Central to this ecosystem are standards, which ensure technologies like wifi and 5G operate seamlessly across myriad devices. Unfortunately, the power imbalance created by some standard-essential patent (SEP) holders exploiting their gatekeeper position threatens the fabric of innovation and the livelihood of Europe\u2019s SMEs striving to compete globally.<\/p>\n
As a head of projects and chief strategist at LucidCircus<\/a>, I\u2019ve witnessed the challenges Europe\u2019s SMEs face when navigating the SEP landscape. Our clients, often SMEs as well, face resource constraints, making them particularly vulnerable to some of the larger SEP holders\u2019 anticompetitive licensing tactics. Overusing restrictive nondisclosure agreements worsen the situation and creates a market filled with information asymmetries. When facing the daunting prospect of years of gamesmanship and costly lawsuits, SMEs can be cornered into either accepting anti-FRAND licensing terms or abandoning the market entirely. It\u2019s a stark reality that a startup is far more acutely impacted by the SEP abuses, which negatively impact our ability to innovate and grow. To level the playing field, there\u2019s a pressing need for mechanisms that protect all enterprises from such damaging tactics, ensuring that we can compete and thrive in a market that values fairness and encourages innovation.<\/p>\n While no regulation is perfect, the proposed SEP Regulation recognizes the critical role of SMEs in driving technological and sustainable advancements, dismantles a range of well-known barriers to standards-based innovation, and levels the playing field. This proposed regulation offers a clearer path through the SEP landscape, enabling innovators to contribute more effectively to Europe\u2019s Digital Decade and ongoing green transition.<\/p>\n It\u2019s a pivotal moment for Europe\u2019s broader economy, offering an opportunity to foster a more inclusive, competitive and sustainable future.<\/p>\n<\/blockquote>\n<\/figure>\n SMEs are the backbone of European markets and the engine of European innovation, and the future of Europe\u2019s economic growth hinges on an improved FRAND SEP licensing landscape.
