{"id":317445,"date":"2025-11-25T06:49:02","date_gmt":"2025-11-25T06:49:02","guid":{"rendered":"https:\/\/peraltafinancing.com\/business\/legal\/icymi-tri-seal-advisory-sanctions-and-export-controls-relief-for-syria\/"},"modified":"2025-11-25T06:49:02","modified_gmt":"2025-11-25T06:49:02","slug":"icymi-tri-seal-advisory-sanctions-and-export-controls-relief-for-syria","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=317445","title":{"rendered":"ICYMI: Tri-Seal Advisory: Sanctions and Export Controls Relief for Syria"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p><span style=\"font-weight: 400;\">On November 7, 2025, the Office of Foreign Assets Control (OFAC), alongside the U.S. Department of State and the U.S. Department of Commerce, issued a Tri-Seal Advisory: <\/span><a href=\"https:\/\/ofac.treasury.gov\/media\/934736\/download?inline\"><span style=\"font-weight: 400;\">Sanctions and Export Controls Relief for Syria<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Advisory follows President Trump\u2019s <\/span><a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/06\/providing-for-the-revocation-of-syria-sanctions\/\"><span style=\"font-weight: 400;\">Executive Order<\/span><\/a><span style=\"font-weight: 400;\"> on June 30, 2025, formally <\/span><a href=\"https:\/\/diaztradelaw.com\/icymi-president-trump-lifts-syria-sanctions\/\"><span style=\"font-weight: 400;\">removing U.S. sanctions on Syria<\/span><\/a><span style=\"font-weight: 400;\"> and directing agencies to take additional measures to encourage U.S. private sector and foreign partner reengagement in Syria.<\/span><\/p>\n<h4><b>New Opportunities &amp; Remaining Restrictions<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">The Advisory outlines what business with Syria is now permissible as well as what restrictions remain.<\/span><\/p>\n<p><b><i>Permissible Business:<\/i><\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The United States no longer imposes comprehensive sanctions on Syria.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Caesar Act is suspended, except for sanctionable transactions with Russia and Iran.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The transfer of most basic civilian use U.S.-origin goods, as well as software and technology, to or within Syria is permitted without a license.\u00a0<\/span><\/li>\n<\/ul>\n<p><b><i>Remaining Restrictions:<\/i><\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sanctions remain on \u201cthe worst of the worst:\u201d Bashar al-Assad and his associates, human rights abusers, drug traffickers, and other destabilizing regional actors.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The U.S. Government continues to review Syria\u2019s State Sponsor of Terrorism (SST) designation.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Most Commerce Control List items going to Syria still require a U.S. export license.<\/span><\/li>\n<\/ul>\n<h4><b>What Exporters Should Do<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">The removal of Syria sanctions and the easing of export-control requirements open up new opportunities for exporters who have avoided the market to comply with U.S. law. However, exporters should proceed with caution and ensure they conduct thorough due diligence before engaging in any business in Syria.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While sanctions have largely been lifted, certain sanctions remain <\/span><span style=\"font-weight: 400;\">in effect for individuals and entities related to Bashar al-Assad and his affiliates. Exporters should also be mindful of the historic links between Syrian entities and Iran. Due diligence should address potential sanctions issues with indirect relationships with Iran or Iranian entities.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Before conducting business with Syria, exporters should consult legal counsel to ensure proper due diligence is conducte<\/span><span style=\"font-weight: 400;\">d. Violations of export control laws carry hefty civil and criminal penalties.
