Today, health care fraud is\u00a0<\/span>everywhere\u00a0<\/roshu><\/span>the news. There undoubtedly is fraud in health care.\u00a0<\/span>an equivalent\u00a0<\/roshu><\/span>is true\u00a0<\/span>for each\u00a0<\/roshu><\/span>business or endeavor touched by human hands, e.g. banking, credit, insurance, politics, etc.\u00a0<\/span>there’s\u00a0<\/roshu><\/span>no doubt\u00a0<\/roshu><\/span>that health care providers who abuse their position and our trust to steal are\u00a0<\/span>a drag\u00a0<\/roshu><\/span>. So are those from other professions who do\u00a0<\/span>an equivalent\u00a0<\/roshu><\/span>.<\/span><\/p>\n

Why does health care fraud appear\u00a0<\/span>to urge\u00a0<\/roshu><\/span>the ‘lions-share’ of attention? Could\u00a0<\/span>it’s\u00a0<\/roshu><\/span>that\u00a0<\/span>it’s\u00a0<\/roshu><\/span>the right\u00a0<\/roshu><\/span>vehicle to drive agendas for divergent groups where taxpayers, health care consumers and health care providers are dupes\u00a0<\/span>during a\u00a0<\/roshu><\/span>health care fraud shell-game operated with ‘sleight-of-hand’ precision?<\/span><\/p>\n

Take\u00a0<\/span>a better\u00a0<\/roshu><\/span>look and one finds\u00a0<\/span>this is often\u00a0<\/roshu><\/span>no game-of-chance. Taxpayers, consumers and providers always lose because\u00a0<\/span>the matter\u00a0<\/roshu><\/span>with health care fraud\u00a0<\/span>isn’t\u00a0<\/roshu><\/span>just the fraud, but\u00a0<\/span>it’s\u00a0<\/roshu><\/span>that our government and insurers use the fraud problem to further agendas while at\u00a0<\/span>an equivalent\u00a0<\/roshu><\/span>time fail to be accountable and take responsibility for a fraud problem they facilitate\u00a0<\/span>and permit\u00a0<\/roshu><\/span>to flourish.<\/span><\/p>\n

1. Astronomical Cost Estimates<\/span><\/p>\n

What better\u00a0<\/span>thanks to\u00a0<\/roshu><\/span>report on fraud then to tout fraud cost estimates, e.g.<\/span><\/p>\n

– “Fraud perpetrated against both public\u00a0<\/span>and personal\u00a0<\/roshu><\/span>health plans costs between $72 and $220 billion annually, increasing\u00a0<\/span>the value\u00a0<\/roshu><\/span>of\u00a0<\/span>medical aid\u00a0<\/roshu><\/span>and\u00a0<\/span>insurance\u00a0<\/roshu><\/span>and undermining\u00a0<\/span>charitable trust\u00a0<\/roshu><\/span>in our health care system…\u00a0<\/span>it’s\u00a0<\/roshu><\/span>not\u00a0<\/roshu><\/span>a secret that fraud represents\u00a0<\/span>one among\u00a0<\/roshu><\/span>the fastest growing and\u00a0<\/span>most expensive\u00a0<\/roshu><\/span>sorts of\u00a0<\/roshu><\/span>crime in America today… We pay these costs as taxpayers\u00a0<\/span>and thru\u00a0<\/roshu><\/span>higher\u00a0<\/span>insurance\u00a0<\/roshu><\/span>premiums… We must be proactive in combating health care fraud and abuse… We must also\u00a0<\/span>make sure that\u00a0<\/roshu><\/span>enforcement\u00a0<\/roshu><\/span>has the tools that it\u00a0<\/span>must\u00a0<\/roshu><\/span>deter, detect, and punish health care fraud.” [Senator Ted Kaufman (D-DE), 10\/28\/09 press release]<\/span><\/p>\n

–\u00a0<\/span>the overall\u00a0<\/roshu><\/span>Accounting Office (GAO) estimates that fraud in healthcare ranges from $60 billion to $600 billion\u00a0<\/span>per annum\u00a0<\/roshu><\/span>– or anywhere between 3% and 10% of the $2 trillion health care budget. [Health Care Finance News reports, 10\/2\/09] The GAO\u00a0<\/span>is that the\u00a0<\/roshu><\/span>investigative arm of Congress.<\/span><\/p>\n

– The National Health Care Anti-Fraud Association (NHCAA) reports over $54 billion is stolen\u00a0<\/span>per annum\u00a0<\/roshu><\/span>in scams designed\u00a0<\/span>to stay\u00a0<\/roshu><\/span>us and our insurance companies with fraudulent and illegal medical charges. [NHCAA, web-site] NHCAA was created and is funded by\u00a0<\/span>insurance\u00a0<\/roshu><\/span>companies.<\/span><\/p>\n

Unfortunately, the reliability of the purported estimates is dubious\u00a0<\/span>at the best\u00a0<\/roshu><\/span>. Insurers, state and federal agencies,\u00a0<\/span>et al.\u00a0<\/roshu><\/span>may gather fraud data\u00a0<\/span>associated with\u00a0<\/roshu><\/span>their own missions, where\u00a0<\/span>the type\u00a0<\/roshu><\/span>, quality and volume\u00a0<\/span>of knowledge\u00a0<\/roshu><\/span>compiled varies widely. David Hyman, professor of Law, University of Maryland, tells us that the widely-disseminated estimates of the incidence of health care fraud and abuse (assumed to be 10% of total spending) lacks any empirical foundation\u00a0<\/span>in the least\u00a0<\/roshu><\/span>,\u00a0<\/span>the small\u00a0<\/roshu><\/span>we do\u00a0<\/span>realize\u00a0<\/roshu><\/span>health care fraud and abuse is dwarfed by what\u00a0<\/span>we do not\u00a0<\/roshu><\/span>know and what\u00a0<\/span>we all know\u00a0<\/roshu><\/span>that’s\u00a0<\/roshu><\/span>not so. [The Cato Journal, 3\/22\/02]<\/span><\/p>\n

2. Health Care Standards<\/span><\/p>\n

The laws & rules governing health care – vary from state to state and from payor to payor – are extensive\u00a0<\/span>and really\u00a0<\/roshu><\/span>confusing for providers\u00a0<\/span>et al.\u00a0<\/roshu><\/span>to know\u00a0<\/roshu><\/span>as\u00a0<\/span>they’re\u00a0<\/roshu><\/span>written in legalese and not plain speak.<\/span><\/p>\n

Providers use specific codes to report conditions treated (ICD-9) and services rendered (CPT-4 and HCPCS). These codes are used when seeking compensation from payors for services rendered to patients. Although created to universally apply to facilitate accurate reporting to reflect providers’ services, many insurers instruct providers to report codes\u00a0<\/span>supported\u00a0<\/roshu><\/span>what the insurer’s computer editing programs recognize – not on what the provider rendered. Further, practice building consultants instruct providers on what codes to\u00a0<\/span>report back to\u00a0<\/roshu><\/span>get paid – in some cases codes that\u00a0<\/span>don’t\u00a0<\/roshu><\/span>accurately reflect the provider’s service.<\/span><\/p>\n

Consumers know what services they receive from their doctor or other provider but\u00a0<\/span>might not\u00a0<\/roshu><\/span>have a clue\u00a0<\/span>on\u00a0<\/roshu><\/span>what those billing codes or service descriptors mean on explanation\u00a0<\/span>of advantages\u00a0<\/roshu><\/span>received from insurers. This lack of understanding may\u00a0<\/span>end in\u00a0<\/roshu><\/span>consumers moving on without gaining clarification of what the codes mean, or may\u00a0<\/span>end in\u00a0<\/roshu><\/span>some believing they were improperly billed. The multitude of insurance plans available today, with varying levels of coverage, ad a wild card to the equation when services are denied for non-coverage – especially if\u00a0<\/span>it’s\u00a0<\/roshu><\/span>Medicare that denotes non-covered services as not medically necessary.<\/span><\/p>\n

3. Proactively addressing the health care fraud problem<\/span><\/p>\n

The government and insurers do\u00a0<\/span>little or no\u00a0<\/roshu><\/span>to proactively address\u00a0<\/span>the matter\u00a0<\/roshu><\/span>with tangible activities\u00a0<\/span>which will\u00a0<\/roshu><\/span>end in\u00a0<\/roshu><\/span>detecting inappropriate claims before\u00a0<\/span>they’re\u00a0<\/roshu><\/span>paid. Indeed, payors of health care claims proclaim\u00a0<\/span>to work\u00a0<\/roshu><\/span>a payment system\u00a0<\/span>supported\u00a0<\/roshu><\/span>trust that providers bill accurately for services rendered, as\u00a0<\/span>they will\u00a0<\/roshu><\/span>not review every claim before payment\u00a0<\/span>is formed\u00a0<\/roshu><\/span>because the reimbursement system would\u00a0<\/span>pack up\u00a0<\/roshu><\/span>.<\/span><\/p>\n

They claim to use sophisticated computer programs\u00a0<\/span>to seem\u00a0<\/roshu><\/span>for errors and patterns in claims, have increased pre- and post-payment audits of selected providers to detect fraud, and have created consortiums and task forces consisting of law enforcers and insurance investigators\u00a0<\/span>to review\u00a0<\/roshu><\/span>the matter\u00a0<\/roshu><\/span>and share fraud information. However, this activity, for\u00a0<\/span>the foremost\u00a0<\/roshu><\/span>part, is\u00a0<\/span>handling\u00a0<\/roshu><\/span>activity after the claim is paid and has little\u00a0<\/span>pertaining to\u00a0<\/roshu><\/span>the proactive detection of fraud.<\/span><\/p>\n

4. Exorcise health care fraud with the creation\u00a0<\/span>of latest\u00a0<\/roshu><\/span>laws<\/span><\/p>\n

The government’s reports on the fraud problem are published in earnest in conjunction with efforts to reform our health care system, and our experience shows us that it ultimately\u00a0<\/span>leads to\u00a0<\/roshu><\/span>the govt\u00a0<\/roshu><\/span>introducing and enacting new laws – presuming new laws will\u00a0<\/span>end in\u00a0<\/roshu><\/span>more fraud detected, investigated and prosecuted – without establishing how new laws will accomplish this more effectively than existing laws that\u00a0<\/span>weren’t\u00a0<\/roshu><\/span>wont to\u00a0<\/roshu><\/span>their full potential.<\/span><\/p>\n

With such efforts in 1996, we got the\u00a0<\/span>insurance\u00a0<\/roshu><\/span>Portability and Accountability Act (HIPAA).\u00a0<\/span>it had been\u00a0<\/roshu><\/span>enacted by Congress\u00a0<\/span>to deal with\u00a0<\/roshu><\/span>insurance portability and accountability for patient privacy and health care fraud and abuse. HIPAA purportedly was to equip federal law enforcers and prosecutors with the tools to attack fraud, and resulted\u00a0<\/span>within the\u00a0<\/roshu><\/span>creation of\u00a0<\/span>variety\u00a0<\/roshu><\/span>of latest\u00a0<\/roshu><\/span>health care fraud statutes, including: Health Care Fraud, Theft or Embezzlement in Health Care, Obstructing Criminal Investigation of Health Care, and False Statements\u00a0<\/span>concerning\u00a0<\/roshu><\/span>Health Care Fraud Matters.<\/span><\/p>\n

In 2009, the Health Care Fraud Enforcement Act appeared on the scene. This act has recently been introduced by Congress with promises that\u00a0<\/span>it’ll\u00a0<\/roshu><\/span>repose on\u00a0<\/roshu><\/span>fraud prevention efforts and strengthen the governments’ capacity\u00a0<\/span>to research\u00a0<\/roshu><\/span>and prosecute waste, fraud and abuse in both government\u00a0<\/span>and personal\u00a0<\/roshu><\/span>insurance\u00a0<\/roshu><\/span>by sentencing increases; redefining health care fraud offense; improving whistleblower claims; creating common-sense\u00a0<\/span>psychological state\u00a0<\/roshu><\/span>requirement for health care fraud offenses; and increasing funding in federal antifraud spending.<\/span><\/p>\n

Undoubtedly, law enforcers and prosecutors MUST have the tools to effectively do their jobs. However, these actions alone, without inclusion of some tangible and significant before-the-claim-is-paid actions, will have little impact on reducing the occurrence of\u00a0<\/span>the matter\u00a0<\/roshu><\/span>.<\/span><\/p>\n

What’s one person’s fraud (insurer alleging medically unnecessary services) is another person’s savior (provider administering tests to defend against potential lawsuits from legal sharks). Is tort reform\u00a0<\/span>an opportunity\u00a0<\/roshu><\/span>from those pushing for health care reform? Unfortunately,\u00a0<\/span>it’s\u00a0<\/roshu><\/span>not! Support for legislation placing new and onerous requirements on providers\u00a0<\/span>within the\u00a0<\/roshu><\/span>name of fighting fraud, however,\u00a0<\/span>doesn’t\u00a0<\/roshu><\/span>appear to be\u00a0<\/span>a drag\u00a0<\/roshu><\/span>.<\/span><\/p>\n

If Congress really wants to use its legislative powers\u00a0<\/span>to form\u00a0<\/roshu><\/span>a difference on the fraud problem\u00a0<\/span>they need to\u00a0<\/roshu><\/span>think outside-the-box of what has already been\u00a0<\/span>wiped out\u00a0<\/roshu><\/span>some form or fashion.\u00a0<\/span>specialise in\u00a0<\/roshu><\/span>some front-end activity that deals with addressing the fraud before it happens.\u00a0<\/span>the subsequent\u00a0<\/roshu><\/span>are illustrative of steps\u00a0<\/span>that would\u00a0<\/roshu><\/span>be taken in\u00a0<\/span>an attempt\u00a0<\/roshu><\/span>to stem-the-tide on fraud and abuse:<\/span><\/p>\n

– DEMAND all payors and providers, suppliers\u00a0<\/span>et al.\u00a0<\/roshu><\/span>only use approved coding systems, where the codes are clearly defined for ALL\u00a0<\/span>to understand\u00a0<\/roshu><\/span>and understand what\u00a0<\/span>the precise\u00a0<\/roshu><\/span>code means. Prohibit anyone from deviating from the defined meaning when reporting services rendered (providers, suppliers) and adjudicating claims for payment (payors and others). Make violations a strict liability issue.<\/span><\/p>\n

– REQUIRE\u00a0<\/span>that each one\u00a0<\/roshu><\/span>submitted claims to public\u00a0<\/span>and personal\u00a0<\/roshu><\/span>insurers be signed or annotated in some fashion by the patient (or appropriate representative) affirming they received the reported and billed services. If such affirmation\u00a0<\/span>isn’t\u00a0<\/roshu><\/span>present claim isn’t paid. If the claim is later determined to be problematic investigators have\u00a0<\/span>the power\u00a0<\/roshu><\/span>to speak\u00a0<\/roshu><\/span>with both the provider\u00a0<\/span>and therefore the\u00a0<\/roshu><\/span>patient…<\/span><\/p>\n

– REQUIRE\u00a0<\/span>that each one\u00a0<\/roshu><\/span>claims-handlers (especially if\u00a0<\/span>they need\u00a0<\/roshu><\/span>authority to pay claims), consultants retained by insurers\u00a0<\/span>to help\u00a0<\/roshu><\/span>on adjudicating claims, and fraud investigators be certified by a national accrediting company under the purview of\u00a0<\/span>the govt\u00a0<\/roshu><\/span>to exhibit that\u00a0<\/span>they need\u00a0<\/roshu><\/span>the requisite understanding for recognizing health care fraud,\u00a0<\/span>and therefore the\u00a0<\/roshu><\/span>knowledge to detect and investigate the fraud in health care claims. If such accreditation\u00a0<\/span>isn’t\u00a0<\/roshu><\/span>obtained, then neither\u00a0<\/span>the worker\u00a0<\/roshu><\/span>nor the consultant would be permitted\u00a0<\/span>to the touch\u00a0<\/roshu><\/span>a health care claim or investigate suspected health care fraud.<\/span><\/p>\n

– PROHIBIT public\u00a0<\/span>and personal\u00a0<\/roshu><\/span>payors from asserting fraud on claims previously paid where\u00a0<\/span>it’s\u00a0<\/roshu><\/span>established that the payor knew or should have known the claim was improper\u00a0<\/span>and will\u00a0<\/roshu><\/span>not\u00a0<\/span>are\u00a0<\/roshu><\/span>paid. And, in those cases where fraud is established in paid claims any monies collected from providers and suppliers for overpayments be deposited into a national account to fund various fraud and abuse\u00a0<\/span>education schemes\u00a0<\/roshu><\/span>for consumers, insurers, law enforcers, prosecutors, legislators and others; fund front-line investigators for state health care regulatory boards\u00a0<\/span>to research\u00a0<\/roshu><\/span>fraud in their respective jurisdictions;\u00a0<\/span>also\u00a0<\/roshu><\/span>as funding other health care related activity.<\/span><\/p>\n

– PROHIBIT insurers from raising premiums of policyholders\u00a0<\/span>supported\u00a0<\/roshu><\/span>estimates of the occurrence of fraud. Require insurers\u00a0<\/span>to determine\u00a0<\/roshu><\/span>a factual basis for purported losses attributed to fraud\u00a0<\/span>including\u00a0<\/roshu><\/span>showing tangible proof of their efforts to detect and investigate fraud,\u00a0<\/span>also\u00a0<\/roshu><\/span>as not paying fraudulent claims.<\/span><\/p>\n

5. Insurers are victims of health care fraud<\/span><\/p>\n

Insurers, as\u00a0<\/span>a daily\u00a0<\/roshu><\/span>course of business, offer reports on fraud to present themselves as victims of fraud by deviant providers and suppliers.<\/span><\/p>\n

It is disingenuous for insurers to proclaim victim-status\u00a0<\/span>once they\u00a0<\/roshu><\/span>have\u00a0<\/span>the power\u00a0<\/roshu><\/span>to review claims before\u00a0<\/span>they’re\u00a0<\/roshu><\/span>paid, but choose\u00a0<\/span>to not\u00a0<\/roshu><\/span>because\u00a0<\/span>it might\u00a0<\/roshu><\/span>impact the flow of the reimbursement system\u00a0<\/span>that’s\u00a0<\/roshu><\/span>under-staffed. Further, for years, insurers have operated within a culture where fraudulent claims were just\u00a0<\/span>a neighborhood\u00a0<\/roshu><\/span>of\u00a0<\/span>the value\u00a0<\/roshu><\/span>of doing business. Then, because they were victims of the putative fraud, they pass these losses on to policyholders\u00a0<\/span>within the\u00a0<\/roshu><\/span>sort of\u00a0<\/roshu><\/span>higher premiums (despite the duty\u00a0<\/span>and skill\u00a0<\/roshu><\/span>to review claims before\u00a0<\/span>they’re\u00a0<\/roshu><\/span>paid). Do your premiums\u00a0<\/span>still\u00a0<\/roshu><\/span>rise?<\/span><\/p>\n

Insurers make\u00a0<\/span>plenty\u00a0<\/roshu><\/span>of cash\u00a0<\/roshu><\/span>, and under the cloak of fraud-fighting, are now keeping more of it by alleging fraud in claims to avoid paying legitimate claims,\u00a0<\/span>also\u00a0<\/roshu><\/span>as going after monies paid on claims for services performed\u00a0<\/span>a few years\u00a0<\/roshu><\/span>prior from providers too petrified to fight-back. Additionally, many insurers, believing\u00a0<\/span>a scarcity\u00a0<\/roshu><\/span>of responsiveness by law enforcers, file civil suits against providers and entities alleging fraud.<\/span><\/p>\n

6. Increased investigations and prosecutions of health care fraud<\/span><\/p>\n

Purportedly,\u00a0<\/span>the govt\u00a0<\/roshu><\/span>(and insurers) have assigned more people\u00a0<\/span>to research\u00a0<\/roshu><\/span>fraud, are conducting more investigations, and are prosecuting more fraud offenders.<\/span><\/p>\n

With\u00a0<\/span>the rise\u00a0<\/roshu><\/span>within the\u00a0<\/roshu><\/span>numbers of investigators,\u00a0<\/span>it’s\u00a0<\/roshu><\/span>not uncommon for law enforcers assigned\u00a0<\/span>to figure\u00a0<\/roshu><\/span>fraud cases to lack the knowledge and understanding for working these\u00a0<\/span>sorts of\u00a0<\/roshu><\/span>cases.\u00a0<\/span>it’s\u00a0<\/roshu><\/span>also not uncommon that law enforcers from multiple agencies expend their investigative efforts\u00a0<\/span>and various\u00a0<\/roshu><\/span>man-hours by\u00a0<\/span>performing on\u00a0<\/roshu><\/span>an equivalent\u00a0<\/roshu><\/span>fraud case.<\/span><\/p>\n<\/div>\n\n","protected":false},"excerpt":{"rendered":"
