This unsettling scenario, known as a &#8220;pay and recover&#8221; order, typically shifts the ultimate financial burden back to the vehicle owner. For Shyam Lal, the owner of a utility vehicle involved in a tragic accident, this was a very real possibility. However, a recent, pivotal ruling by the Supreme Court of India has emphatically set aside such an order, fundamentally redefining how accident liability is determined, particularly for utility vehicles.<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"Hasdr P8FAI _18oPJ DWkY9\" dir=\"auto\" id=\"viewer-wts24264\"><span class=\"I47Iv\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>The case, <\/span><\/span><span>Shyam Lal v. Shriram General Insurance Co. Ltd.<\/span><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>, saw the High Court initially issuing a &#8220;pay and recover&#8221; directive against Shyam Lal. The High Court&#8217;s reasoning was rooted in its interpretation of the vehicle&#8217;s insurance policy, specifically the <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>&#8220;Limitation as to Use&#8221; <\/span><\/span><\/strong><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>clause. It held that the utility vehicle was not permitted to carry ordinary passengers and that only employees falling under the <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Workmen\u2019s Compensation Act, 1923<\/span><\/span><\/strong><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>, were entitled to travel in it. This meant that if the passengers involved in the accident were not covered by this Act, the owner would bear the financial brunt.<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"Hasdr P8FAI _18oPJ DWkY9\" dir=\"auto\" id=\"viewer-j662d277\"><span class=\"I47Iv\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Shyam Lal, the appellant-owner, swiftly challenged this decision before the Supreme Court. His legal counsel meticulously presented the vehicle&#8217;s Certificate of Registration, the contract carriage permit, and the package policy. Crucially, these documents clearly indicated the vehicle&#8217;s seating capacity as 4+1, including the driver. It was argued that the &#8220;limitation as to use&#8221; for carriage of goods applies only to dedicated goods vehicles, not to a &#8220;utility vehicle&#8221; designed to transport both passengers and goods.<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"Hasdr P8FAI _18oPJ DWkY9\" dir=\"auto\" id=\"viewer-mdaqe293\"><span class=\"I47Iv\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>The Insurance Company, Shriram General Insurance Co. Ltd., countered by highlighting the varied professions of the deceased passengers \u2013 a student, a catering employee, a painter, a postal department employee, and an unemployed man \u2013 arguing they didn&#8217;t fall under permissible categories. The Court found that the certificate of registration categorised the offending vehicle as an &#8220;Utility Van&#8221; with a seating capacity of 5, including the driver. Furthermore, the permit issued for the vehicle was a &#8220;contract carriage&#8221; permit, which explicitly allows for the carriage of passengers for hire or reward. This is in stark contrast to a &#8220;goods carriage&#8221; defined as a vehicle used <\/span><\/span><em style=\"font-style:italic\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>solely<\/span><\/span><\/em><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0for goods<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"Hasdr P8FAI _18oPJ DWkY9\" dir=\"auto\" id=\"viewer-nsvhd314\"><span class=\"I47Iv\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>The package policy itself, for a &#8220;Bolero Camper Utility DC,&#8221; also specified a seating capacity of 4+1. The Court concluded that such an <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>&#8220;<\/span><\/span><\/strong><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>utility vehicle obviously is for carriage of passengers and goods&#8221;, and the passengers are not necessarily limited to being owners of goods. Therefore, the High Court&#8217;s finding that &#8220;the limitation as to the use only of carriage of goods&#8221; applied was rejected.<\/span><\/span><\/span><\/p>\n<\/div>\n<p><h3 class=\"m2cwN EIoCt _18oPJ DWkY9\" dir=\"auto\" id=\"viewer-9d4jt324\"><span class=\"-lMkI\"><span>Insurer&#8217;s Own Admissions <\/span><\/span><\/h3>\n<\/p>\n<div data-breakout=\"normal\">\n<p class=\"Hasdr P8FAI _18oPJ DWkY9\" dir=\"auto\" id=\"viewer-6lwpy326\"><span class=\"I47Iv\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>A significant turning point came from the testimony of the Insurance Company\u2019s own Branch Manager. During cross-examination, the manager admitted that the insurance policy was issued after reviewing the vehicle&#8217;s records, including the registration certificate, which categorised it as a &#8220;Utility Van<\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>&#8220;<\/span><\/span><\/strong><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>. They further conceded that the policy explicitly stated the seating capacity as 4+1\u00a0and contained no recital about not charging premiums for passengers. Most damningly, the manager admitted that a utility van is a vehicle where &#8220;half portion is used for carrying of goods and half portion in front is used for carrying passengers&#8221;.<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"Hasdr P8FAI _18oPJ DWkY9\" dir=\"auto\" id=\"viewer-tp04s339\"><span class=\"I47Iv\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>These admissions cemented the Supreme Court\u2019s view: &#8220;there can be no restriction insofar as the \u2018limitation as to use\u2019 as found in the policy which applies only to goods vehicles while the present vehicle as per the certificate of registration is a utility vehicle and the permit issued is of a contract carriage<\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>&#8220;<\/span><\/span><\/strong><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>. The Court unequivocally stated that the Insurance Company, having issued a package policy based on the vehicle\u2019s clear registration and permit, &#8220;cannot wriggle out of its liability to indemnify the owner&#8221;.<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"Hasdr P8FAI _18oPJ DWkY9\" dir=\"auto\" id=\"viewer-pbm94347\"><span class=\"I47Iv\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Regarding the overloading contention, the Supreme Court noted that the Tribunal&#8217;s findings, supported by eyewitness testimony, confirmed that there were only four passengers in the vehicle just before the accident, and some of the claim petitions were from pedestrians hit by the vehicle.<\/span><\/span><\/span><\/p>\n<\/div>\n<p><h3 class=\"m2cwN EIoCt _18oPJ DWkY9\" dir=\"auto\" id=\"viewer-0impt351\"><span class=\"-lMkI\"><span>No Reason for &#8220;Pay and Recover&#8221;<\/span><\/span><\/h3>\n<\/p>\n<div data-breakout=\"normal\">\n<p class=\"Hasdr P8FAI _18oPJ DWkY9\" dir=\"auto\" id=\"viewer-pexgq353\"><span class=\"I47Iv\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>The Supreme Court declared, &#8220;We find absolutely no reason to sustain the order of the High Court directing pay and recovery. The liability is on the Insurance Company and that has to be satisfied fully by the Insurance Company&#8221;.<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"Hasdr P8FAI _18oPJ DWkY9\" dir=\"auto\" id=\"viewer-78her358\"><span class=\"I47Iv\"><span style=\"color:rgb(19, 19, 20);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>This judgment serves as a critical clarification for vehicle owners and insurance companies alike.
