{"id":327597,"date":"2025-12-02T11:43:26","date_gmt":"2025-12-02T11:43:26","guid":{"rendered":"https:\/\/peraltafinancing.com\/uncategorized\/sec-has-regarded-ethereum-as-security-for-at-least-a-year-report\/"},"modified":"2025-12-02T11:43:26","modified_gmt":"2025-12-02T11:43:26","slug":"sec-has-regarded-ethereum-as-security-for-at-least-a-year-report","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=327597","title":{"rendered":"SEC has regarded Ethereum as security for at least a year: report"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<div>\n<ul>\n<li><span style=\"font-weight: 400\">SEC began investigtions into Ethereum as a security in March 2023.<\/span><\/li>\n<li><span style=\"font-weight: 400\">The regulator sent subpoenas and a Wells Notice to Consensys, a Ethereum development firm.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">The US Securities and Exchange Commission (SEC) has reportedly viewed <a href=\"https:\/\/coinjournal.net\/news\/tag\/ethereum\/\">Ethereum<\/a> as an unregistered security for at least a year, FOX Business <a href=\"https:\/\/www.foxbusiness.com\/markets\/new-court-filings-show-sec-chair-gensler-believed-ethereum-was-security-for-at-least-year\" target=\"_blank\" rel=\"noopener\">reported<\/a><\/span><span style=\"font-weight: 400\">\u00a0on Monday<\/span><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">According to the publication, this consideration about ETH comes to light following court filings by Ethereum software developer company Consensys. <\/span><\/p>\n<p><span style=\"font-weight: 400\">The company, which <a href=\"https:\/\/twitter.com\/CoinJournal\/status\/1783583222053429527\">sued the SEC last week<\/a> amid investigations around the cryptocurrency, maintains that Ethereum is not a security.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Consensys sued the SEC<\/span><\/h2>\n<p><span style=\"font-weight: 400\">The Consensys team\u2019s lawsuit filed in Texas accused the Gary Gensler led SEC of \u201coverreach\u201d in its regulation of the crypto space. The lawsuit also asked the court to declare ETH not a security.<\/span><\/p>\n<p><span style=\"font-weight: 400\">SEC\u2019s Wells Notice to Consensys and an investigation against the Ethereum Foundation have been key events to unfold in the past few weeks.<\/span><\/p>\n<p><span style=\"font-weight: 400\">FOX Business\u2019 report states that documents show the SEC\u2019s Enforcement Division has looked at Ethereum as an unregistered security since March last year. Per the documents, the investigation centers on the so-called \u201cEthereum 2.0.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">The SEC believes that there might have been securities \u201coffers and sales\u201d involving Ethereum since 2018.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Interestingly, this is the same year that SEC\u2019s then-Director of Corporation Finance Bill Hinman said Ethereum was a security.
