{"id":335858,"date":"2025-12-09T04:54:39","date_gmt":"2025-12-09T04:54:39","guid":{"rendered":"https:\/\/peraltafinancing.com\/business\/legal\/extension-of-tenure-of-federal-court-judges\/"},"modified":"2025-12-09T04:54:39","modified_gmt":"2025-12-09T04:54:39","slug":"extension-of-tenure-of-federal-court-judges","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=335858","title":{"rendered":"Extension of tenure of Federal Court judges"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>Article 125(1) of the Federal Constitution (\u201c<strong>FC<\/strong>\u201d), which governs the tenure of Federal Court judges and the extension of their tenure, provides the following:<\/p>\n<p style=\"padding-left: 40px;\">\u201cSubject\u00a0 to\u00a0 the\u00a0 provisions\u00a0 of\u00a0 Clauses\u00a0 (2)\u00a0 to\u00a0 (5),\u00a0 a\u00a0 judge\u00a0 of\u00a0 the\u00a0 Federal\u00a0 Court\u00a0 shall\u00a0 hold\u00a0 office\u00a0 until\u00a0 he\u00a0 attains\u00a0 the\u00a0 age\u00a0 of\u00a0 sixty-six\u00a0 years\u00a0 or\u00a0 such\u00a0 later\u00a0 time,\u00a0 not\u00a0 being\u00a0 later\u00a0 than\u00a0 six\u00a0 months\u00a0 after he attains that age, <strong><u>as the Yang di-Pertuan Agong may approve<\/u><\/strong>.\u201d (Bold and underline mine)<\/p>\n<p>A legal issue arises as to whether, under Article 125(1) of the FC, the Yang di-Pertuan Agong (\u201c<strong>YDPA<\/strong>\u201d) exercises the power to extend the tenure of Federal Court judges on advice or at his discretion.<\/p>\n<p>Both positions are legally tenable, and can be reasonably argued:<\/p>\n<p style=\"padding-left: 40px;\">(a) The YDPA\u2019s power under Article 125(1) is exercisable \u201cin accordance with the advice of the Cabinet or a Minister acting under the general authority of the Cabinet\u201d<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a> [\u201c<strong>Position 1<\/strong>\u201d];<\/p>\n<p style=\"padding-left: 40px;\">(b) The YDPA\u2019s power under Article 125(1) of the FC is exercisable \u201cin his discretion\u201d<a href=\"#_ftn2\" name=\"_ftnref2\"><sup>[2]<\/sup><\/a> [\u201c<strong>Position 2<\/strong>\u201d].<\/p>\n<p><strong><u>Position 1<\/u><\/strong><\/p>\n<p>Some of the arguments in support of Position 1 are as follows:<\/p>\n<p style=\"padding-left: 40px;\">(a) As a general rule, the YDPA acts on advice.<a href=\"#_ftn3\" name=\"_ftnref3\"><sup>[3]<\/sup><\/a> The limited exceptions are those found in Article 40(2) of the FC. Hence, the YDPA\u2019s power under Article 125(1) of the FC should be exercised on advice except where expressly provided otherwise;<\/p>\n<p style=\"padding-left: 40px;\">(b) The phrase \u201cas the Yang di-Pertuan Agong may approve\u201d in Article 125(1) of the FC is too vague, and does not fall within the exception of \u201cin any other case mentioned in this Constitution\u201d found in Article 40(2) of the FC; and<\/p>\n<p style=\"padding-left: 40px;\">(c) The YDPA acts on the advice of the Prime Minister on the appointment of judges<a href=\"#_ftn4\" name=\"_ftnref4\"><sup>[4]<\/sup><\/a> and so it would be reasonable to imply\/presume that it is the same case when it comes to the extension of the tenure of judges under Article 125(1) of the FC.<\/p>\n<p>Historically, it is evident that the Executive has regarded Position 1 as the correct position.<a href=\"#_ftn5\" name=\"_ftnref5\"><sup>[5]<\/sup><\/a><\/p>\n<p><strong><u>Position 2<\/u><\/strong><\/p>\n<p>Several arguments in support of Position 2 include:<\/p>\n<p style=\"padding-left: 40px;\">(a) Article 125(1) of the FC is silent on the YDPA needing to act on advice, unlike the appointment of judges under Article 122B of the FC. Parliament could have, but did not, insert an express requirement for the YDPA to act on advice when exercising his power under Article 125(1) of the FC; and<\/p>\n<p style=\"padding-left: 40px;\">(b) Parliament expressly used the phrase \u201cas the Yang di-Pertuan Agong may approve\u201d in Article 125(1) of the FC. This phrase does not appear anywhere else in the FC, and falls within the \u201cin any other case mentioned in this Constitution\u201d exception in Article 40(2) of the FC.<\/p>\n<p>The late Karpal Singh s\/o Ram Singh Deo, in a press statement on the tenure of Tun Ahmad Fairuz Sheikh Abdul Halim (the then Chief Justice) who was due to retire soon, was in effect of the view that Position 2 was correct in law.<a href=\"#_ftn6\" name=\"_ftnref6\"><sup>[6]<\/sup><\/a><\/p>\n<p>It will be interesting to see which position the Judiciary finds more persuasive in the event the matter is brought before the courts.<\/p>\n<hr\/>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><sup>[1]<\/sup><\/a> Article 40(1) of the Federal Constitution<\/p>\n<p><a href=\"#_ftnref2\" name=\"_ftn2\"><sup>[2]<\/sup><\/a> Article 40(2) of the Federal Constitution<\/p>\n<p><a href=\"#_ftnref3\" name=\"_ftn3\"><sup>[3]<\/sup><\/a> Article 40(1) of the Federal Constitution<\/p>\n<p><a href=\"#_ftnref4\" name=\"_ftn4\"><sup>[4]<\/sup><\/a> Article 122B(1) of the Federal Constitution<\/p>\n<p><a href=\"#_ftnref5\" name=\"_ftn5\"><sup>[5]<\/sup><\/a> See for example Bala Krishnan, Dhesegaan. \u201cAnwar: Govt considering extending Tengku Maimun\u2019s tenure as chief justice.\u201d 22 May 2025, <a href=\"https:\/\/www.malaymail.com\/news\/malaysia\/2025\/05\/22\/anwar-govt-considering-extending-tengku-maimuns-tenure-as-chief-justice\/177759\">https:\/\/www.malaymail.com\/news\/malaysia\/2025\/05\/22\/anwar-govt-considering-extending-tengku-maimuns-tenure-as-chief-justice\/177759<\/a>.
