to-be-constitutional-only-because-it-does-not-contain-investor-state-arbitration-provisions\/\" data-wpel-link=\"internal\">discussed<\/a> a <a href=\"https:\/\/esacc.corteconstitucional.gob.ec\/storage\/api\/v1\/10_DWL_FL\/e2NhcnBldGE6J3RyYW1pdGUnLCB1dWlkOicyMmM4OTQ3Mi02YmNmLTQ4NzgtOGMyOC05ZGIwMjU5NDRiYTcucGRmJ30=\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">decision<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> issued by the Constitutional Court of Ecuador on July 28, 2023. The Court declared that the <a href=\"https:\/\/www.produccion.gob.ec\/wp-content\/uploads\/2023\/12\/Copia-de-FTA-COPY-ECUADOR-SPANISH_.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">Free Trade Agreement between Ecuador and the People\u2019s Republic of China<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> was constitutional because it does not include investor-State dispute resolution mechanisms or ICSID arbitration. A previous decision from the same court was analyzed <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2023\/12\/02\/ecuador-sends-mixed-signals-the-constitutional-court-wrongly-declared-a-treaty-containing-an-icsid-arbitration-provision-unconstitutional\/\" data-wpel-link=\"internal\">here<\/a>.<\/p>\n<p>Early in 2024, the award in <a href=\"https:\/\/jusmundi.com\/en\/document\/pdf\/decision\/en-worley-parsons-v-the-republic-of-ecuador-thursday-14th-february-2019\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\"><em>Worley Parsons\u00a0v. Ecuador<\/em><span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> surfaced<em>. <\/em>This decision joins the repertoire of cases in which tribunals have declined jurisdiction based on corruption allegations. <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/aorellana11\/\" data-wpel-link=\"internal\">Adriana Orellana<\/a> and <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/alegriaj\/\" data-wpel-link=\"internal\">Alegr\u00eda Jij\u00f3n<\/a> <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/04\/03\/worley-international-services-v-ecuador-the-what-when-and-how-in-corruption-allegations\/\" data-wpel-link=\"internal\">reported<\/a> that Ecuador challenged jurisdiction, citing several instances of alleged corruption and illegal acts committed by Worley during the investment\u2019s creation and operation, which the tribunal ultimately upheld.<\/p>\n<p>\u00a0<\/p>\n<ul>\n<li><strong>Per\u00fa: Metro de Lima Wins First Award<\/strong><\/li>\n<\/ul>\n<p>Earlier in 2024, a tribunal ruled on the first claim filed by Metro de Lima against Peru, awarding damages to the claimant. Although the decision is not public, a shareholder <a href=\"https:\/\/www.italaw.com\/sites\/default\/files\/case-documents\/180749.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">reported<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> that the claimant received a favorable ruling. There are two additional claims ongoing related to the same dispute.<\/p>\n<p>In a long-standing dispute between Rutas de Lima and Municipalidad de Lima, the latter failed to set aside two arbitral awards issued in two different arbitration proceedings. <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/jorgemanrique1\/\" data-wpel-link=\"internal\">Jorge Luis Manrique de Lara Seminario<\/a> <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/07\/09\/annulment-procedure-on-the-arbitral-awards-involving-long-standing-dispute-between-rutas-de-lima-and-municipalidad-de-lima\/\" data-wpel-link=\"internal\">reported<\/a> that on March 12, 2024, the District of Columbia (\u201cDC\u201d) Circuit issued a decision denying Municipalidad de Lima\u2019s petition to set aside both arbitration awards. The DC Circuit noted that to vacate an arbitral award, the proceeding must have significantly deviated from the FAA standards of fair adjudication, which according to the DC Circuit, the petitioner failed to demonstrate.<\/p>\n<p>\u00a0<\/p>\n<ul>\n<li><strong>Central America: Honduras Withdraws From ICSID<\/strong><\/li>\n<\/ul>\n<p>A significant event in Central America was Honduras\u2019s withdrawal from ICSID. On February 24, 2024, the <a href=\"https:\/\/icsid.worldbank.org\/news-and-events\/communiques\/honduras-denounces-icsid-convention\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">World Bank received<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> a written notice of denunciation of the ICSID Convention from the Republic of Honduras. According with Article 71 of the ICSID Convention, the denunciation took effect six months after the receipt of the notice. In 2024, five additional cases were <a href=\"https:\/\/icsid.worldbank.org\/cases\/case-database\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">registered by ICSID<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> against Honduras.<\/p>\n<p>Guatemala faced its first conciliation proceedings under the 2022 ICSID Rules (<a href=\"https:\/\/www.italaw.com\/cases\/10835\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\"><em>APM Terminals Management Barcelona, S.L.U. v Republic of Guatemala<\/em><span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a>). According to ICSID\u2019s website, on September 6, 2024, the Conciliation Commission issued its report.<\/p>\n<p>\u00a0<\/p>\n<ul>\n<li><strong>Bolivia: <em>Glencore v. Bolivia<\/em> <\/strong><\/li>\n<\/ul>\n<p>Bolivia received its long-awaited award in the case of <a href=\"https:\/\/pcacases.com\/web\/sendAttach\/50638\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\"><em>Glencore v. Bolivia<\/em><span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a>. <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/luis-miguel-velarde-saffer\/\" data-wpel-link=\"internal\">Luis Miguel Velarde<\/a> and <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/tehayes\/\" data-wpel-link=\"internal\">Tessa Hayes<\/a> <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/03\/05\/glencore-v-bolivia-a-long-awaited-award-finds-expropriation-and-fet-breaches-by-the-state\/\" data-wpel-link=\"internal\">analyzed<\/a> the decision and pointed several issues such as the tribunal\u2019s finding that Bolivia\u2019s obligations under the <a href=\"https:\/\/investmentpolicy.unctad.org\/international-investment-agreements\/treaties\/bit\/595\/bolivia-plurinational-state-of---united-kingdom-bit-1988-\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">UK-Bolivia BIT<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> are unaffected by its other international human arbitrations and that the reasonability of state action in the face of social unrest must be assessed considering the state\u2019s resources. In a separate <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/04\/09\/glencore-v-bolivia-is-the-uncertainty-of-the-unclean-hands-doctrine-finally-settled\/\" data-wpel-link=\"internal\">post<\/a>, <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/gabortega\/\" data-wpel-link=\"internal\">Gabriel Ortega<\/a> emphasized the tribunal\u2019s approach to applying the clean hands doctrine in their decision. Gabriel described the decision as an \u201cillustrative case\u201d of the approach to the unclean hands doctrine.<\/p>\n<p>\u00a0<\/p>\n<ul>\n<li><strong>Mexico: Mining Disputes on the Rise<\/strong><\/li>\n<\/ul>\n<p>Mexico continues to be one of the most sued countries in the region according to <a href=\"https:\/\/icsid.worldbank.org\/cases\/case-database\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\">ICSID\u2019s registered<span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> cases in different sectors such as oil and gas, mining, and energy. <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/fernando-rodriguez-cortina\/\" data-wpel-link=\"internal\">Fernando Rodriguez-Cortina<\/a> and <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/author\/arturo-oropeza-casas\/\" data-wpel-link=\"internal\">Arturo Oropeza Casas<\/a> <a href=\"https:\/\/arbitrationblog.kluwerarbitration.com\/2024\/06\/17\/do-international-mining-investors-have-an-fps-claim-against-mexico-for-cartel-extortion\/\" data-wpel-link=\"internal\">discussed<\/a> earlier in the year reported that the growing interference of Mexican drug cartels in mining activities presents a potential liability to the State. They added that, over the past three years, Mexico has faced numerous mining industry investment cases, mostly as \u201clegacy claims\u201d under NAFTA and that <a href=\"https:\/\/www.italaw.com\/cases\/10666\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\" class=\"wpel-icon-right\"><em>Silver Bull Resources v. Mexico<\/em><span class=\"wpel-icon wpel-image wpel-icon-3\"\/><\/a> will be the first case to adjudicate a dispute in which an international miner claims that extortion from local groups constitutes a breach of FPS. We will monitor and report in due course.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Conclusion<\/strong><\/p>\n<p>The 2024 developments in international investment arbitration in Latin America are evidence of its evolving landscape. The increase in arbitration cases, along with significant legal reforms (such as those in Mexico and Argentina) and emerging trends, reflect efforts to improve the region\u2019s arbitration framework.
