A few years back, a Brigham City orthopedic surgeon (Dr.
\nDewey MacKay) claimed that the jury mistakenly convicted him of illegally
\nprescribing medication because they neither understood the facts of the case,
\nnor how chronic pain is managed.<\/p>\n

Jurors interviewed at the time, however, said Dr. Mackay\u2019s
\ncomments were misguided. The jurors were emphatic that they took every single\u00a0count one by one and discussed
\neach count in detail. Not only that, but the jurors explained that they used
\nboth the chalkboard made available to them as well as multiple sheets of paper
\nto draw things so everything was visual for everyone.<\/span><\/p>\n

This is not a one-time comment.
\nThis is something I hear over and over again both in focus groups and from
\njurors post-trial.<\/span><\/p>\n

\u201cSo
\neverything was visual for everyone.\u201d<\/span><\/i><\/b>
\nThat\u2019s the key. That\u2019s how you must be able to present your case if you are to
\nprevail: visually. Regardless of the nature of your case: personal injury, med
\nmal, construction defect, eminent domain, contractual dispute, intellectual
\nproperty dispute, whatever, you must be able to find ways to translate
\ntestimony and facts into visual elements. <\/span><\/p>\n

That means much more than
\nflashing deposition or other text on the screen. Visual rendition of testimony
\nmeans coming up with graphics, diagrams, and bottom line charts. It\u2019s answering
\ntoday\u2019s jurors\u2019 constant need to \u201csee it\u201d before they believe it.<\/span><\/p>\n

When you, the lawyer, provide
\nthe jury with compelling visuals to clarify and emphasize your points, you pave
\nthe way for the deliberations to favor your interpretation of the facts. This
\nis far better than relying on the jurors\u2019 ability to render your points
\nvisually, for they may or may not do so accurately.<\/span><\/p>\n
