S. But honestly, these mistake can get you in trouble in many countries. I\u2019m going to explain exactly what went wrong, what you need to know and the five mistakes to avoid so this never happens to you!<\/p>\n<p style=\"text-align: center;\">Read <a href=\"https:\/\/grrrltraveler.com\/should-you-get-a-global-entry-pass\/\">Should you get a global entry pass?<\/a><\/p>\n<p class=\"p1\">On March 18, 2025, two German backpackers \u2013 just 18 and 19 years old \u2013 arrived in Honolulu, planning a five-week adventure. Instead, they were denied entry, detained by U.S. Customs and Border Protection, held overnight in a federal facility (the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Federal_Detention_Center,_Honolulu\" target=\"_blank\" rel=\"noopener\">Honolulu Federal Detention Center<\/a> aka FDC Honolulu), strip-searched, and deported the next day.<\/p>\n<p class=\"p1\">The reason: U.S. officials thought they were planning to work illegally, even though they came in under the <a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/tourism-visit\/visa-waiver-program.html\" target=\"_blank\" rel=\"noopener\">U.S. Visa Waiver Program<\/a>.\u00a0 Their flexible travel plans, few accommodation bookings, and mention of freelance work raised red flags.<\/p>\n<p class=\"p1\">When this story broke, it felt both shocking and personal because it happened in <a href=\"https:\/\/grrrltraveler.com\/things-to-do-oahu-hawaii-famous-landmarks\/\">Hawaii<\/a> \u2013 my home state \u2013 known for its <em>aloha spirit<\/em>. So I wanted to know what went so wrong to cause something this extreme. Initially, I shared my first thoughts on my <a href=\"https:\/\/facebook.com\/GRRRL.TRAVELER\" target=\"_blank\" rel=\"noopener\">GRRRLTRAVELER Facebook page<\/a>, but as I looked deeper, I realized this could happen to many travelers \u2013 <a href=\"https:\/\/grrrltraveler.com\/guide-to-being-a-digital-nomad\/\">digital nomads<\/a>, long-term backpackers, content creators and even regular short-term tourists \u2013 without them even knowing it.<\/p>\n<p>\u00a0<\/p>\n<p>You might be making one of these five mistakes that could blindside you at immigration. Watch out for number 4 as it\u2019s the biggest one to avoid.<\/p>\n<h2 class=\"p3\"><span id=\"1_Awrong_visa_for_your_activities\"><span class=\"s1\">1. A<\/span>\u00a0wrong visa for your activities<b\/><\/span><\/h2>\n<p class=\"p3\">Let\u2019s start with the case of volunteering abroad being considered \u201cwork\u201d. <b\/>UK backpacker Rebecca Burke, age 28 was detained at the Canadian\/U.S. border on February 26 and held for 19 days. She had a tourist visa and was part of a <em>Workaway<\/em> program, staying with locals <em>in exchange for light chores<\/em>.<\/p>\n<p class=\"p1\"><em>Workaway<\/em> promotes itself as a cultural exchange, volunteering or house-sitting program. But here\u2019s where it gets tricky-\u00a0 when Burke entered Canada, she mentioned her Workaway experience. Canadian officials decided her activities counted as \u201cwork,\u201d and she didn\u2019t have a <em>work visa<\/em>. So they sent her back to the U.S., where she had been doing the same thing for weeks\/months under a tourist visa. This denial from Canada raised a red flag for U.S. border agents.<\/p>\n<p class=\"p1\">In some countries, even <em>unpaid work<\/em>, like doing chores in exchange for a free stay, can legally count as \u201cwork\u201d because immigration sees it as an exchange of equal <em>value<\/em>.<\/p>\n<p class=\"p1\">Burke had done this before under a <em>tourist visa<\/em>. Maybe those countries didn\u2019t ask her questions, or they saw her activities as tourism. But this time, she entered two countries with stricter definitions of what counts as work\u2014and she got flagged.<\/p>\n<p class=\"p1\">Most countries see vacationing and working as two totally different things. If you\u2019re working, they might think you\u2019re taking jobs from locals, planning to stay longer than allowed, or avoiding taxes. That breaks the rules of a tourist visa.<\/p>\n<p class=\"p1\">Workaway didn\u2019t say what type of visa Burke needed. But it depends on the country and what you plan to do. It\u2019s up to you, the traveler, to research and <em>apply for the right visa<\/em>.<\/p>\n<p class=\"p1\">For example, in Germany, even \u201cvolunteering\u201d can count as real work. So you can\u2019t do it on a tourist visa.<\/p>\n<p class=\"p1\">If you accidentally fall into the wrong visa category, even without meaning to, you could get into serious trouble. It\u2019s worthwhile to understand the different visa categories of any country you\u2019re entering.<\/p>\n<p class=\"p1\">When I took my <a href=\"https:\/\/grrrltraveler.com\/studying-abroad-a-yoga-ashram\/\">yoga teacher program in India<\/a>, I was told by my program to never say I was a \u201cstudent\u201d because it pertains to those who are coming to the country strictly for college or university study and it requires lengthy paperwork and an institutional approval. Lacking itinerary documentation &amp; proof of onward travel<b\/><\/span><\/h2>\n<p class=\"p1\">Not having a full <a href=\"https:\/\/grrrltraveler.com\/planning-a-solo-trip\/\">trip itinerary<\/a> or proof of accommodation isn\u2019t technically a visa violation, but it can make immigration officers suspicious.<\/p>\n<p class=\"p1\">In the German girls\u2019 case, they told a German magazine: \u201c<em>We arrived in Honolulu from New Zealand, planning to explore the islands, then fly to the mainland. We\u2019d only booked two nights in an Airbnb so we could stay flexible, like we did in New Zealand. We had an onward ticket to Asia but no U.S. flights booked yet.<\/em>\u201d<\/p>\n<p class=\"p1\">They had valid ESTA approvals under the Visa Waiver Program. But when CBP Hawaii immigration officers pulled them aside, those \u201cflexible plans\u201d raised a red flag. They were planning to stay five weeks in the U.S. but only booked the first two nights.\u00a0 But Hawaii is expensive, especially for places to stay you\u2019re looking at $300-$400\/avg and they were traveling during peak season. How were they going to afford five weeks?<\/p>\n<p class=\"p1\">Secondly, they did not have <em>proof<\/em> of where they were going <em>after<\/em> the U.S.<\/p>\n<p class=\"p1\"><a href=\"https:\/\/grrrltraveler.com\/how-to-provide-proof-of-onward-travel\/\">Onward proof of travel<\/a> means showing a flight or booking that proves you\u2019ll leave the country before your visa ends. It shows immigration that you won\u2019t overstay.<\/p>\n<p class=\"p1\">The girls only had a ticket leaving Asia, not leaving the U.S. or going back to Germany. This was because once in Hawaii, they were likely going to wait-and-see where they wanted to travel to next. They were going to improvise their travels. Unfortunately, immigration doesn\u2019t care if you like being spontaneous. They want to see that you\u2019re a real tourist. You want to have proof that you are here as a tourist and will be leaving at a definite date. They want to see: hotel bookings and bookings for onward <a href=\"https:\/\/grrrltraveler.com\/solo-travel-packing-list\/\">travel to your next destination<\/a>.<\/p>\n<h2 class=\"p5\"><span id=\"3_Improvising_your_travel_plans_at_the_border\">3. Improvising your travel plans at the border<b\/><\/span><\/h2>\n<p class=\"p1\">Hope and improvising at the border or on your visa application is not a strategy. When you\u2019re backpacking, you get used to traveling without a plan. Sometimes you want to decide your next move once you land at your destination.<\/p>\n<p class=\"p1\">But immigration and visas are something you want to be intentional and planned in.<\/p>\n<p class=\"p1\">You\u2019re dealing with another country\u2019s government and it\u2019s black and white rules.\u00a0 You could be denied entry, banned from the country for five years, or deported.<\/p>\n<p>The German backpacker girls later admitted they <i>thought<\/i> about booking dummy tickets or printing travel plans, but decided not to. One of the girls wrote in a post:<\/p>\n<p class=\"p1\"><em>\u201cThey wanted to send us back to Auckland on the next flight, but we asked to rebook our tickets for the next day so we could continue our travels. They agreed but said we\u2019d be detained overnight. We thought we\u2019d just wait in the same room where they interviewed us\u2026 but no.\u201d (receipts in YouTube video)<\/em><\/p>\n<p class=\"p1\">But of you\u2019re denied entry, you\u2019re usually sent back on the next flight to the country you came from. That\u2019s why airlines check your visa before you board- they\u2019re actually responsible for you.<\/p>\n<p class=\"p1\">Everything could\u2019ve been avoided if the girls had just gotten on the flight back to Auckland. But instead, they asked to go to Japan. Since the next flight wasn\u2019t until the next day, they had to stay overnight in federal custody.<\/p>\n<p class=\"p1\">The nearest holding facility that met federal standards was a federal prison. That\u2019s why they were strip-searched and held overnight \u2013 it\u2019s standard for anyone going into the prison system.<\/p>\n<p class=\"p1\">This is where people misunderstand: strip searches and prison stays are not an automatic punishment for being denied entry \u2013 they\u2019re part of the federal holding and detainment process.<\/p>\n<p class=\"p1\">Could this happen to you or me? Yes. I\u2019ve done long backpacking trips with open-ended plans just like them. But immigration doesn\u2019t care about spontaneity. They care about documents and whether you plan to work or overstay.<\/p>\n<h2 class=\"p3\"><span id=\"4_Admitting_to_remote_work_or_freelancing_without_a_work_visa\">4. Admitting to remote work or freelancing without a work visa\u00a0<b\/><\/span><\/h2>\n<p class=\"p1\">During questioning, the girls admitted they sometimes did freelance gigs, for clients in Germany and Asia. That admission sealed their fate. Officers found emails referencing that work and saw it as a sign they planned to work while in the U.S.<\/p>\n<p class=\"p1\">\u00a0Immigration doesn\u2019t just care where your clients are located. They care where you are physically when you\u2019re working. So even if you\u2019re working for a company in another country, if you\u2019re doing it from inside the U.S. on a tourist visa, that\u2019s a violation. You could be breaking immigration law and not even realize it.<\/p>\n<p class=\"p1\">So working from your laptop in a caf\u00e9 abroad as you travel country to country <i>can<\/i> break visa rules if you\u2019re on a tourist visa. Creators and nomads are proudly shouting their lifestyle online, without realizing it might be violating immigration law.<\/p>\n<p class=\"p1\">Old work visas needed local sponsorship\u2014new online businesses don\u2019t fit that model.<\/p>\n<p class=\"p1\">That\u2019s why countries like Bali, Thailand, and Taiwan are rolling out <a href=\"https:\/\/grrrltraveler.com\/guide-to-being-a-digital-nomad\/\">digital nomad visas<\/a> that say:<br \/>\u201cIt\u2019s okay, work online here legally.\u201d<\/p>\n<p class=\"p1\">That\u2019s why some countries more countries like Thailand and Bali, Taiwan are now offer \u201cdigital nomad visas\u201d\u2014special visas that say, \u201cIt\u2019s okay, you can do freelance work online from here legally.\u201d<\/p>\n<p class=\"p1\">\u00a0Check out <a href=\"https:\/\/grrrltraveler.com\/guide-to-being-a-digital-nomad\/\">how to be a digital nomad<\/a> where I link to digital nomad visa sites.<\/p>\n<h2 class=\"p6\"><span id=\"5_Oversharing_at_immigration\">5. Oversharing at immigration<\/span><\/h2>\n<p class=\"p6\">Aside from mentioning their freelance work, I don\u2019t feel the girls made the mistake of oversharing. But this is a big one I see travelers making nonetheless- going into Immigration unprepared and talking too much.<b\/><\/p>\n<p class=\"p1\">A huge travel mistake is treating immigration like a casual chat with friendly staff. Most travelers don\u2019t prepare for this part of their trip, don\u2019t know what to expect, and end up oversharing out of nervousness or a false sense of honesty.<\/p>\n<p class=\"p1\">Immigration officers aren\u2019t your friends\u2014they\u2019re trained to spot anything that doesn\u2019t fit their \u201ctourist\u201d profile. If you give too much info, you hand them reasons to dig deeper.<\/p>\n<p class=\"p1\">The German backpackers weren\u2019t prepared. When asked about work, they talked about past freelance gigs and their flexible travel style. They thought being honest would help. Immigration isn\u2019t asking because they\u2019re curious\u2014they\u2019re assessing risk. Even innocent answers can open up your phone, emails, or apps to further inspection.. If your visa doesn\u2019t align perfectly with your situation, even harmless details can trigger phone searches or deeper questioning.<\/li>\n<li class=\"p1\">U.S. border agents <i style=\"letter-spacing: 0em;\">can<\/i><span style=\"letter-spacing: 0em;\"> search your phone, ask for your passwords, or review your social accounts. I<\/span>f they find something they interpret as \u201cyou\u2019re planning to work,\u201d or you have anti-government sentiments,.. you could be deported even if you had no bad intentions.
