Trump administration officials have their hands full when it comes to <\/span>legal battles surrounding their mass deportation efforts<\/span><\/a>, and now the president is trying to use his legally dubious<\/span> <\/strong>strikes on Venezuelan boats<\/span><\/a> to help his case.<\/span><\/p>\n

In President Donald Trump\u2019s America, declaring that boats are ferrying drugs and <\/span>bombing them indiscriminately<\/span><\/a> is apparently a convenient way to justify chaotic and cruel deportation campaigns.<\/span><\/p>\n

As a little refresher, Trump\u2019s Department of Homeland Security put 252 Venezuelan men<\/span> and several women<\/span><\/a> on two planes en route to El Salvador in March. Despite instruction from U.S. District <\/span>Judge James Boasberg to halt the flights,<\/span><\/a> the administration <\/span>ignored the orders<\/span><\/a> <\/strong>and sent the detainees<\/span> <\/strong>to the<\/span> <\/strong>infamous terrorism confinement center<\/span><\/a> known as CECOT.<\/span><\/p>\n\n

At the time, Trump used the 1798 Alien Enemies Act as justification for the swift deportations.\u00a0<\/span><\/p>\n

There, the male detainees\u2014who the president <\/span>claimed were dangerous Tren de Aragua gang members<\/span><\/a>\u2014were later <\/span>found to be tortured,<\/span><\/a> beaten, and, in some cases, <\/span>sexually assaulted<\/span><\/a> while in custody.\u00a0<\/span><\/p>\n

Various investigations have<\/span> found many of these men <\/span><\/a>to have <\/span>no past criminal record <\/span><\/a>and seemingly no ties to any gang.\u00a0<\/span><\/p>\n

After three months, with <\/span>rocky negotiations<\/span><\/a> headed by Secretary of State Marco Rubio and Special Envoy Richard Grenell, Trump<\/span> <\/strong>released the men back to Venezuela<\/span><\/a> in exchange for 10 political prisoners<\/span> <\/strong>kept by Venezuelan President Nicolas Maduro.<\/span><\/a><\/p>\n

Despite being back in their home country, a lawsuit filed by the American Civil Liberties Union shortly after the deportation is still ongoing. The plaintiffs in <\/span>JGG v. Trump<\/em><\/a> argue that Trump\u2019s use of the Alien Enemies Act was illegal to begin with.\u00a0<\/span><\/p>\n

Essentially, the<\/span> <\/strong>act<\/span> <\/strong>says that the president<\/span><\/a> <\/strong>is at liberty to deport \u201calien enemies\u201d without due process during times of \u201cdeclared war\u201d or an \u201cinvasion or predatory incursion.\u201d<\/span><\/p>\n

And while Trump argued that Tren de Aragua gang members<\/span> were terrorizing the U.S.<\/span><\/a> at the behest of Maduro, sociopolitical experts said that his defense was flimsy at best.\u00a0<\/span><\/p>\n

Rebecca Hanson, a sociology professor at the University of Florida who studies Latin American affairs, <\/span>said in her declaration <\/span><\/a>that TdA couldn\u2019t be under the control of the Venezuela government given how new and disorganized the gang is.<\/span><\/p>\n

\u201cThere is no credible evidence that TdA has a foothold as a criminal organization within the United States,\u201d she wrote, adding that a relationship between the gang and Maduro is \u201cimplausible.\u201d<\/span><\/p>\n\n

Now, however, after the Trump administration fumbled its way through another<\/span> <\/strong>justification for its inhumane treatment of immigrants<\/span><\/a>, officials are using a new excuse.\u00a0<\/span><\/p>\n

According to <\/span>their legal filing<\/span><\/a>,<\/strong> we <\/span>are<\/em> in a war-like conflict with Venezuela. Well, at least we are now that we\u2019ve <\/span>bombed their ships and killed over 80 people<\/span><\/a> <\/strong>who were alleged drug traffickers.\u00a0<\/span><\/p>\n

An ACLU official associated with the legal battle told Daily Kos that this argument alone helps their case on behalf of the men.\u00a0<\/span><\/p>\n

\u201cIn our view the administration\u2019s claims that they are in a non-international conflict with TdA, that allows the boat strikes, supports our view that the Alien Enemies Act is being misused, since it requires an invasion or incision by a foreign government (as opposed to a non international actor like TdA),\u201d they said.\u00a0<\/span><\/p>\n

Since his first term, the president has <\/span>sought to remove Maduro,<\/span><\/a> and the administration <\/span>openly stated <\/span><\/a>that they do not accept the dictator as the \u201clegitimate government of Venezuela.\u201d<\/span><\/p>\n

Maduro has a<\/span> <\/strong>history of human rights abuses <\/span><\/a>against Venezuelan citizens and is accused of <\/span>rigging the 2018 election<\/span><\/a> in his favor.<\/span><\/p>\n

Scores of Trump\u2019s political prisoners were sent back to Venezuela as international tensions were rising, and they\u2019re looking for a way back to their lives\u2014and in many cases, their families\u2014in the U.S.\u00a0<\/span><\/p>\n
