{"id":338769,"date":"2025-12-11T05:21:55","date_gmt":"2025-12-11T05:21:55","guid":{"rendered":"https:\/\/peraltafinancing.com\/uncategorized\/judicial-review-applications-based-on-oral-decisions\/"},"modified":"2025-12-11T05:21:55","modified_gmt":"2025-12-11T05:21:55","slug":"judicial-review-applications-based-on-oral-decisions","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=338769","title":{"rendered":"Judicial Review Applications based on Oral Decisions"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>Can applications for judicial review (\u201c<strong>JR Applications<\/strong>\u201d) be filed with regard to oral decisions that relate to the exercise of a public duty or function?<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a><\/p>\n<p>Based on the cases explored in this article, the answer to this question is in the affirmative.<\/p>\n<p><u>Decisions of the Strata Management Tribunal (\u201c<strong>SMT<\/strong>\u201d) <\/u><\/p>\n<p>In <em>Tham Sau Hoon v Tribunal Pengurusan Strata &amp; Anor<\/em> [2021] MLJU 1087, the SMT delivered both its decision and the reasons for its decision orally.<a href=\"#_ftn2\" name=\"_ftnref2\"><sup>[2]<\/sup><\/a> The applicant therein then filed a JR Application based on the SMT\u2019s oral decision and reasons.<a href=\"#_ftn3\" name=\"_ftnref3\"><sup>[3]<\/sup><\/a><\/p>\n<p>A similar instance occurred in <em>Perbadanan Pengurusan Sunrise Towers v Tribunal Pengurusan Strata &amp; Anor<\/em> [2020] MLJU 1604.<a href=\"#_ftn4\" name=\"_ftnref4\"><sup>[4]<\/sup><\/a><\/p>\n<p>In <em>Caroline Philomena Gomez v Tribunal Pengurusan Strata &amp; Anor <\/em>[2021] CLJU 2496, the SMT delivered its decision orally but did not provide its reasons for its decision.<a href=\"#_ftn5\" name=\"_ftnref5\"><sup>[5]<\/sup><\/a> The applicant therein then filed a JR Application based on the SMT\u2019s oral decision.<\/p>\n<p><u>Decisions of the Tribunal for Homebuyer Claims (\u201c<strong>THC<\/strong>\u201d)<\/u><\/p>\n<p>In <em>Hazlinda bte Hamzah v Kumon Method of Learning Centre<\/em> [2006] 3 MLJ 124, a decision of the Court of Appeal, the THC delivered both its decision and the reasons for its decision orally.<a href=\"#_ftn6\" name=\"_ftnref6\"><sup>[6]<\/sup><\/a> The applicant therein then filed a JR Application based on the THC\u2019s oral decision and reasons.<a href=\"#_ftn7\" name=\"_ftnref7\"><sup>[7]<\/sup><\/a><\/p>\n<p>The THC in <em>Denia Development Sdn. Bhd. v Tribunal Tuntutan Pembeli Rumah &amp; Anor<\/em> [2019] MLJU 783 allowed the Claimant\u2019s claim and granted its Award.<a href=\"#_ftn8\" name=\"_ftnref8\"><sup>[8]<\/sup><\/a> However, the THC did not provide its reasons for its decision.<a href=\"#_ftn9\" name=\"_ftnref9\"><sup>[9]<\/sup><\/a> The applicant therein filed a JR Application based on the THC\u2019s oral decision.<a href=\"#_ftn10\" name=\"_ftnref10\"><sup>[10]<\/sup><\/a><\/p>\n<p>A similar situation occurred in <em>Seraimas Bina Sdn Bhd v Tribunal Tuntutan Pembeli Rumah Negeri Pulau Pinang &amp; Anor<\/em> [2017] 1 LNS 181,<a href=\"#_ftn11\" name=\"_ftnref11\"><sup>[11]<\/sup><\/a> and <em>Oxbridge Height Sdn Bhd v.
