href=\"https:\/\/fandango.getyarn.io\/yarn-clip\/f520de0e-9bc7-442c-a578-a1a186484729\">it\u2019s here, it\u2019s happening<\/a>.\u00a0 The <a href=\"https:\/\/www.reginfo.gov\/public\/do\/eAgendaMain?operation=OPERATION_GET_AGENCY_RULE_LIST&amp;currentPub=true&amp;showStage=active&amp;agencyCd=0900\">Unified Agenda of Regulations<\/a> has been updated to include <a href=\"https:\/\/www.reginfo.gov\/public\/do\/eAgendaViewRule?pubId=202510&amp;RIN=0910-AJ14&amp;operation=OPERATION_PRINT_RULE\">a proposed rule<\/a>, \u201cTransparency in Direct-to-Consumer Advertising\u201d to remove the (so-called) \u201cadequate provision loophole\u201d from the prescription drug advertising regulations in <a href=\"https:\/\/www.ecfr.gov\/current\/title-21\/chapter-I\/subchapter-C\/part-202\/section-202.1\">21 C.F.R. \u00a7202.1(e)(1)(i)(B)<\/a>.\u00a0 The proposal appears to be set for publication in December 2026 and is intended to force pharmaceutical companies to include a full brief summary within the drug\u2019s broadcast ad (not through direction to a website, toll-free number, etc.,).\u00a0 If finalized, this could effectively ban DTC broadcast ads by making them so lengthy as to be cost prohibitive.<\/p>\n<p>This effort is hardly a surprise and is in response to the <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/09\/memorandum-for-the-secretary-of-health-and-human-services-the-commissioner-of-food-and-drugs\/\">presidential memorandum<\/a>, <a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-launches-crackdown-deceptive-drug-advertising\">FDA<\/a> \u00a0press release, and <a href=\"https:\/\/www.hhs.gov\/press-room\/hhs-fda-drug-ad-transparency-fact-sheet.html\">HHS Fact Sheet<\/a> that we previously blogged on <a href=\"https:\/\/www.thefdalawblog.com\/2025\/09\/fdas-crackdown-on-deceptive-ads-what-happens-when-fdas-representations-may-be-false-or-misleading\/\">here<\/a> and <a href=\"https:\/\/www.thefdalawblog.com\/2025\/09\/hpm-fact-sheet-ensuring-fda-and-hhs-are-held-accountable-for-radical-transparency-and-communicating-truthful-and-non-misleading-information-about-dtc-rx-drug-ad-crackdown\/\">here<\/a> in September, simultaneous with FDA\u2019s \u201cDTC Crackdown.\u201d\u00a0 As we noted back in September, FDA continues to mischaracterize adequate provision as a \u201cloophole,\u201d omitting the fact that broadcast ads already contain a \u201cmajor statement\u201d of key risks, and positioning this proposal as \u201cimproving consumer understanding\u201d \u2013 when, in reality, it does the opposite.\u00a0 Over a decade ago, <a href=\"https:\/\/www.fda.gov\/files\/drugs\/published\/Brief-Summary-and-Adequate-Directions-for-Use---Disclosing-Risk-Information-in-Consumer-Directed-Print-Advertisements-and-Promotional-Labeling-for-Prescription-Drugs.pdf\">FDA advised industry<\/a> on the following as it pertained to consumer directed brief summary requirements:<\/p>\n<blockquote>\n<p>To provide better and more actionable information for consumers, FDA believes that the brief summary should focus on the most important risk information rather than an exhaustive list of risks and that the information should be presented in a way most likely to be understood by consumers.\u00a0 Thus, FDA strongly recommends against the use of the traditional approach to fulfill the brief summary requirement in consumer-directed advertisements, an approach in which risk related sections of the PI are presented verbatim, often in small font.<\/p>\n<\/blockquote>\n<p>While this position was with regard to print advertisement (where consumers could take their time to read the print provided), one would expect the same policies regarding consumer comprehension to hold true for broadcast media.\u00a0 So much for \u201cimproving consumer understanding.\u201d\u00a0 But hey, let\u2019s not let the truth get in the way of a good story.<\/p>\n<p>The FDA acknowledges that it anticipates this rule to be economically significant, with annual costs exceeding $100 million.\u00a0 It is also likely to lead to litigation.\u00a0 We\u2019ll wait and see what ultimately gets published and how industry will
