{"id":351719,"date":"2025-12-19T19:44:55","date_gmt":"2025-12-19T19:44:55","guid":{"rendered":"https:\/\/peraltafinancing.com\/business\/legal\/judicial-misquotation-of-pan-malaysia-equities-sdn-bhd-v-angeline-tan-eei-we-2010-mlju-1528\/"},"modified":"2025-12-19T19:44:55","modified_gmt":"2025-12-19T19:44:55","slug":"judicial-misquotation-of-pan-malaysia-equities-sdn-bhd-v-angeline-tan-eei-we-2010-mlju-1528","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=351719","title":{"rendered":"Judicial Misquotation of Pan Malaysia Equities Sdn Bhd v Angeline Tan Eei We [2010] MLJU 1528"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>In <em>Lesley Chan Siew Yoke v RHB Bank Berhad<\/em> [2020] MLJU 242 (\u201c<strong>Lesley Chan<\/strong>\u201d), the learned High Court judge (\u201c<strong>LHCJ<\/strong>\u201d) therein referred <em>inter alia<\/em> to an earlier decision of <em>Pan Malaysia Equities Sdn Bhd v Angeline Tan Eei We<\/em> [2010] MLJU 1528 (\u201c<strong>Pan Malaysia<\/strong>\u201d):<\/p>\n<p style=\"padding-left: 40px;\">\u201c<strong><u>The Court of Appeal in <em>Pan Malaysia Equities Sdn Bhd v Angeline Tan Eei We<\/em> <\/u><\/strong>[2010] MLJU 1528 held that Section 16 of the Act is <em>in pari materia<\/em> with the corresponding provision under the Indian Contract Act. <strong><u>Hamid Sultan JCA<\/u><\/strong> went on to analyse the application of the doctrine in the context of the Contracts Act 1950.\u201d<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a> (Bold and underline mine)<\/p>\n<p>The LHCJ in Lesley Chan appeared to be of the impression that Pan Malaysia was:<\/p>\n<p style=\"padding-left: 40px;\">(a) A decision of the Court of Appeal; and<\/p>\n<p style=\"padding-left: 40px;\">(b) A decision by Hamid Sultan JCA.<\/p>\n<p>[collectively referred to as the \u201c<strong>Impugned Impressions 1<\/strong>\u201d]<\/p>\n<p>In <em>Loh Mun Wah v Loh Yoon Sang &amp; Ors<\/em> [2023] MLJU 3435 (\u201c<strong>Loh Mun Wah<\/strong>\u201d), the LHCJ therein also misquoted Pan Malaysia as being a decision of the Court of Appeal:<\/p>\n<p style=\"padding-left: 40px;\">\u201c\u2026 <strong><u>The Court of Appeal in <em>Pan Malaysia Equities Sdn Bhd v. Angeline Tan Eei We<\/em><\/u><\/strong> [2011] 1 CLJ 923; ; [2010] MLJU 1528 held that there was a need to place caveats on applying English cases.\u201d<a href=\"#_ftn2\" name=\"_ftnref2\"><sup>[2]<\/sup><\/a> (Bold and underline mine)<\/p>\n<p>The LHCJ in Loh Mun Wah, similar to the LHCJ in Lesley Chan, appeared to be of the impression that Pan Malaysia was a decision of the Court of Appeal (\u201c<strong>Impugned Impression 2<\/strong>\u201d).<\/p>\n<p>Regrettably, the Impugned Impressions 1 and Impugned Impression 2 are factually incorrect.<\/p>\n<p>Pan Malaysia was a decision of the High Court by Justice Hamid Sultan Abu Backer when His Lordship was a High Court judge (and not when His Lordship was a Court of Appeal judge):<\/p>\n<p style=\"padding-left: 40px;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-2184 size-medium\" src=\"http:\/\/joshuawu.my\/wp-content\/uploads\/2025\/08\/2010-MLJU-1528-300x289.png\" alt=\"\" width=\"300\" height=\"289\"\/><\/p>\n<p style=\"padding-left: 40px;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-2190 size-medium\" src=\"http:\/\/joshuawu.my\/wp-content\/uploads\/2025\/08\/2011-1-CLJ-923-300x80.png\" alt=\"\" width=\"300\" height=\"80\"\/><\/p>\n<p>The Impugned Impressions led the LHCJ in Lesley Chan to be of the view that he was bound by Pan Malaysia:<\/p>\n<p style=\"padding-left: 40px;\">\u201c<strong><u>This Court is bound<\/u><\/strong> by the position taken in <strong><u>Pan Malaysia Equities<\/u><\/strong> and agrees with Singlefine.\u201d<a href=\"#_ftn3\" name=\"_ftnref3\"><sup>[3]<\/sup><\/a> (Bold and underline mine)<\/p>\n<p>It is unclear whether the LHCJ in Lesley Chan would have agreed with (and adopted) the position taken in Pan Malaysia if he was aware that Pan Malaysia was a decision of the High Court.<\/p>\n<p>After all, Pan Malaysia \u201cbeing a decision of a court of coordinate jurisdiction \u2026 whilst deserving the respect and deference that is due to it \u2026 is not binding on\u201d<a href=\"#_ftn4\" name=\"_ftnref4\"><sup>[4]<\/sup><\/a> the High Court in Lesley Chan.<\/p>\n<p>As for Loh Mun Wah, the misquotation of Pan Malaysia likely would not have had a material impact on the outcome of the matter as the LHCJ therein also relied on the Court of Appeal\u2019s decision in <em>Tengku Abdullah Ibni Sultan Abu Bakar &amp; Ors V.
