Hemani: SCOTUS Backs Gun Rights"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p class=\"wp-block-paragraph\">In <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-1234_g2bh.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>United States v. Hemani<\/em><\/a>, 608 U.S. ___ (2026), the U.S. Supreme Court unanimously held that \u00a0the federal government\u2019s prosecution of a nonviolent marijuana user for possessing a gun violated the Second Amendment\u2019s right to bear arms.<\/p>\n<h2 class=\"wp-block-heading\">Facts of the Case<\/h2>\n<p class=\"wp-block-paragraph\">Ali Hemani is a dual citizen of the United States and Pakistan who was born in Texas. He has spent most of his life living in the Dallas area with his parents and working a stable job. Suspecting Mr. Hemani and his family members of terrorism-related activities, the government conducted a search of the family home in 2022. Throughout the process, Mr. Hemani proved cooperative: he surrendered a gun he kept in the house, pointed agents to some marijuana on the property, and consented to an interview during which he told law enforcement months after the search.<\/p>\n<p class=\"wp-block-paragraph\">Relying solely on Mr. Hemani\u2019s admitted use of marijuana, the government prosecuted Mr. Hemani under <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/922\" target=\"_blank\" rel=\"noreferrer noopener\">18 U.S.C. \u00a7922(g)(3)<\/a> for knowingly possessing a gun in his home while being an unlawful user of a controlled substance. Mr. Hemani moved to dismiss the indictment, arguing that the government\u2019s effort to enforce \u00a7922(g)(3) against him violated the Second Amendment. The district court granted the motion, and after an unsuccessful appeal to the Fifth Circuit, the government asked this Court to review the case.<\/p>\n<h2 class=\"wp-block-heading\">Supreme Court\u2019s Decision<\/h2>\n<p class=\"wp-block-paragraph\">The Supreme Court unanimously held that \u201cthe government\u2019s prosecution of Mr. Hemani under \u00a7922(g)(3)\u2019s unlawful user provision is inconsistent with the Second Amendment.\u201d Justice <a href=\"https:\/\/constitutionallawreporter.com\/current-supreme-court-justices\/neil-gorsuch\/\" target=\"_blank\" rel=\"noreferrer noopener\">Neil Gorsuch<\/a> wrote on behalf of the Court.<\/p>\n<p class=\"wp-block-paragraph\">As Justice Gorsuch explained, while the Second Amendment protects the right of all Americans to keep and bear firearms for self-defense, it does have limits. As set forth in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>New York State Rifle &amp; Pistol Assn., Inc.<\/em> <em>v.<\/em> <em>Bruen<\/em><\/a>, 597 U.S. ____ (2022), to determine when the government infringes the Second Amendment, the Court begins by asking whether the Amendment\u2019s terms cover the conduct in question; if so, the Constitution \u201cpresumptively\u201d protects it.\u00a0To overcome that presumption, the government bears the burden of showing its regulatory efforts are \u201cconsistent with the Nation\u2019s historical tradition of firearm regulation.\u201d However, as the Court clarified in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-915_8o6b.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>United States<\/em> v. <em>Rahimi<\/em><\/a>, 602 U.S. 680 (2023), the government need not point to a \u201chistorical twin\u201d or \u201cprecis[e] . . . historical precursors.\u201d\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Applying this framework, the Supreme Court went on to conclude that \u00a7922(g)(3)\u2019s unlawful user provision burdens conduct presumptively protected by the Second Amendment because the statute bans a class of people, including Mr. Hemani, from possessing essentially any firearm for any purpose.<\/p>\n<p class=\"wp-block-paragraph\">To allow \u201cthe government that kind of \u2018broad power to designate any group as dangerous and thereby disqualify its members from having a gun,&#8217;\u201d Justice Gorsuch wrote, \u201cwould risk allowing it to \u2018quickly swallow\u2019 the Second Amendment.\u201d<\/p>\n<p class=\"wp-block-paragraph\">In reaching its decision, the Court rejected the government\u2019s reliance on habitual drunkard laws to justify \u00a7922(g)(3)\u2019s unlawful user provision. \u201cThe habitual drunkard laws on which the government relies here differ dramatically from [the federal] unlawful user provision on every single metric the government invites us to consider,\u201d Justice Gorsuch wrote. \u201cThey targeted different kinds of people, did so for different purposes, and operated in different ways. Whether any one of these problems taken in isolation would prove fatal to the government\u2019s cause, we need not decide. Taken cumulatively, we hold, they certainly do.\u201d Justice Gorsuch went on to note that \u201capart from pointing to habitual drunkard laws, the government has not even attempted to prove that any other specific historical principle might justify its prosecution in this case.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Finally, the Court emphasized that itsdecision was narrow. Notably, it did not apply to laws that ban addicts or those presently intoxicated from possessing a firearm, or other laws \u201cCongress might adopt after determining that users of a particular drug pose a special risk of misusing firearms.\u201d<\/p>\n<p class=\"wp-block-paragraph\">In an unusual pairing, Justice <a href=\"https:\/\/constitutionallawreporter.com\/current-supreme-court-justices\/samuel-alito\/\" target=\"_blank\" rel=\"noreferrer noopener\">Samuel A. Alito Jr.<\/a> authored a concurrence joined by Justice <a href=\"https:\/\/constitutionallawreporter.com\/current-supreme-court-justices\/elena-kagan\/\" target=\"_blank\" rel=\"noreferrer noopener\">Elena Kagan<\/a>. The justices agreed with the Court\u2019s decision, but wrote separately to emphasize that the government could not compare historical laws dealing with drunkards to present efforts to bar guns from marijuana users.<\/p>\n<p class=\"wp-block-paragraph\">\u201cMarijuana use today is like alcohol use at the founding,\u201d Justice Alito wrote. \u201cIt is widespread and increasingly considered socially acceptable in many quarters.
