Union of India<\/span><\/em><\/strong><span>\u00a0and connected matters, Justice Sachin Datta delivered a combined judgment covering 31 petitions from individuals seeking to have references to themselves removed from internet searches of court records \u2014 most involving cases that ended in acquittal, discharge, or private settlement.<\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"quFrX lqD6C s0dZt t5MrV\" dir=\"auto\" id=\"viewer-3f1wv458\" tabindex=\"-1\"><span class=\"_0nrb0\"><span>The Court did not order judgments to be deleted. It drew a distinction between two remedies:<\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<ul class=\"Q3HBV s0dZt\">\n<li dir=\"auto\" aria-level=\"1\" class=\"_6uFGs\" style=\"margin-inline-start:1.5em;list-style-type:disc\">\n<p class=\"quFrX lqD6C s0dZt t5MrV\" dir=\"\" id=\"viewer-uoxon462\" tabindex=\"-1\"><span class=\"_0nrb0\"><strong style=\"font-weight:700\"><span>De-indexing<\/span><\/strong><span>: Directed at search engines (Google) and legal database platforms (Indian Kanoon). The underlying judgment stays exactly where it is \u2014 the platform simply stops surfacing it against a name-based search. The order remains fully accessible by case number, citation, court, and date.<\/span><\/span><\/p>\n<\/li>\n<li dir=\"auto\" aria-level=\"1\" class=\"_6uFGs\" style=\"margin-inline-start:1.5em;list-style-type:disc\">\n<p class=\"quFrX lqD6C s0dZt t5MrV\" dir=\"\" id=\"viewer-9d8tk466\" tabindex=\"-1\"><span class=\"_0nrb0\"><strong style=\"font-weight:700\"><span>Masking<\/span><\/strong><span>: A separate, narrower remedy available at the level of the court record itself, where a party&#8217;s name in the publicly accessible version of a judgment is replaced with a neutral reference, while the original unredacted record is preserved internally. This has to be sought from the court that originally passed the order.<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"quFrX lqD6C s0dZt t5MrV\" dir=\"auto\" id=\"viewer-3epk9469\" tabindex=\"-1\"><span class=\"_0nrb0\"><span>Google was directed to de-index the relevant content from name-based search results. The appeal raises three core arguments:<\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<ol class=\"Nob7o s0dZt\">\n<li dir=\"auto\" aria-level=\"1\" class=\"_6uFGs\" style=\"margin-inline-start:1.5em;list-style-type:decimal\">\n<p class=\"quFrX lqD6C s0dZt t5MrV\" dir=\"\" id=\"viewer-vbdk5477\" tabindex=\"-1\"><span class=\"_0nrb0\"><strong style=\"font-weight:700\"><span>The standard is undefined.<\/span><\/strong><span>\u00a0The single judge&#8217;s test for de-indexing turns on whether information is &#8220;no longer relevant&#8221; or fails to serve a &#8220;legitimate public purpose.&#8221; Neither phrase is defined anywhere in law or in the judgment itself, which Indian Kanoon says leaves the door open to inconsistent, case-by-case outcomes rather than a workable rule.<\/span><\/span><\/p>\n<\/li>\n<li dir=\"auto\" aria-level=\"1\" class=\"_6uFGs\" style=\"margin-inline-start:1.5em;list-style-type:decimal\">\n<p class=\"quFrX lqD6C s0dZt t5MrV\" dir=\"\" id=\"viewer-myspi481\" tabindex=\"-1\"><span class=\"_0nrb0\"><strong style=\"font-weight:700\"><span>Open justice and public access.<\/span><\/strong><span>\u00a0Once information is part of a public court record, the appeal argues, privacy interests ordinarily give way to the public&#8217;s right to access it \u2014 subject to recognised exceptions such as sexual offence cases, juvenile matters, and other statutorily protected proceedings. Indian Kanoon contends the ruling extends privacy protection well beyond these established exceptions.<\/span><\/span><\/p>\n<\/li>\n<li dir=\"auto\" aria-level=\"1\" class=\"_6uFGs\" style=\"margin-inline-start:1.5em;list-style-type:decimal\">\n<p class=\"quFrX lqD6C s0dZt t5MrV\" dir=\"\" id=\"viewer-jd6bg485\" tabindex=\"-1\"><span class=\"_0nrb0\"><strong style=\"font-weight:700\"><span>Right to trade under Article 19(1)(g).<\/span><\/strong><span>\u00a0Name-based search, the appeal argues, is core to how lawyers, litigants, researchers, and even judges locate precedent. Restricting it, Indian Kanoon says, disproportionately affects a legal research platform&#8217;s ability to function and interferes with its constitutional right to carry on trade.<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"quFrX lqD6C s0dZt t5MrV\" dir=\"auto\" id=\"viewer-tkuzm488\" tabindex=\"-1\"><span class=\"_0nrb0\"><span>The Delhi High Court Bar Association has opposed the appeal, citing its impact on lawyers&#8217; practice and livelihood \u2014 pointing to how heavily the profession relies on being able to search case records by name.<\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"quFrX lqD6C s0dZt t5MrV\" dir=\"auto\" id=\"viewer-ht1bi490\" tabindex=\"-1\"><span class=\"_0nrb0\"><span>The matter was listed on July 14 but adjourned \u2014 counsel sought a short date since lawyers were abstaining from work that day over an unrelated issue (the pecuniary jurisdiction of Delhi&#8217;s district courts). It is now listed for <\/span><strong style=\"font-weight:700\"><span>July 21, 2026<\/span><\/strong><span>.<\/span><\/span><\/p>\n<\/div>\n<p><h2 class=\"NaJFE sRcyl s0dZt t5MrV\" dir=\"auto\" id=\"viewer-15a5o494\" tabindex=\"-1\"><span aria-hidden=\"https:\/\/www.aristolegal.co.in\/post\/true\" id=\"what-does-no-longer-relevant-actually-mean-right-now-15a5o494\"\/><span class=\"JLBCz\"><span>What does &#8220;no longer relevant&#8221; actually mean right now?<\/span><\/span><\/h2>\n<\/p>\n<div data-breakout=\"normal\">\n<p class=\"quFrX lqD6C s0dZt t5MrV\" dir=\"auto\" id=\"viewer-qitep496\" tabindex=\"-1\"><span class=\"_0nrb0\"><span>In practice \u2014 nothing precise yet, and that is exactly Indian Kanoon&#8217;s objection. The single judge&#8217;s order didn&#8217;t set out a checklist (e.g., a minimum number of years since the case concluded, or a defined list of case outcomes that automatically qualify). Instead, relief was granted petition-by-petition, largely turning on the fact pattern of each individual case \u2014 mostly acquittals, discharges, quashed proceedings, or matters of a private nature.<\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"quFrX lqD6C s0dZt t5MrV\" dir=\"auto\" id=\"viewer-cjc30498\" tabindex=\"-1\"><span class=\"_0nrb0\"><span>That means, as things stand, anyone wanting a similar remedy has to independently approach the Court and argue their own case on its facts. The Digital Personal Data Protection Act, 2023 addresses related data-privacy concepts but does not squarely cover de-indexing or masking of court records.
