{"id":345320,"date":"2025-12-15T13:34:31","date_gmt":"2025-12-15T13:34:31","guid":{"rendered":"https:\/\/peraltafinancing.com\/business\/legal\/health-and-safety-executor-launches-consultation-for-tighter-asbestos-regulations\/"},"modified":"2025-12-15T13:34:31","modified_gmt":"2025-12-15T13:34:31","slug":"health-and-safety-executor-launches-consultation-for-tighter-asbestos-regulations","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=345320","title":{"rendered":"Health and Safety Executor Launches Consultation for Tighter Asbestos Regulations"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p><h2>Health and Safety Executor Launches Consultation for Tighter Asbestos Regulations<\/h2>\n<\/p><\/div>\n<div>\n<p>The Health and Safety Executive (HSE) has recently launched a public consultation to strengthen the <strong>Control of Asbestos Regulations 2012<\/strong>, aiming to further protect workers and building users from asbestos exposure.<\/p>\n<p>The consultation, which opened at the start of November 2025, is seeking stakeholder views on three key proposals to improve asbestos management and safety practices across Great Britain.<\/p>\n<p>\u00a0<\/p>\n<h3>What are the Key Proposals?<\/h3>\n<p>The HSE is consulting on the following regulatory and non-regulatory measures:<\/p>\n<ol>\n<li><strong>To amend the Control of Asbestos Regulations 2012<\/strong> and associated guidance to ensure the independence and impartiality of roles in the four-stage clearance process to minimise the risk of exposure from asbestos to workers and building users after the removal of asbestos<\/li>\n<\/ol>\n<ol start=\"2\">\n<li><strong>To drive up the standard of asbestos surveys<\/strong> by improving guidance and using other interventions to ensure dutyholders understand the critical role of an asbestos survey in managing asbestos risk; and are equipped to commission a quality survey from a competent asbestos surveyor or organisation<\/li>\n<li><strong>To improve guidance<\/strong> and use other interventions to clarify the type of work that constitutes work with asbestos, known as Notifiable Non-Licensed Work (NNLW)<\/li>\n<\/ol>\n<p><strong>Source:<\/strong> HSE <a href=\"https:\/\/consultations.hse.gov.uk\/hse\/proposals-control-of-asbestos-regs-2012\/\">Legislative and guidance proposals for the Control of Asbestos Regulations 2012<\/a>.<\/p>\n<p>\u00a0<\/p>\n<h3>Importance of Tighter Asbestos Regulations<\/h3>\n<p>Although asbestos has been banned in the UK since 1999, it remains the largest cause of work-related deaths in the UK. Around 5,000 people die every year from asbestos-related diseases, with related illnesses typically taking decades to develop after initial exposure.<\/p>\n<p><a href=\"https:\/\/bridgemcfarland.co.uk\/meet-the-team\/james-burrell\/\">James Burrell<\/a>, Partner and <a href=\"https:\/\/bridgemcfarland.co.uk\/personal-law\/personal-injury\/industrial-disease\/\">Industrial Disease specialist<\/a> at Bridge McFarland LLP, commented: \u201c<em>We welcome these proposed regulatory changes and hope more can be done to reduce future asbestos <\/em><em>exposure. Our team continues to see clients who were exposed to asbestos decades ago, now facing life-changing diagnoses.
