{"id":345065,"date":"2025-12-15T09:34:20","date_gmt":"2025-12-15T09:34:20","guid":{"rendered":"https:\/\/peraltafinancing.com\/alabama\/ua-defends-magazine-closures-as-free-speech-group-weighs-further-involvement\/"},"modified":"2025-12-15T09:34:20","modified_gmt":"2025-12-15T09:34:20","slug":"ua-defends-magazine-closures-as-free-speech-group-weighs-further-involvement","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=345065","title":{"rendered":"UA defends magazine closures as free speech group weighs further involvement"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p style=\"font-weight: 400\">The Foundation for Individual Rights and Expression is \u201cexploring\u201d options to push the University of Alabama to reopen two student publications it shuttered last week.<\/p>\n<p style=\"font-weight: 400\">Founded in 2020, Nineteen Fifty-Six was a biannual student-run magazine \u201cfocused on Black culture, Black excellence, and Black student experiences at The University of Alabama.\u201d The publication was named after the year the first Black student to attend UA, Autherine Lucy Foster, enrolled in the university.<\/p>\n<p style=\"font-weight: 400\">Alice was a lifestyle, fashion and wellness magazine that produced content primarily targeted toward university women since its launch in 2015.<\/p>\n<p style=\"font-weight: 400\">Both publications were suspended by UA last Monday on the grounds that they engaged in \u201cunlawful proxy discrimination\u201d and violated \u201cbest practices\u201d set forth in a July memo released by U.S. Attorney General Pam Bondi.<\/p>\n<p style=\"font-weight: 400\">FIRE responded with a\u00a0<a href=\"https:\/\/www.thefire.org\/research-learn\/fire-letter-university-alabama-december-3-2025\">letter<\/a> last week strongly condemning the university\u2019s termination of student publications. The document highlighted that the cited U.S. Department of Justice memo was not legally binding, citing numerous court precedents that FIRE argued the terminations violated and called for the publications\u2019 immediate reinstatement.<\/p>\n<p style=\"font-weight: 400\">The university issued a\u00a0<a href=\"https:\/\/www.thefire.org\/research-learn\/university-alabama-response-fire-december-10-2025\">response<\/a> to FIRE\u2019s letter on Wednesday, dismissing the organization\u2019s assertion that the university, by suspending the publications, violated the editorial independence of its student publications and the First Amendment.<\/p>\n<p style=\"font-weight: 400\">As of Thursday, both publications remain closed, and the university has announced no plans to reinstate the magazines.<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p style=\"font-weight: 400\">Marie McMullan, student press counsel for FIRE, told APR that her organization is currently considering additional actions to advocate for the publications\u2019 reopening, following the university\u2019s response.\u00a0<\/p>\n<p style=\"font-weight: 400\">\u201cWe are weighing our options and our ability to be further involved,\u201d McMullan said.<\/p>\n<p style=\"font-weight: 400\">\u201cUnfortunately, [UA\u2019s response] ignores our substantive concerns about closing down the magazines and it proffers an argument that creating a more general magazine and shutting down these two magazines, will create more opportunities, even though it appears that two magazines merged into one will slash editorial staff in half,\u201d McMullan said.<\/p>\n<p style=\"font-weight: 400\">UA Chief University Counsel Robin H. Jones, in the university\u2019s response to FIRE, denied that the closures constituted an attempt to censor or control the content of student publications, writing that UA \u201chas a long-standing commitment to protect the First Amendment rights of all members of our campus community.\u201d<\/p>\n<p style=\"font-weight: 400\">Jones expressed the university\u2019s \u201cdisappointment\u201d in FIRE\u2019s letter of condemnation, adding that UA has \u201cenjoyed a productive relationship with FIRE for several years, frequently collaborating closely on issues aimed at preserving and expanding campus opportunities for expression.\u201d Jones went on to describe the letter \u201cas the latest example of FIRE unnecessarily undermining its credibility.\u201d<\/p>\n<p style=\"font-weight: 400\">\u201cAll publications within our student media are supported through the University, but UA has no editorial influence on those publications. The students have exercised\u2014and will continue to exercise\u2014full editorial autonomy regarding content,\u201d the UA official stated.<\/p>\n<p style=\"font-weight: 400\">\u201cContrary to the assumptions made in your correspondence, no one can credibly claim that the University has censored, controlled, quashed, edited, or otherwise diluted the editorial independence of student journalists to publish whatever content or viewpoint they wish to include in UA student media,\u201d UA\u2019s document continued.<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p style=\"font-weight: 400\">The university counsel also highlighted UA\u2019s plan to establish a new student publication \u201cthat will include a wider variety of topics,\u201d arguing the decision will expand opportunities available for students through university publications.<\/p>\n<p style=\"font-weight: 400\">\u201cIn short, UA\u2019s recent action effectively provides opportunities for <em>more<\/em> students to share <em>more<\/em> content, subject matters, and viewpoints that may be of interest to more students,\u201d Jones wrote. \u201cFar from limiting speech, funding a magazine that has a broader impact and is more welcoming to all members of the campus community is consistent with free speech values and UA\u2019s core mission of providing quality educational opportunities for all of our students.\u201d<\/p>\n<p style=\"font-weight: 400\">McMullan, however, pushed back against UA\u2019s claim that either of the closed publications were guilty of discriminatory practices solely because they produced content geared toward particular audiences.<\/p>\n<p style=\"font-weight: 400\">\u201cEvery magazine, every outlet, has a target audience, and to collect the viewpoints that you disseminate and bring in a target audience is part of the editorial freedoms that student journalists should have, and are promised at the University of Alabama,\u201d she said.<\/p>\n<p style=\"font-weight: 400\">\u201cProtecting these publications\u2019 editorial independence protects the breeding ground of journalism at large,\u201d McMullan added. \u201cThese outlets are where these students are beginning their careers. It is where stories are being told about those on their campuses, and student journalists are the best situated to tell those stories and to create those perspectives.\u201d<\/p>\n<p style=\"font-weight: 400\">Citing <a href=\"https:\/\/thecrimsonwhite.com\/125358\/news\/university-suspends-alice-nineteen-fifty-six-student-magazines\/\">reporting<\/a> from UA\u2019s student newspaper, The Crimson White, that both publications \u201chad hired staff who are not part of their target audiences,\u201d McMullan argued that the university has presented no substantive evidence that the magazines engaged in exclusionary hiring practices or policies.<\/p>\n<p style=\"font-weight: 400\">\u201cAll they\u2019re pointing to is the content and the viewpoint, not any tangible practice by either of these magazines,\u201d she said. \u201cUnless there is more to the story that the university has not shared, only pointing to the viewpoints and the content that\u2019s being produced is not going to be enough to ground that decision.\u201d<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p style=\"font-weight: 400\">She added that FIRE believes legal precedent protects UA from any federal \u201cscrutiny\u201d or attempts to revoke university funding because of the publications\u2019 content.<\/p>\n<p style=\"font-weight: 400\">\u201cCourts have also repeatedly held that student media does not speak for the university itself,\u201d McMullan said. \u201cStudent media outlets, in other situations, have been separate from the university, such that the university hasn\u2019t been held liable for the contents that have been produced or their actions.\u201d<\/p>\n<p style=\"font-weight: 400\">McMullan expressed support for efforts aimed at pushing UA to reinstate the publications and urged student journalists to contact FIRE\u2019s 24\/7 hotline if they feel their publications are \u201cfacing censorship efforts.\u201d<\/p>\n<p style=\"font-weight: 400\">\u201cWe want to know so that we can hit the ground running and help them in any way that is possible, whether that is advocating or getting them connected with legal services,\u201d she said.<\/p>\n<p style=\"font-weight: 400\">Alongside FIRE, the publication closures have been condemned by the <a href=\"https:\/\/x.com\/SPLC\/status\/1996321375074623990\">Student Press Law Center<\/a>, The <a href=\"https:\/\/thecrimsonwhite.com\/125448\/opinion\/our-view\/\">Crimson White editorial board<\/a> and a group of <a href=\"https:\/\/thecrimsonwhite.com\/125444\/opinion\/letter-to-the-editor-eighty-student-media-alumni-condemn-shuttering-of-campus-magazines-urge-support-for-students\/\">80 UA student press alumni<\/a>.<\/p>\n<p style=\"font-weight: 400\">An online <a href=\"https:\/\/sign.moveon.org\/petitions\/reinstate-alice-and-1956-to-the-university-of-alabama-s-campus\">petition<\/a> to reinstate the magazines has received more than 2,900 signatures.<\/p>\n<p style=\"font-weight: 400\">Alumni student journalists also launched a\u00a0<a href=\"https:\/\/www.alreporter.com\/2025\/12\/10\/alumni-nonprofit-raises-funds-to-support-student-journalists-at-suspended-ua-magazines\/\">fundraiser<\/a> earlier this week to support the publication of two additional issues of the magazines, which has since outperformed its original fundraising goal of $25,000.<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement.
