Copyright laws are meant to protect the artistic work of creators. However, a question arises: does every artist fall under the exact legal definition of an author? Today, I would like to explore the question\u2014<\/strong>\u201cIs your makeup copyrightable in any country?\u201d<strong data-end=\"639\" data-start=\"589\">\u2014under various legal systems around the globe.<\/strong><\/span><\/p>\n<p data-end=\"855\" data-start=\"641\" style=\"text-align: justify;\"><span style=\"font-family: times; font-size: medium;\">Copyright laws primarily aim to safeguard the interests and sole authorship of creators by protecting their original work. If a third party infringes a copyrighted work, the creator may be entitled to compensation.<\/span><\/p>\n<\/div>\n<div>\n<h3 data-end=\"875\" data-start=\"862\" style=\"text-align: justify;\"><strong data-end=\"875\" data-start=\"866\"><span style=\"font-family: times; font-size: medium;\"><u>India<\/u><\/span><\/strong><\/h3>\n<h3\/>\n<p data-end=\"1300\" data-start=\"877\" style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: times; font-size: medium;\">In India, an artist&#8217;s creation is protected under the\u00a0<strong data-end=\"956\" data-start=\"931\">Copyright Act of 1957<\/strong>, which has a broad scope. This Act explicitly defines\u00a0<strong data-end=\"1031\" data-start=\"1011\">\u201cartistic work.\u201d<\/strong>\u00a0As per Section 2(c), artistic work includes a painting, sculpture, drawing (including maps, charts, diagrams, or plans), engraving, photograph, work of architecture, or any other work of artistic craftsmanship\u2014regardless of whether the work possesses artistic quality.<\/span><\/p>\n<p data-end=\"1805\" data-start=\"1302\" style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: times; font-size: medium;\">This means your work does not need to be of supreme artistic quality; it only needs to be\u00a0<strong data-end=\"1404\" data-start=\"1392\">original<\/strong>\u00a0to be copyrightable. However, copyright law does\u00a0<strong data-end=\"1480\" data-start=\"1454\">not protect mere ideas<\/strong>\u2014the idea must be\u00a0<strong data-end=\"1511\" data-start=\"1498\">expressed<\/strong>\u00a0in a tangible form to qualify. Therefore, if you are the creator of an original artwork, it is advisable to\u00a0<strong data-end=\"1642\" data-start=\"1620\">register your work<\/strong>\u00a0under copyright law. Although registration is not mandatory (as copyright exists upon expression), it strengthens legal protection in case of future infringement.<\/span><\/p>\n<\/div>\n<div style=\"text-align: left;\">\n<p><span style=\"font-family: times; font-size: medium;\"><strong data-end=\"1834\" data-start=\"1816\"><u>United Kingdom<\/u><\/strong><\/span><\/p>\n<p><span style=\"font-family: times; font-size: medium;\"><strong data-end=\"1834\" data-start=\"1816\"><u><br \/><\/u><\/strong>In the UK, the High Court in the\u00a0<em data-end=\"1879\" data-start=\"1869\">Adam Ant<\/em>\u00a0case ruled that, under Section 3 of the Copyright, Designs and Patents Act,\u00a0<strong data-end=\"2005\" data-start=\"1956\">facial makeup cannot be considered a painting<\/strong>.<\/span><\/p>\n<p><span style=\"font-family: times; font-size: medium;\"><br \/>In the 1983 case\u00a0<em data-end=\"2075\" data-start=\"2025\"><b>Merchandising Corporation of America v. Harpbond<\/b><\/em>, the court noted that:-<\/span><\/p>\n<p><span style=\"font-family: times; font-size: medium;\"><br \/><i>\u201cPainting was not defined in the Act but was a word in ordinary English usage,\u201d adding that \u201cit was a question of fact in each case whether the subject qualifies as a painting.\u201d<\/i><\/span><\/p>\n<p><span style=\"font-family: times; font-size: medium;\"><br \/>The word\u00a0<strong data-end=\"2302\" data-start=\"2289\">\u201csurface\u201d<\/strong>\u00a0played a crucial role in the judgment. The court held:-<\/span><\/p>\n<p><span style=\"font-family: times; font-size: medium;\"><br \/><i>\u201cA painting must be on a surface. If there were a painting in this case, it must be the makeup marks plus the second plaintiff&#8217;s face. If the marks were taken off the face, there could not be a painting.\u201d<\/i><\/span><\/p>\n<p><span style=\"font-family: times; font-size: medium;\"><br \/>The UK court further noted that if the makeup was depicted on paper in the form of a\u00a0<strong data-end=\"2672\" data-start=\"2651\">sketch or drawing<\/strong>, it might be eligible for copyright protection, but not otherwise.<\/span><\/p>\n<\/div>\n<div style=\"text-align: left;\">\n<h3 data-end=\"2760\" data-start=\"2746\"><strong data-end=\"2760\" data-start=\"2750\"><u><span style=\"font-family: times;\">France<\/span><\/u><\/strong><\/h3>\n<h3\/>\n<p data-end=\"3150\" data-start=\"2762\" style=\"font-weight: 400;\"><span style=\"font-family: times;\">French intellectual property laws are more flexible. They do not require creative works to fit into predefined categories. Unlike UK law,\u00a0<strong data-end=\"2989\" data-start=\"2900\">French law does not focus on the surface (e.g., the skin) or the fixation of the work<\/strong>\u00a0as a condition for protection. As a result,\u00a0<strong data-end=\"3118\" data-start=\"3034\">makeup artistry may be more likely to qualify for copyright protection in France<\/strong>, assuming the work is original.<\/span><\/p>\n<\/div>\n<div style=\"text-align: left;\">\n<p><span style=\"font-family: times; font-size: medium;\"><strong data-end=\"3174\" data-start=\"3161\"><u>Argentina<\/u><\/strong><\/span><\/p>\n<p><span style=\"font-family: times; font-size: medium;\"><strong data-end=\"3174\" data-start=\"3161\"><br \/><\/strong>In Argentina, courts appear to support fashion and beauty industry artists, not necessarily through copyright laws directly, but under the protection of\u00a0<strong data-end=\"3361\" data-start=\"3329\">moral and patrimonial rights<\/strong>\u00a0of the artist.<\/span><\/p>\n<p><span style=\"font-family: times; font-size: medium;\"><br \/>For instance, in 2011, a case arose where a magazine publisher gave credit for makeup work to the wrong person. Initially, the court rejected the case on grounds that the makeup work lacked originality.
