{"id":328117,"date":"2025-12-02T19:20:42","date_gmt":"2025-12-02T19:20:42","guid":{"rendered":"https:\/\/peraltafinancing.com\/uncategorized\/odisha-jan-vishwas-bill-2025-key-highlights-explained\/"},"modified":"2025-12-02T19:20:42","modified_gmt":"2025-12-02T19:20:42","slug":"odisha-jan-vishwas-bill-2025-key-highlights-explained","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=328117","title":{"rendered":"Odisha Jan Vishwas Bill 2025: Key Highlights Explained"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<div class=\"intro-text\">\n<p>The Odisha Legislative Assembly on 2 December 2025 passed the Odisha Jan Vishwas Bill, 2025 \u2013 a landmark legislation that decriminalises minor and procedural offences across 16 state laws, replacing imprisonment with graded monetary penalties and aligning Odisha with the Centre\u2019s Jan Vishwas (Amendment of Provisions) Act, 2023.<\/p>\n<hr\/>\n<\/div>\n<p>Inspired by the national framework already adopted by states like Madhya Pradesh, Chhattisgarh, Gujarat and Tripura, the bill aims to reduce compliance burden, eliminate fear of criminal prosecution for technical lapses, and create an investor-friendly and citizen-centric environment.<\/p>\n<h4>Key Highlights of the Bill<\/h4>\n<ul>\n<li>\u2013 Amends 16 laws belonging to 9 departments<\/li>\n<li>\u00a0Identifies 161 provisions for rationalisation<\/li>\n<li>\u00a0Removes or decriminalises 50 imprisonment clauses<\/li>\n<li>\u00a0Converts 111 existing fines into civil monetary penalties<\/li>\n<li>\u00a0Serious offences involving deliberate fraud, public health, environment or society remain fully criminal and punishable under the Bharatiya Nyaya Sanhita<\/li>\n<\/ul>\n<h4>Offences Re-categorised into Two Groups<\/h4>\n<p><strong>**Category A**<\/strong> covers minor procedural lapses, such as delay in filing returns or failure to furnish required information.<br \/><strong>**Category B**<\/strong> includes slightly more serious compliance-based or technical violations, such as operating without registration or non-renewal of a licence.<\/p>\n<p>The new penalty structure, based on the severity of the earlier imprisonment provision, is as follows:<\/p>\n<ul>\n<li>For offences that previously carried imprisonment of up to 3 months:<br \/>Category A offenders will now pay \u20b95,000 to \u20b925,000, while Category B offenders will pay \u20b925,000 to \u20b975,000.<\/li>\n<li>For offences that previously carried imprisonment of 6 months to 1 year:<br \/>Category A penalty ranges from \u20b925,000 to \u20b91 lakh, while Category B penalty ranges from \u20b975,000 to \u20b92 lakh.<\/li>\n<li>For offences that previously carried imprisonment of 1 to 3 years:<br \/>Category A offenders will be fined \u20b91 lakh to \u20b92 lakh, whereas Category B offenders will face \u20b92 lakh to \u20b95 lakh.<\/li>\n<\/ul>\n<p>In every case, Category B (technical\/compliance-based) violations attract a higher penalty slab than Category A (purely procedural) violations, ensuring the punishment remains proportionate and deterrent without resorting to jail terms for minor or inadvertent breaches.<\/p>\n<h4>List of 16 Laws Amended<\/h4>\n<p>1. The Odisha Nurses and Midwives Registration Act, 1938<br \/>2. The Odisha Municipal Act, 1950<br \/>3. The Odisha Prevention of Gambling Act, 1955<br \/>4. The Odisha Agricultural Produce Markets Act, 1956<br \/>5. The Odisha Town Planning and Improvement Trust Act, 1956<br \/>6. The Odisha Shops and Commercial Establishments Act, 1956<br \/>7. The Odisha Electricity (Duty) Act, 1961<br \/>8. The Odisha Kendu Leaves (Control of Trade) Act, 1961<br \/>9. The Odisha Co-operative Societies Act, 1962<br \/>10. The Odisha Industrial Establishments (National &amp; Festival) Holidays Act, 1969<br \/>11. The Odisha Development Authorities Act, 1982<br \/>12. The Odisha Fire and Emergency Services Act, 1993<br \/>13. The Odisha Municipal Corporation Act, 2003<br \/>14. The Odisha Value Added Tax Act, 2004<br \/>15. The Odisha Labour Welfare Fund Act, 2005<br \/>16. The Odisha Excise Act, 2008<\/p>\n<h4>Four Core Reforms Introduced<\/h4>\n<p>1. Decriminalisation of minor offences \u2013 jail terms replaced with civil penalties<br \/>2. Administrative adjudication mechanism for quick resolution<br \/>3. Conversion of criminal \u201cfines\u201d into \u201ccivil monetary penalties\u201d<br \/>4.
