In
\nmy ongoing research of what jurors think and how they decide cases, I am once
\nagain reminded of the enduring \u201cCSI effect,\u201d and how lawyers would do well to
\npay more attention to it.<\/span><\/p>\n

Simply
\nput, the \u201cCSI effect\u201d is jurors\u2019 overriding, sometimes obsessive, need to
\nexplore for themselves every bit of physical evidence in an attempt to come to
\na fair and just decision. This is true whether the case is civil or criminal.
\nContracts are scrutinized, emails pored over and signatures examined with the
\nsame zeal as skid marks and bloodstains.<\/span><\/p>\n

What\u2019s
\nthe lesson here? It\u2019s up to you, the attorney, to look at your evidence every
\nwhich way and give a forceful, compelling, interpretation to your evidence so
\nit cannot be re-interpreted in some unfavorable way by a jury that examines the
\nevidence with a keener eye than yours. Use visuals of all kinds, videos,
\ngraphics, charts, and mock-ups where appropriate, to emphasize and bring home
\nyour position on the evidence. Even when there is no way for you or your
\nexperts to say with conviction \u201cHere\u2019s the smoking gun!\u201d offer the jurors the
\nstrongest probable interpretation that can be drawn from the evidence.<\/span><\/p>\n

Leaving
\nthe interpretation up to the jurors is taking a chance you can ill afford when
