Agricultural
\nLabor:\u00a0Maryland Court\u00a0of Appeals Finds Tyson\u00a0Farms\u00a0Not
\nCo-Employer of\u00a0Poultry\u00a0Farm Employee<\/span><\/b>\u00a0<\/span><\/p>\n

On November 20, 2020, the
\nCourt of Appeals of Maryland issued an\u00a0opinion<\/span><\/a>\u00a0reversing
\nthe decision of the Maryland Court of Special Appeals and\u00a0finding that
\nTyson Farms was not a co-employer of a Maryland poultry
\nfarm\u00a0worker\u00a0who sustained an occupational\u00a0lung
\ndisease\u00a0during his\u00a0employment and residence on a Worcester County
\nchicken farm.\u00a0\u00a0In\u00a0overturning\u00a0a jury verdict from the
\nCircuit Court for Worcester County, which found\u00a0Tyson not to be a joint
\nemployer,\u00a0the\u00a0majority of\u00a0a Maryland Court of Special Appeals
\npanel\u00a0reversed the trial court and\u00a0determined that Tyson\u00a0was
\na\u00a0co-employer with the farm owner\u2014who had failed to carry worker\u2019s
\ncompensation insurance\u2014and awarded compensation for the worker.\u00a0 Tyson
\nappealed the Court of Special Appeals decision to the Maryland Court of
\nAppeals, which\u00a0found \u201csufficient evidence\u00a0from which a reasonable
\njury could find\u2014as it did\u2014that Tyson\u00a0. . . did not exercise the
\ncontrol\u00a0. . .\u00a0necessary to be deemed a co-employer,\u201d noting that the
\nfarm owner\u2019s \u201cselection and hiring,\u201d \u201cpayment of wages, and the ability to
\nfire\u201d the worker \u201cweighed\u00a0in favor of finding that Tyson was not . . . [a]
\nco-employer.\u201d\u00a0<\/span><\/p>\n

Agricultural Labor:\u00a0DOL\u00a0Issues
\nFinal H-2A Rule<\/span><\/b>\u00a0<\/span><\/p>\n

On January 15, 2021 the U.S.
\nDepartment of Labor (DOL)\u00a0Employment and Training Administration\u00a0announced<\/span><\/a>\u00a0the forthcoming publication of
\na\u00a0final rule<\/span><\/a>\u00a0titled\u00a0\u201cTemporary
\nAgricultural Employment of H-2A Nonimmigrants in the United States.\u201d\u00a0 The
\nfinal rule\u00a0requires job orders and applications to be filed
\nelectronically, allowing\u00a0DOL to share\u00a0information with the Department
\nof Homeland Security and other federal agencies, and allows employers
\nwithout\u00a0full-time work offerings to\u00a0file a single
\napplication\u00a0for\u00a0joint employment to provide full-time
\nwork.\u00a0\u00a0The rule also allows employers to stagger\u00a0the entry of
\nH-2A workers into the country over 120\u00a0days and\u00a0permits state and
\nfederal\u00a0authorities\u00a0to conduct inspections\u00a0of employer-provided
\nhousing for up to twenty-four months.\u00a0 For more on the July 26, 2019

\n\u201cDepartment of Labor Proposes Changes to H-2A Program.\u201d\u00a0<\/span><\/p>\n

WOTUS:\u00a0EPA Issues Draft
\nof Proposed Guidance for County of Maui<\/u><\/i> Case<\/span><\/b>\u00a0<\/span><\/p>\n

On January 10, 2020, the
\nEnvironmental Protection Agency\u00a0(EPA)\u00a0published notice in the Federal
\nRegister of\u00a0draft guidance<\/span><\/a>\u00a0clarifying
\nwastewater permit requirements under\u00a0County of Maui v. Hawaii
\nWildlife Fund<\/span><\/i><\/a>, which held that the\u00a0Clean Water Act<\/span><\/a>\u00a0(CWA)
\nrequires a discharge permit when there is a direct discharge from a point source
\ninto navigable waters or when there is the \u201cfunctional equivalent of a direct
\ndischarge\u201d\u00a0(85 FR 79489<\/span><\/a>).\u00a0\u00a0The
\nnon-binding guidance, which\u00a0EPA issued<\/span><\/a>\u00a0to
\nclarify\u00a0CWA requirements,\u00a0states that \u201ccertain
\nthreshold\u00a0conditions .\u00a0. . must be satisfied before the legal
\nobligation to have an [National\u00a0Pollutant Discharge Elimination System
\n(NPDES)]\u00a0permit is triggered:\u201d that\u00a0\u201cthere must\u00a0be (or
\nwill\u00a0be)\u00a0an \u201cactual\u00a0discharge of a pollutant to a water of the
\nUnited States\u201d\u00a0(WOTUS),\u00a0and that \u201csuch a discharge must be from a
\npoint source.\u201d\u00a0\u00a0\u00a0The
\nguidance\u00a0further\u00a0outlined\u00a0three concepts\u00a0related to discharges
\nthat are the\u00a0\u201cfunctional equivalent\u201d of a direct discharge into WOTUS:
\n1)\u00a0An actual discharge of a pollutant to a water of the United States is a
\nthreshold condition that must be satisfied before the need for an NPDES permit
\nis triggered; 2)\u00a0The discharge of pollutants that reaches, or will reach,
\na water of the United States must be from a point source to trigger NPDES
\npermitting requirements; and 3)\u00a0Only a subset of discharges of pollutants
\nto groundwater that ultimately reach a water of the United States are the
\n\u201cfunctional equivalent\u201d of a direct discharge to a water of the United
\nStates.\u00a0 The\u00a030-day comment period on the draft guidance closed
\nJanuary 11, 2021\u00a0(EPA-HQ-OW-2020-0673-0001<\/span><\/a>).\u00a0

Antitrust:\u00a0Pilgrim’s
\nPride Reaches $75 Million Civil Antitrust Settlement<\/span><\/b>\u00a0<\/span><\/p>\n

On January 11, 2021,
\nPilgrim\u2019s Pride Corporation\u00a0filed a\u00a0notice of settlement<\/span><\/a>,
\nsubject to court approval,\u00a0with the U.S. District Court for the Northern
\nDistrict of Illinois, settling all claims\u00a0with the Direct Purchaser
\nPlaintiffs\u00a0(DPP) in the consolidated antitrust class action suit\u00a0In\u00a0re
\nBroiler Chicken Antitrust Litigation<\/u>\u00a0<\/i>(No.\u00a01:16-cv-08637<\/span><\/a>).\u00a0\u00a0Pilgrim\u2019s
\nconcurrently disclosed the settlement in a\u00a0U.S. Securities and Exchange
\nCommission\u00a0filing<\/span><\/a>\u00a0and shareholder\u00a0announcement<\/span><\/a>,\u00a0which
\nstates that Pilgrim\u2019s $75 million payment to the DPP class will\u00a0appear on
\nits\u00a02020 fourth quarter financial statements.\u00a0 Pilgrim\u2019s states that,
\nalthough it \u201cdoes not admit any liability for the claims alleged in the Broiler
\nAntitrust Civil Litigation,\u201d the company\u00a0had\u00a0concluded that the
\nproposed settlement, which does not apply to non-DPP claims, is \u201cin the best
\ninterests of the Company and its shareholders.\u201d\u00a0<\/span><\/p>\n

Conservation
\nPrograms:\u00a0USDA\u00a0Issues\u00a0Regional Conservation Partnership
\nProgram\u00a0Final Rule\u00a0<\/span><\/b>\u00a0<\/span><\/p>\n

On January 15, 2021,
\nthe\u00a0U.S. Department of Agriculture\u2019s (USDA)\u00a0Natural Resources
\nConservation Service (NRCS) Commodity Credit Corporation (CCC)\u00a0published
\nin the Federal Register a final rule titled, \u201cRegional Conservation Partnership
\nProgram\u201d\u00a0(RCPP)\u00a0(86 FR 3735<\/span><\/a>),
\nwhich\u00a0adopts the February 13,\u00a02020\u00a0interim rule<\/span><\/a>\u00a0with\u00a0few
\nmodifications.\u00a0\u00a0(For more on the interim rule, see\u00a0ALWR \u2014February 20, 2020<\/span><\/i><\/a>,
\n\u201cNew Interim Rule on Regional Conservation Partnership Program\u201d)
\nPreviously\u00a0announced<\/span><\/a>\u00a0by NRCS
\non January 13, 2021, the final rule
\nrequires\u00a0RCPP\u00a0agreements\u00a0with historically underserved\u00a0(HU)\u00a0producers\u00a0to
\nlist any applicable\u00a0\u201cauthorizations for higher payment rates, advance
\npayment options, or other methods for encouraging HU participation\u201d and
\ndesignates source water protection as a priority resource
\nconcern.\u00a0\u00a0According to the\u00a0Regional Conservation Partnership
\nProgram<\/span><\/a>\u00a0website, the next round of\u00a0\u201cRCPP Classic funding\u201d
\nwill be announced in summer 2021.\u00a0\u00a0The\u00a0final\u00a0rule became
\neffective upon publication.\u00a0\u00a0\u00a0<\/span><\/p>\n

Regulatory Policy:\u00a0EPA\u00a0Publishes
\nPivotal Science Transparency Final Rule<\/span><\/b>\u00a0<\/span><\/p>\n

On January 6, 2021, the
\nEnvironmental Protection Agency (EPA) published in the Federal Register a final
\nrule title, \u201cStrengthening Transparency in
\nPivotal Science Underlying Significant Regulatory Actions and Influential
\nScientific Information<\/span><\/a>\u201d (86 FR 469<\/span><\/a>).\u00a0\u00a0The
\nrule\u00a0requires\u00a0that EPA\u00a0clearly identify\u00a0and\u00a0make
\npublicly available all science\u00a0informing a significant regulatory
\naction.\u00a0\u00a0In evaluating scientific data, the final rule calls
\nfor\u00a0the agency to\u00a0give greater consideration to\u00a0\u201cpivotal\u201d
\nstudies whose dose-response data are available\u00a0for
\nindependent\u00a0validation and\u00a0sets forth requirements\u00a0for
\nindependent peer review of such studies.\u00a0 The rule does not
\nrequire\u00a0that \u201cPersonally Identifiable Information\u00a0(PII)\u201d or \u201cConfidential
\nBusiness Information (CBI)\u201d\u00a0be released, nor does it require EPA to
\n\u201ccollect, store, or publicly disseminate\u201d such information.\u00a0\u00a0The rule
\nbecame effective upon publication.\u00a0\u00a0<\/span><\/p>\n
