Rather than a single change taking effect on one date, the Act rolls out in phases across 2026 and into 2027.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The scale of the Act is\u00a0substantial. Over 18 million workers are directly affected, including\u00a06.3 million employees\u00a0who gain accelerated protection from unfair dismissal and up to 1.3 million workers newly eligible for Statutory Sick Pay, according to the government\u2019s own\u00a0<a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/695e61e72a4a53b73d51382f\/employment-rights-act-analysis.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">economic analysis of the Act<\/a>.\u00a0Yet readiness varies sharply by business size: just <a href=\"https:\/\/www.cipd.org\/en\/about\/news\/employers-prioritise-cost-management-confidence-remains-weak\/\">20% of SMEs currently name regulatory compliance as an organisational priority<\/a>, compared to almost a third of larger firms (32%), according to CIPD\u2019s Winter 2025\/26 Labour Market Outlook.<\/p>\n<p class=\"wp-block-paragraph\">Employers are absorbing this change alongside other rising costs. The National Living Wage rose 4.1% to \u00a312.71 an hour from April 2026, adding further pressure on top of the Act\u2019s own requirements, according to\u00a0<a href=\"https:\/\/www.gov.uk\/government\/news\/national-living-wage-increases-to-1271-per-hour\" target=\"_blank\" rel=\"noreferrer noopener\">GOV.UK<\/a>.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">For HR teams and business leaders, this means preparation cannot wait until each implementation date arrives. Policies,\u00a0systems\u00a0and manager capability all need to evolve in step with the new legal landscape.<\/p>\n<p class=\"wp-block-paragraph\">This guide serves as the hub for everything HR teams need to know about the Act. It covers:<\/p>\n<ul class=\"wp-block-list\">\n<li>What the Act is designed to do, and the debate over its\u00a0true cost\u00a0to business\u00a0<\/li>\n<li>The key areas of change employers must prepare for\u00a0<\/li>\n<li>Reforms to NDAs, and the misinformation still circulating about the Act\u00a0<\/li>\n<li>What the Act means for recruitment, workforce planning, and what HR should do now\u00a0<\/li>\n<\/ul>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong>What the Act Is Designed to Do<\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">The Employment Rights Act 2025 forms part of the government\u2019s wider \u201cPlan to Make Work Pay\u201d agenda, aimed at ending what ministers describe as \u201cone-sided flexibility\u201d in the\u00a0labour\u00a0market.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The cost of delivering that ambition has shifted considerably as the Act moved through Parliament. The\u00a0government\u2019s\u00a0<a href=\"https:\/\/www.personneltoday.com\/hr\/employment-rights-acts-cost-impact-cut-by-80\/\" target=\"_blank\" rel=\"noreferrer noopener\">original 2024 impact assessment estimated costs to business at up to \u00a35 billion a year<\/a>. Following concessions made during the Bill\u2019s passage, including the move to a six-month unfair dismissal qualifying period rather than a day-one right, the\u00a0<a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/695e61e72a4a53b73d51382f\/employment-rights-act-analysis.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">updated January 2026 assessment<\/a>\u00a0revised this down to approximately\u00a0<strong>\u00a31 billion<\/strong>, or 0.1% of the UK\u2019s total pay bill. The\u00a0<a href=\"https:\/\/www.personneltoday.com\/hr\/employment-rights-acts-cost-impact-cut-by-80\/\" target=\"_blank\" rel=\"noreferrer noopener\">British Chambers of Commerce<\/a>\u00a0has publicly questioned whether that revised figure fully reflects the\u00a0true cost\u00a0to employers.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">On the benefits side,\u00a0<a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/695e61e72a4a53b73d51382f\/employment-rights-act-analysis.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">official modelling<\/a>\u00a0is comparatively modest: a\u00a0<strong>0.1% increase in employment<\/strong>\u00a0and a\u00a0<strong>0.04% boost to GDP<\/strong>. Independent analysis commissioned by the\u00a0<a href=\"https:\/\/www.tuc.org.uk\/blogs\/its-official-employment-rights-act-will-deliver-stronger-fairer-economy\" target=\"_blank\" rel=\"noreferrer noopener\">TUC<\/a>\u00a0puts the wider economic benefit\u00a0considerably higher, at an estimated\u00a0<strong>\u00a310 billion a year<\/strong>,\u00a0largely through\u00a0reduced workplace conflict and improved staff wellbeing.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">For employers, the detail of that debate matters less than the direction of travel it points to. The Act is designed to:<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>Expand employment rights from day one<\/strong>, reducing or removing qualifying service periods\u00a0<\/li>\n<li><strong>Increase employer accountability<\/strong>, particularly in high-risk areas such as dismissal, harassment and pay\u00a0<\/li>\n<li><strong>Reduce reliance on individual enforcement<\/strong>, through stronger state oversight and intervention\u00a0<\/li>\n<li><strong>Address insecure work<\/strong>, including zero-hours arrangements and short-notice shift cancellations\u00a0<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">In practical terms, this means a shift away from minimum-compliance thinking. It will no longer be enough to simply have policies in place. Employers will increasingly need to show that those policies are up to date, clearly communicated, applied consistently, and understood by managers.<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong>Key Areas of Change: Hub Summary<\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">The changes introduced by the Act span pay, absence, enforcement, dismissal, and workplace culture.\u00a0Here\u2019s what employers need to know about each, at a glance.<\/p>\n<p class=\"wp-block-paragraph\"><strong>Unfair Dismissal<\/strong>\u00a0<\/p>\n<p class=\"wp-block-paragraph\">From 1 January 2027, the qualifying period for unfair dismissal claims falls from two years to six months. This is a change from the Act\u2019s original proposal: a day-one right to claim unfair dismissal was dropped before Royal Assent, in\u00a0favour\u00a0of the six-month model that survived into the final legislation, according to law firm commentary from\u00a0<a href=\"https:\/\/knowledge.dlapiper.com\/dlapiperknowledge\/globalemploymentlatestdevelopments\/2025\/ERB-receives-royal-assent-\" target=\"_blank\" rel=\"noreferrer noopener\">DLA Piper<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.slaughterandmay.com\/insights\/new-insights\/employment-rights-act\/\" target=\"_blank\" rel=\"noreferrer noopener\">Slaughter and May<\/a>. Alongside this, the statutory cap on unfair dismissal compensation, previously the lower of \u00a3118,223 or\u00a052 weeks\u2019 pay, is removed entirely, materially increasing employers\u2019 financial exposure.\u00a0<\/p>\n<p class=\"wp-block-paragraph\"><strong>Statutory Sick Pay Reform<\/strong>\u00a0<\/p>\n<p class=\"wp-block-paragraph\">From April 2026, SSP becomes a day-one right for all employees, per\u00a0<a href=\"https:\/\/www.acas.org.uk\/employment-rights-act-2025\" target=\"_blank\" rel=\"noreferrer noopener\">Acas<\/a>\u00a0guidance. The three-day waiting period and the lower earnings limit are both removed. Under the <a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/695fb36d47867b8e14f764fb\/statutory-sick-pay-factsheet.pdf\">government\u2019s Employment Rights Act SSP factsheet<\/a>, employees are paid whichever is lower: the standard flat rate, or 80% of their normal weekly earnings.\u00a0<\/p>\n<p class=\"wp-block-paragraph\"><strong>The Fair Work Agency<\/strong>\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Launched on 7 April 2026, the Fair Work Agency\u00a0consolidates\u00a0enforcement powers previously spread across several bodies. It can issue penalties of up to 200% of any underpayment\u00a0identified, capped at \u00a320,000 per worker (reduced to 100% if settled within 14 days), and can review employer records going back up to six years, according to the\u00a0<a href=\"https:\/\/www.gov.uk\/government\/publications\/fair-work-agency-enforcement-policy-statement\/fair-work-agency-enforcement-statement\" target=\"_blank\" rel=\"noreferrer noopener\">official enforcement statement<\/a>.\u00a0<\/p>\n<p class=\"wp-block-paragraph\"><strong>Employment Tribunal Risk<\/strong>\u00a0<\/p>\n<p class=\"wp-block-paragraph\">From October 2026, the time limit for bringing most tribunal claims doubles from three months to six, according to\u00a0<a href=\"https:\/\/www.littler.com\/news-analysis\/asap\/looking-forward-october-2026-next-phase-changes-under-uk-employment-rights-act\" target=\"_blank\" rel=\"noreferrer noopener\">Littler<\/a>. This lands against a system already under strain: single tribunal claims were <a href=\"https:\/\/www.gov.uk\/government\/statistics\/tribunals-statistics-quarterly-october-to-december-2025\/tribunal-statistics-quarterly-october-to-december-2025--2\">up 54% year-on-year in Q3 2025\/26<\/a>, according to provisional Ministry of Justice figures. Combined with the separately extended 12-week\u00a0Acas\u00a0Early Conciliation window, a workplace dispute can now remain legally live for up to ten months after an employee leaves, making thorough record-keeping more important than ever.\u00a0<\/p>\n<p class=\"wp-block-paragraph\"><strong>Zero-Hours Contracts<\/strong>\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Reforms guaranteeing hours reflective of actual working patterns are expected from 2027. This lands against a backdrop of rising zero-hours\u00a0use: a record 1.23 million UK workers are currently on zero-hours\u00a0contracts, including 1 in 8 young workers, according to\u00a0<a href=\"https:\/\/www.lancaster.ac.uk\/work-foundation\/news\/zero-hour-contracts-reach-new-record-high-as-workers-wait-for-new-rights-to-arrive\" target=\"_blank\" rel=\"noreferrer noopener\">Work Foundation analysis of ONS data<\/a>.\u00a0<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong>NDA Reform: New Limits on Confidentiality<\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">Alongside its better-known provisions, the Act introduces significant new restrictions on how non-disclosure agreements can be used.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Under the new rules, NDAs will be unenforceable where they are used to prevent employees or witnesses from reporting or discussing harassment, discrimination, or abuse. In practice, this means:<\/p>\n<ul class=\"wp-block-list\">\n<li>Settlement agreements must include clear carve-outs allowing individuals to speak to police, regulators, or legal advisors\u00a0<\/li>\n<\/ul>\n<ul class=\"wp-block-list\">\n<li>Existing grievance, disciplinary and whistleblowing procedures should be reviewed against this standard\u00a0<\/li>\n<\/ul>\n<ul class=\"wp-block-list\">\n<li>Employers should move toward a culture of openness, with stronger protections for those who raise concerns<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">This is a meaningful shift from how NDAs have traditionally been used in workplace settlements, and\u00a0it\u2019s\u00a0worth reviewing any standard settlement agreement templates well before the wider provisions of the Act come into force.<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong>Other Confirmed Changes You May Have Missed<\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">Beyond NDAs, a handful of further provisions round out the Act. None will dominate headlines the way unfair dismissal reform or the Fair Work Agency have, but each carries its own compliance deadline:<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>Tipping law reforms.<\/strong>\u00a0From October 2026, employers must formally consult staff or trade union representatives before drafting or revising tipping\u00a0policies, and\u00a0must review those policies at least once every three years, according to\u00a0<a href=\"https:\/\/www.acas.org.uk\/employment-rights-act-2025\" target=\"_blank\" rel=\"noreferrer noopener\">Acas<\/a>\u00a0and confirmed in the\u00a0government\u2019s\u00a0<a href=\"https:\/\/www.gov.uk\/government\/publications\/implementing-the-plan-to-make-work-pay-and-employment-rights-act\/plan-to-make-work-pay-and-employment-rights-act-timeline-update\" target=\"_blank\" rel=\"noreferrer noopener\">consultation on strengthening the law on tipping<\/a>.\u00a0<\/li>\n<li><strong>Adult Social Care Fair Pay Agreement.<\/strong>\u00a0A new sector-specific negotiating body will set minimum pay,\u00a0terms\u00a0and conditions across the adult social care sector, backed by\u00a0<a href=\"https:\/\/www.gov.uk\/government\/news\/500m-for-first-ever-fair-pay-agreement-for-care-workers\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a3500 million in government funding<\/a>, with the first agreement expected in 2028.\u00a0<\/li>\n<li><strong>Reasonable notice and\u00a0shift-cancellation\u00a0compensation.<\/strong>\u00a0Alongside the guaranteed-hours reform covered above, workers will also gain rights to reasonable notice of shifts and compensation for shifts cancelled at short notice, per\u00a0<a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/6a1d6024c7335e2ca6daad8c\/zero-hours-contracts.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">GOV.UK\u2019s factsheet on zero-hours reforms<\/a>.\u00a0<\/li>\n<li><strong>Mandatory gender\u00a0pay\u00a0and menopause action plans.<\/strong>\u00a0Voluntary from 6 April 2026, becoming mandatory for employers with 250 or more workers in 2027, per\u00a0<a href=\"https:\/\/www.acas.org.uk\/employment-rights-act-2025\" target=\"_blank\" rel=\"noreferrer noopener\">Acas<\/a>\u00a0guidance.\u00a0<\/li>\n<li><strong>Umbrella company\u00a0regulation.<\/strong>\u00a0The Act expands the legal definition of \u201cemployment business\u201d to bring umbrella companies into scope, introducing new oversight of pay and deductions for agency workers, per\u00a0<a href=\"https:\/\/www.littler.com\/news-analysis\/asap\/latest-updates-uk-employment-rights-act-2025-revised-implementation-timeline-and\" target=\"_blank\" rel=\"noreferrer noopener\">Littler<\/a>\u00a0analysis.\u00a0<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">Each is easy to miss if attention stays fixed on the headline changes alone, but worth having on your radar before the relevant deadline arrives.\u00a0<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong>Cutting Through the Noise<\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">With legislation this wide-ranging,\u00a0it\u2019s\u00a0no surprise that misinformation has circulated alongside the genuine detail. A few claims are worth addressing directly.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Media reports have suggested, inaccurately, that the Act mandates\u00a0diversity\u00a0quotas or bans certain types of workplace conversation. Government sources have firmly denied these claims, clarifying that:<\/p>\n<ul class=\"wp-block-list\">\n<li>Employers\u00a0are not required to\u00a0appoint diversity officers\u00a0<\/li>\n<\/ul>\n<ul class=\"wp-block-list\">\n<li>There is no legal prohibition on workplace conversation, provided it does not amount to harassment or discrimination\u00a0<\/li>\n<\/ul>\n<ul class=\"wp-block-list\">\n<li>NDAs are not banned outright, but are being reformed specifically to protect whistleblowers and victims of misconduct, as covered in the\u00a0previous\u00a0section\u00a0<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">For HR professionals, the safest approach is to rely on official guidance and seek legal advice where needed, rather than responding to unverified reports or secondhand summaries. Given how much of the Act\u2019s detail is still being\u00a0finalised\u00a0through secondary legislation, this is likely to remain true throughout 2026 and 2027.<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong>Recruitment and Employment Strategy Implications<\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">The Act is already shaping how employers approach hiring, well ahead of most provisions taking effect.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">According to\u00a0<a href=\"https:\/\/www.cipd.org\/en\/about\/press-releases\/employment-rights-act-handbrake-on-hiring-labour-market-outlook-winter-25-26\/\" target=\"_blank\" rel=\"noreferrer noopener\">CIPD\u2019s Winter 2025\/26 Labour Market Outlook<\/a>, a survey of 2,082 UK employers, the net employment balance (the difference between employers expecting to increase headcount and those expecting to reduce it) has fallen to +7, the lowest level recorded outside the pandemic. More than a third of employers (37%) say they plan to hire fewer permanent staff as a direct result of the Act\u2019s reforms, and 74% expect their employment costs to rise.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">This points to a real risk worth planning around: employers responding to increased cost and risk by leaning more heavily on temporary staff, self-employed contractors, or automation, rather than permanent headcount. For recruitment and workforce planning teams, this makes it worth revisiting hiring strategy now, rather than waiting for each provision to land individually.<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong>What HR Should Do Now<\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">Despite the scale of the changes ahead, many\u00a0organisations\u00a0are further behind than\u00a0they\u2019d\u00a0like to be. A\u00a0<a href=\"https:\/\/solicitornews.co.uk\/employers-not-ready-employment-rights-act\/\" target=\"_blank\" rel=\"noreferrer noopener\">survey by law firm Birketts<\/a>\u00a0found that 81% of HR professionals and business leaders describe their\u00a0organisation\u00a0as only \u201csomewhat prepared\u201d for the Act, and just 9% consider themselves fully prepared.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">To close that gap, employers should focus on three priorities:\u00a0<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>Audit.<\/strong>\u00a0Review existing policies, pay practices and\u00a0records\u00a0against each area of change covered above, particularly sick pay, dismissal and probation, and record-keeping.\u00a0<\/li>\n<\/ul>\n<ul class=\"wp-block-list\">\n<li><strong>Train managers, not just HR teams.<\/strong>\u00a0Line managers are the ones who will handle the practical impact of these\u00a0changes\u00a0day to day, from probation decisions to\u00a0absence\u00a0conversations, and most have had no dedicated preparation for it.\u00a0<\/li>\n<\/ul>\n<ul class=\"wp-block-list\">\n<li><strong>Build internal confidence.<\/strong>\u00a0Employment law decision-making will come under more scrutiny, from both employees and the Fair Work Agency.
