Recently, Stephen Thaler attempted to secure a copyright for a work generated by his AI. In the present case, he is the owner of a system called the \u201cCreativity Machine,\u201d while the AI itself is the claimed author of the artwork titled\u00a0<em data-end=\"552\" data-start=\"518\">\u201cA Recent Entrance to Paradise.\u201d<\/em><\/span><\/strong><\/p>\n<p data-end=\"716\" data-start=\"556\" style=\"text-align: justify;\"><span style=\"font-family: times; font-size: medium;\">The \u201cCreativity Machine\u201d is an AI system that autonomously creates original pieces of art from existing images using algorithms, without any human intervention.<\/span><\/p>\n<p data-end=\"1006\" data-start=\"718\" style=\"text-align: justify;\"><span style=\"font-family: times; font-size: medium;\">Thaler\u2019s application for copyright registration of the AI-generated work was rejected by the United States Copyright Office (USCO). The USCO affirmed that copyright law protects only\u00a0<strong data-end=\"939\" data-start=\"901\">&#8220;the fruits of intellectual labor&#8221;<\/strong>\u00a0that are\u00a0<strong data-end=\"1006\" data-start=\"949\">&#8220;founded in the creative powers of the [human] mind.&#8221;<\/strong><\/span><\/p>\n<p data-end=\"1295\" data-start=\"1008\" style=\"text-align: justify;\"><span style=\"font-family: times; font-size: medium;\">Under\u00a0<strong data-end=\"1055\" data-start=\"1014\">Section 306 of the U.S. Copyright Act<\/strong>, copyright protection extends to\u00a0<strong data-end=\"1123\" data-start=\"1089\">\u201coriginal works of authorship\u201d<\/strong>\u00a0(17 U.S.C. \u00a7 102(a)). To qualify as a \u201cwork of authorship,\u201d a work must be created by a\u00a0<strong data-end=\"1227\" data-start=\"1212\">human being<\/strong>. Works that do not meet this requirement are\u00a0<strong data-end=\"1294\" data-start=\"1273\">not copyrightable<\/strong>.<\/span><\/p>\n<p data-end=\"1336\" data-start=\"1297\" style=\"text-align: justify;\"><span style=\"font-family: times; font-size: medium;\">According to the U.S. Copyright Office:<\/span><\/p>\n<blockquote data-end=\"1608\" data-start=\"1337\">\n<p><span style=\"font-size: large;\"><span style=\"font-family: times;\">\u201cThe Office will not register works produced by a machine or mere mechanical process that operates randomly or automatically without any creative input or intervention from a human author.\u201d<\/span><\/span><\/p>\n<p><span style=\"font-family: times; font-size: medium;\"><\/p>\n<p>\u2014\u00a0<em data-end=\"1608\" data-start=\"1535\">Report to the Librarian of Congress by the Register of Copyrights, 1966<\/em><\/p>\n<p><\/span><\/p><\/blockquote>\n<p data-end=\"1871\" data-start=\"1610\" style=\"text-align: justify;\"><span style=\"font-family: times; font-size: medium;\">Previously, Thaler also attempted to designate one of his AIs,\u00a0<strong data-end=\"1682\" data-start=\"1673\">DABUS<\/strong>, as an inventor by filing a\u00a0<strong data-end=\"1733\" data-start=\"1711\">patent application<\/strong>.
