I was assisting with voir
\ndire recently when opposing counsel, questioning the prospective jurors, was
\ntold by the judge to \u201cMove along, counselor,\u201d to which the attorney replied,
\n\u201cBut Your Honor\u2026\u201d I barely listened to the rest of what the attorney was
\nsaying, because I was delighted at the expression of confusion and dismay on
\nthe faces of the jurors. Opposing counsel had just lost points with the very
\npeople they would need to convince down the road, all to my side\u2019s advantage.<\/span><\/p>\n

Perhaps the most egregious
\nmistake a lawyer can make in voir dire is to fail to fully respect the judge.
\nProspective jurors are not happy to be there; they do not trust the lawyers,
\nand the whole process is intimidating. Whatever else happens, prospective
\njurors are convinced only that the judge is neutral and therefore only the
\njudge is trustworthy.<\/span><\/p>\n

If the judge says, \u201cThat\u2019s
\nenough, counselor,\u201d or \u201cMove along, counselor,\u201d or any other such directive,
\nthe lawyer should immediately say, \u201cThank you, Your Honor,\u201d and do so. If the
\njudge says, \u201cYou\u2019re out of time, counselor,\u201d the lawyer should refrain from
\narguing; \u201cBut Your Honor, opposing counsel took 10 extra minutes, which ate
\ninto my time.\u201d As far as the prospective jurors are concerned, whatever the
\njudge says, goes. If you have a legitimate grievance worth arguing with the
\njudge, to do so out of the range of the prospective jurors.\u00a0<\/span><\/p>\n<\/div>\n\n","protected":false},"excerpt":{"rendered":"
