Examples include corruption, abuse of judicial office,<br \/>\nbias, or conduct unbecoming of a judge. Misbehaviour must be <i>proved<\/i><br \/>\nthrough an inquiry by a judicial committee before Parliament can act.<o:p\/><\/span><\/p>\n<p><span style=\"font-size: 22.0pt; line-height: 107%; mso-ansi-language: EN-GB; mso-fareast-font-family: &quot;Times New Roman&quot;; mso-fareast-language: EN-GB; mso-font-kerning: 0pt; mso-ligatures: none;\">Incapacity refers to a judge\u2019s inability to discharge duties due to<br \/>\nphysical or mental disability. Here, there is nothing which could be proved<br \/>\nagainst Justice Swaminathan.
