These are contracts that try to limit where you can work after you leave a job. Employers often use them to keep patients from following a departing provider to a new clinic down the road.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">But starting <strong>September 1, 2025<\/strong>, Texas is changing the game. A new law (Senate Bill 1318) puts strict limits on what healthcare non-competes can say and how far they can go. If you\u2019ve ever worried, <em>\u201cCan my hospital really stop me from practicing nearby?\u201d<\/em>, this law gives you more clarity \u2014 and more freedom.<\/p>\n<h2 style=\"white-space:pre-wrap;\">What\u2019s Changing?<\/h2>\n<p class=\"\" style=\"white-space:pre-wrap;\">Here are the biggest takeaways:<\/p>\n<ul data-rte-list=\"default\">\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>One Year Limit<\/strong><br \/>Your employer can\u2019t stop you from practicing for more than <strong>12 months<\/strong> after you leave.<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>Five Mile Radius<\/strong><br \/>Non-competes can\u2019t cover huge areas anymore. They\u2019re capped at <strong>five miles from the clinic or hospital where you mainly worked<\/strong>.<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>Buyouts Are Affordable<\/strong><br \/>If your contract includes a buyout option (a way to \u201cpay your way out\u201d of the non-compete), the most it can cost is <strong>one year of your salary<\/strong>.<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>Must Be Clear and in Writing<\/strong><br \/>No more vague or hidden restrictions. The terms have to be written clearly so you know what you\u2019re signing.<\/p>\n<\/li>\n<\/ul>\n<h2 style=\"white-space:pre-wrap;\">Special Protections for Physicians<\/h2>\n<p class=\"\" style=\"white-space:pre-wrap;\">If you\u2019re a doctor, you get some extra protections:<\/p>\n<ul data-rte-list=\"default\">\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>Fired Without Good Cause? Non-Compete Is Void.<\/strong><br \/>If your employer lets you go for reasons that aren\u2019t legitimate and job-related, your non-compete can\u2019t be enforced at all.<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>Administrative Roles Don\u2019t Count.<\/strong><br \/>If you work in a purely management role (like being a medical director), these new limits don\u2019t apply \u2014 different rules cover those contracts.<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>Patient Access Still Protected.<\/strong><br \/>Doctors still have rights to patient lists, medical records (with patient permission), and the ability to keep treating patients in the middle of acute illness, even after leaving.<\/p>\n<\/li>\n<\/ul>\n<h2 style=\"white-space:pre-wrap;\">Why This Matters to You<\/h2>\n<p class=\"\" style=\"white-space:pre-wrap;\">Before this law, hospitals and medical groups often used broad non-competes to lock providers out of entire regions for years. That left many healthcare workers facing a tough choice: uproot your life to work elsewhere, or stay stuck in an unhealthy job.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Now:<\/p>\n<ul data-rte-list=\"default\">\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>The rules are clear.<\/strong> Employers can\u2019t claim you can\u2019t practice across half the city.<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>You have leverage.<\/strong> If a non-compete goes beyond one year or five miles, it\u2019s likely unenforceable.<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>It\u2019s easier to move on.<\/strong> With the buyout cost capped, buying your way out is actually realistic.<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>Physicians have extra protection.<\/strong> If you\u2019re fired unfairly, the contract simply doesn\u2019t hold you back.<\/p>\n<\/li>\n<\/ul>\n<h2 style=\"white-space:pre-wrap;\">What About Old Contracts?<\/h2>\n<p class=\"\" style=\"white-space:pre-wrap;\">The new law only applies to agreements <strong>entered into or renewed on or after September 1, 2025<\/strong>. But here\u2019s the catch: many contracts \u201cauto-renew\u201d each year. That renewal may be enough to bring your old agreement under the new rules.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">So if you signed years ago, don\u2019t assume you\u2019re stuck with the old terms. It\u2019s worth reviewing your contract with a lawyer to see whether SB 1318 applies.<\/p>\n<h2 style=\"white-space:pre-wrap;\">What Should You Do Now?<\/h2>\n<ul data-rte-list=\"default\">\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\"><strong>Read Your Contract.<\/strong> Check the duration, mileage, and buyout language. A quick consultation can save you a lot of stress (and money).<\/p>\n<\/li>\n<\/ul>\n<h2 style=\"white-space:pre-wrap;\">Bottom Line<\/h2>\n<p class=\"\" style=\"white-space:pre-wrap;\">Starting September 2025, Texas law gives healthcare workers more freedom to change jobs without being locked out of their communities.
