Not.<\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-size: 13pt; mso-bidi-font-family: Verdana; mso-bidi-font-size: 11.0pt; mso-bidi-language: EN-US;\">Fascinating research<br \/>\n(Flores, 2011) revealed something I long suspected from years of trial<br \/>\nconsulting: people feel that what is between themselves and a sheet of paper is<br \/>\nprivate. Potential jurors are most honest with their true thoughts and feelings<br \/>\nin response to jury questionnaires, to a surprising degree.<\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-size: 13pt; mso-bidi-font-family: Verdana; mso-bidi-font-size: 11.0pt; mso-bidi-language: EN-US;\">Jurors in the study<br \/>\nfailed to answer truthfully to 67% of voir dire questions, 33% of attorney<br \/>\nsidebar questions, fully 50% of judge sidebar questions, and even to 20% of<br \/>\nquestions asked in chambers.<\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-size: 13pt; mso-bidi-font-family: Verdana; mso-bidi-font-size: 11.0pt; mso-bidi-language: EN-US;\">What does this mean to<br \/>\nyou? Simple. Whenever possible, use a jury questionnaire. Jury<br \/>\nquestionnaires do not need to be arduous, overwrought documents.
