{"id":345853,"date":"2025-12-15T20:09:10","date_gmt":"2025-12-15T20:09:10","guid":{"rendered":"https:\/\/peraltafinancing.com\/uncategorized\/new-legal-framework-on-human-biological-material-in-cameroon\/"},"modified":"2025-12-15T20:09:10","modified_gmt":"2025-12-15T20:09:10","slug":"new-legal-framework-on-human-biological-material-in-cameroon","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=345853","title":{"rendered":"New Legal Framework on Human Biological Material in Cameroon"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>On <strong>July 15, 2025<\/strong>, the <a href=\"https:\/\/www.prc.cm\/en\/\" target=\"_blank\" rel=\"noopener\">President of the Republic<\/a> enacted <strong>Law No. 2025\/009<\/strong>, establishing a comprehensive legal regime governing the <strong>donation, removal, transplantation, storage, and destruction of human biological material<\/strong> in Cameroon. <\/p>\n<p>This landmark legislation addresses long-standing legal voids surrounding organ donation, tissue transplantation, stem cell banking, and biobank regulation.<\/p>\n<h2 class=\"wp-block-heading\" id=\"1-scope-and-applicability\">1. <strong>Scope and<\/strong> <strong>Applicability<\/strong><\/h2>\n<p>The law covers <strong>organs, tissues, cells, and stem cells<\/strong>, while expressly excluding blood, gametes, and embryos (governed by separate instruments).<\/p>\n<h2 class=\"wp-block-heading\" id=\"2-principles\">2. Principles<\/h2>\n<p>It upholds <strong>ethical and bioethical standards<\/strong>, <strong>non-commercialisation<\/strong>, <strong>donor consent<\/strong>, and <strong>human dignity<\/strong> as foundational legal principles.<\/p>\n<h2 class=\"wp-block-heading\" id=\"3-accreditation-system\">3. Accreditation System<\/h2>\n<p>Only <strong>authorised public or private health centres<\/strong> may collect, preserve, transplant or destroy human biological material. These centres must establish <strong>institutional ethics committees<\/strong> and ensure <strong>traceability, privacy, and recordkeeping<\/strong>.<\/p>\n<h2 class=\"wp-block-heading\" id=\"4-consent-requirements\">4. Consent Requirements<\/h2>\n<p>Donations must be <strong>free, informed, written, and witnessed<\/strong>. For living donors with disabilities and minors, stricter safeguards and oversight apply.<\/p>\n<h2 class=\"wp-block-heading\" id=\"5-biobanks-regulation\">5. <strong>Biobanks Regulation<\/strong><\/h2>\n<p>The law allows the creation of <strong>biobanks<\/strong> within accredited centres, with strict time-bound storage (5 years max) and <strong>biosecurity rules<\/strong>. Transfer of materials is restricted to within the national territory and between accredited facilities only.<\/p>\n<h2 class=\"wp-block-heading\" id=\"6-national-oversight\">6. <strong>National Oversight<\/strong><\/h2>\n<p>A <strong>National Ethics Body<\/strong> is responsible for maintaining a <strong>donor register<\/strong>, a <strong>recipient waiting list<\/strong>, and issuing ethical opinions on sensitive matters.<\/p>\n<h2 class=\"wp-block-heading\" id=\"prohibitions\">Prohibitions<\/h2>\n<p>The law explicitly criminalises:<\/p>\n<ul class=\"wp-block-list\">\n<li>Sale or purchase of human biological material.<\/li>\n<li>Transplants performed without valid consent.<\/li>\n<li>Advertisement of donations for specific individuals or centres.<\/li>\n<li>Violation of anonymity, privacy, or ethical procedures.<\/li>\n<li>Import\/export of human biological material.<\/li>\n<\/ul>\n<h2 class=\"wp-block-heading\" id=\"sanctions\">Sanctions<\/h2>\n<p>Violations attract:<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>Administrative penalties:<\/strong> Suspension or withdrawal of accreditation; exclusion from public contracts.<\/li>\n<li><strong>Criminal penalties:<\/strong> Up to <strong>20 years imprisonment<\/strong> and fines up to <strong>20 million CFA francs<\/strong> for unlawful removal, transplantation, or commercialisation.<\/li>\n<li><strong>Forfeitures<\/strong> under the Penal Code.<\/li>\n<\/ul>\n<p>This law aligns Cameroon with international standards, including the <a href=\"https:\/\/iris.who.int\/bitstream\/handle\/10665\/341814\/WHO-HTP-EHT-CPR-2010.01-eng.pdf\" target=\"_blank\" rel=\"noopener\"><em>WHO Guiding Principles on Human Cell, Tissue and Organ Transplantation<\/em><\/a>, and reflects best practices seen in some countries around the world.<\/p>\n<p><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">However, <em><a href=\"https:\/\/www.nyulawglobal.org\/globalex\/cameroon1.html\" target=\"_blank\" rel=\"noopener\">Cameroon\u2019s law<\/a> <\/em>goes further by\u00a0<strong>banning cross-border transfers<\/strong>, placing a\u00a0<strong>5-year limit<\/strong>\u00a0on biobank storage, and imposing strict\u00a0<strong>nationalisation<\/strong>\u00a0of transplant oversight, suggesting a cautious but sovereignty-focused public health approach.<\/span><\/p>\n<h2 class=\"wp-block-heading\" id=\"practical-implications\">Practical Implications<\/h2>\n<h3 class=\"wp-block-heading\" id=\"for-hospitals-and-clinics\">For Hospitals and Clinics:<\/h3>\n<ul class=\"wp-block-list\">\n<li>Must obtain accreditation.<\/li>\n<li>Institutional ethics committees are now mandatory.<\/li>\n<li>Consent forms and procedures must comply with strict legal formalities.<\/li>\n<\/ul>\n<h3 class=\"wp-block-heading\" id=\"for-biotech-and-research-institutions\">For Biotech and Research Institutions:<\/h3>\n<ul class=\"wp-block-list\">\n<li>Biobank operations must align with biosafety norms and approved SOPs.<\/li>\n<li>Transfer of biological material between centres requires regulatory authorisation.<\/li>\n<\/ul>\n<h3 class=\"wp-block-heading\" id=\"for-legal-advisors-and-compliance-officers\">For Legal Advisors and Compliance Officers:<\/h3>\n<ul class=\"wp-block-list\">\n<li>Immediate review of current organ donation protocols is required.<\/li>\n<li>Client advisories must include criminal law exposure for non-compliance.<\/li>\n<\/ul>\n<h3 class=\"wp-block-heading\" id=\"for-investors-and-ng-os\">For Investors and NGOs:<\/h3>\n<ul class=\"wp-block-list\">\n<li>Opportunities exist in setting up accredited transplant centres or biobanks, subject to national licensing.<\/li>\n<li>Partnerships with government and public health authorities must integrate ethics training and legal due diligence.<\/li>\n<\/ul>\n<p>We offer:<\/p>\n<ul class=\"wp-block-list\">\n<li>Licensing support for accredited centres and biobanks.<\/li>\n<li>Drafting of institutional protocols and consent forms.<\/li>\n<li>Staff training on legal and ethical standards.<\/li>\n<li>Legal representation in disputes or audits involving transplantation practices.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/4mlegaltax.com\/\">4M Legal and Tax \u2013 Law Firm<\/a><\/p>\n<\/p><\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>On July 15, 2025, the President of the Republic enacted Law No. 2025\/009, establishing a comprehensive legal regime governing the donation, removal, transplantation, storage, and destruction of human biological material in Cameroon.
