It can be quite the head scratcher and one of those essentials is <span style=\"color: #00bce4;\"><a href=\"https:\/\/www.wellersaccountants.co.uk\/uk-payroll-services-request-a-meeting-lp\" rel=\"noopener\" style=\"color: #00bce4;\"><span style=\"font-weight: bold;\">Employers&#8217; National Insurance Contributions (NICs)<\/span><\/a><\/span>.<\/p>\n<p data-start=\"678\" data-end=\"768\">If you employ staff then NICs is non-negotiable, and a <strong data-start=\"940\" data-end=\"964\">core part of payroll<\/strong> given it&#8217;s also a major contributor to government revenue, accounting for roughly <strong data-start=\"1037\" data-end=\"1071\">one-sixth of all tax collected<\/strong>.<\/p>\n<p data-start=\"1076\" data-end=\"1221\">This post will guide you through how NICs works, your responsibilities as an employer, and a few ways you may be able to reduce your tax bill. Be sure to read on to find out more:\u00a0\u00a0<\/p>\n<p><a id=\"What\" data-hs-anchor=\"true\"\/><\/p>\n<h2 style=\"font-weight: bold;\">What is Employers&#8217; National Insurance Contributions?\u00a0<\/h2>\n<p>National Insurance (NI) forms part of the <span style=\"font-weight: bold;\">UK tax system<\/span> and it was first introduced in 1911, and then expanded in 1948, to fund state benefits including:<\/p>\n<ul>\n<li>The state pension<\/li>\n<li>The National Health Service (NHS)<\/li>\n<\/ul>\n<p>People&#8217;s e<span>ligibility for some benefits such as the state pension can depend\u00a0on the NICs\u00a0they&#8217;ve made during their working life.<\/span> If you have employees over the age of 16 and you&#8217;re paying them above a certain amount, you owe <span style=\"font-weight: bold;\">NICs on their earnings<\/span>. NICs is in effect a tax on employing people and it forms a significant amount of what HMRC collects in tax every year. \u00a0<\/p>\n<p><span style=\"font-weight: bold;\">Example:<\/span> Say you open a cafe and hire 2 baristas, you&#8217;d then become aware through your payroll that you&#8217;re liable for Employer NICs every month at \u00a3270. If you then multiply that by 12 you can then see how the cost of employing people adds up over time. \u00a0<\/p>\n<p><a id=\"How\" data-hs-anchor=\"true\"\/><\/p>\n<h2>How much do employers pay in NI?\u00a0<\/h2>\n<p>You&#8217;ll pay <span style=\"font-weight: bold;\">C<\/span><strong data-start=\"559\" data-end=\"620\">lass 1 Secondary National Insurance Contributions (NICs)<\/strong> on your employees\u2019 earnings <span style=\"font-weight: normal;\">above <\/span>the <strong data-start=\"694\" data-end=\"722\">Secondary Threshold (ST)<\/strong>. That&#8217;s currently \u00a3417 per month in the <span style=\"color: #00bce4;\"><a href=\"https:\/\/www.wellersaccountants.co.uk\/blog\/why-does-the-uk-tax-year-start-in-april\" rel=\"noopener\" style=\"color: #00bce4;\"><span style=\"font-weight: bold;\">2025\/26 tax year<\/span><\/a><\/span>. Once their gross pay exceeds that threshold, you have to pay a percentage of those earnings.<\/p>\n<p data-start=\"842\" data-end=\"918\">The calculation is actually one of the simpler parts of the UK tax system:<\/p>\n<blockquote data-start=\"919\" data-end=\"1013\">\n<p data-start=\"921\" data-end=\"1013\"><strong data-start=\"921\" data-end=\"1013\">Employer NICs = <\/strong><strong data-start=\"921\" data-end=\"1013\">(Your employee\u2019s gross pay \u2212 the Secondary Threshold) \u00d7 Applicable rate<\/strong><\/p>\n<\/blockquote>\n<p><span>Most employers pay a flat <span style=\"font-weight: normal;\">15%<\/span> above the threshold. But not all employees are treated equally. <\/span><\/p>\n<h2>Common NI categories<\/h2>\n<p>Each of your employees will have a letter code, and that&#8217;s their NI category. Their category is a reflection of their circumstances and the common ones are covered in the table below.<\/p>\n<p>Specialist categories also exist with reduced rates for eligible workers in Freeports, Investment Zones, and maritime industries. Because his apprentice earns \u00a33,500 per month, James pays <strong>no NICs<\/strong> for them under Category H! This then <\/span><span>provides him with a saving of over \u00a3600 per month, or \u00a37,200 a year, compared to taking on a standard employee.<\/span><\/p>\n<p><a id=\"Impacts\" data-hs-anchor=\"true\"\/><\/p>\n<h2><span>What impacts on how much you pay?\u00a0<\/span><\/h2>\n<p><span>There are 2 main factors:<\/span><\/p>\n<p>1. Your employee&#8217;s NI category<\/p>\n<p>2. Contact us to find out more.\" align=\"middle\"\/><\/a><\/span><\/span><!-- end HubSpot Call-to-Action Code --><\/p>\n<p data-start=\"3177\" data-end=\"3302\">In general, that\u2019s how NI works, allocate the correct category, apply the relevant thresholds, and then do the calculation.<span\/><\/p>\n<p data-start=\"3177\" data-end=\"3302\"><span style=\"font-weight: bold;\">Example:<\/span> Jane runs an animation studio and gives one of her apprentice animators (aged 24) a pay rise from \u00a33,750 to \u00a34,250 per month. The additional \u00a3500 a month (equivalent to \u00a36,000 per year) pushes their pay above the UST meaning Jane has to pay 15% NICs on the excess. This is why it&#8217;s essential to plan these increases carefully in advance through a <a href=\"https:\/\/www.wellersaccountants.co.uk\/blog\/what-is-a-business-budget-and-why-is-it-important\" rel=\"noopener\"><span style=\"font-weight: bold; color: #00bce4;\">business budget<\/span><\/a>, so as to help you forecast the additional costs. \u00a0<\/p>\n<p><a id=\"Allowance\" data-hs-anchor=\"true\"\/><\/p>\n<h2><span>The Employment Allowance<\/span><\/h2>\n<p><span>The <span style=\"color: #00bce4;\"><a href=\"https:\/\/www.wellersaccountants.co.uk\/employment-allowance-request-a-meeting-lp\" rel=\"noopener\" style=\"font-weight: bold; color: #00bce4;\">Employment Allowance<\/a><\/span> enables you to reduce your NI bill by up to \u00a310,500 per year should you qualify. It&#8217;s potentially good news if you qualify and the criteria includes:<\/span><\/p>\n<ul>\n<li><span>You&#8217;re a registered employer with a payroll<\/span><\/li>\n<li><span>You can only claim it for one payroll not several<\/span><\/li>\n<li><span>You can only claim it for one company, not many if in a group of interconnected companies<\/span><\/li>\n<li>A business with only directors earning over the secondary threshold for NI can be potentially eligible<\/li>\n<\/ul>\n<p>Of note it&#8217;s not automatic, you need to claim it every tax year, usually through your payroll software. If you&#8217;re a director in a company and you&#8217;re taking a salary then you should consider advice to ascertain the most tax efficient means of paying yourself that takes into account:<\/p>\n<p><a id=\"Benefits\" data-hs-anchor=\"true\"\/><\/p>\n<h2>Tax and NI on employee benefits &#8211; don&#8217;t get caught out<\/h2>\n<p><span>If you&#8217;re giving employees perks (cars, gym memberships, or private healthcare for example)\u00a0these may count as <\/span><span><span style=\"color: #00bce4;\"><a href=\"https:\/\/www.wellersaccountants.co.uk\/blog\/what-is-a-benefit-in-kind-tax\" rel=\"noopener\" style=\"color: #00bce4;\"><strong>Benefits in Kind (BIKs)<\/strong><\/a><\/span><span style=\"font-weight: normal;\">. It <\/span><\/span><span>means\u00a0you incur more NICs. <\/span>BIK is enforced if your <span style=\"font-weight: bold;\">staff benefit from those perks personally<\/span> and there isn&#8217;t a clear or identifiable business purpose. It exists to prevent employers replacing salaries with gifts.<\/p>\n<p>Where there are BIK gifts then both the employees personal tax and their NI is applied along with Employers&#8217; NICs (usually Class 1A or Class 1B). You may also have to pay tax on them too. You have to document this in 1 of 2 ways, either:<\/p>\n<ul>\n<li>By submitting a <span style=\"color: #00bce4;\"><a href=\"https:\/\/www.wellersaccountants.co.uk\/it-is-time-to-complete-the-p11d-form\" rel=\"noopener\" style=\"font-weight: bold; color: #00bce4;\">P11D form<\/a><\/span> to the taxman or;<\/li>\n<li>Making payment of the tax on the benefits through your payroll<\/li>\n<\/ul>\n<p>Critical to this is having clear records of expenses that detail what the benefits were and when exactly they were purchased.<\/p>\n<p>Of note from April 2027 with some limited exceptions, you will have to report tax and most benefits and expenses in real-time through your PAYE payroll submissions. This means all the relevant tax will be deducted from your employee&#8217;s pay in each pay period thereby reducing the need for tax code adjustments and collecting tax on benefits at the end of the year.\u00a0<\/p>\n<div class=\"hs-embed-wrapper\" data-service=\"youtube\" data-responsive=\"true\" style=\"position: relative; overflow: hidden; width: 100%; height: auto; padding: 0px; max-width: 560px; min-width: 256px; display: block; margin: 20px auto 10px;\">\n<div class=\"hs-embed-content-wrapper\">\n<p><iframe loading=\"lazy\" title=\"Chancellor confirms hike in employers&#039; NI while not increasing taxes for &#039;working people&#039;\" width=\"840\" height=\"473\" src=\"https:\/\/www.youtube.com\/embed\/oR5nz4L3olw?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<\/div>\n<\/div>\n<p><span style=\"font-weight: bold;\">Example:<\/span> Bav provides his sales manager with a company car but doesn&#8217;t realise he needs to report this. Then, 9 months later he receives a letter from HMRC requesting a visit to conduct a PAYE audit. Their checks reveal the benefit resulting in a Class 1A NICs liability plus a penalty for not reporting it!\u00a0\u00a0<\/p>\n<p><a id=\"Manage\" data-hs-anchor=\"true\"\/><\/p>\n<h2>How to manage Employers&#8217; NICs<\/h2>\n<p style=\"font-weight: normal;\">Here are some top tips to ensure you don&#8217;t fall foul of NICs:<\/p>\n<p style=\"font-weight: normal;\"><span style=\"font-weight: bold;\">1. Automate<\/span> &#8211; use payroll software that stays up to date with NIC changes and thresholds.\u00a0<\/p>\n<p style=\"font-weight: normal;\"><span style=\"font-weight: bold;\">2. Keep informed<\/span> &#8211; subscribe to updates from HMRC and put reminders in your calendar to check on new rates and rules.\u00a0<\/p>\n<p style=\"font-weight: normal;\"><span style=\"font-weight: bold;\">3. Understand the impact of changes <\/span>&#8211; for changes to rates or thresholds, use budgets and <span style=\"color: #00bce4;\"><a href=\"https:\/\/www.wellersaccountants.co.uk\/pages\/importance-of-a-cash-flow-forecast-and-profit-projections\" rel=\"noopener\" style=\"font-weight: bold; color: #00bce4;\">cashflow forecasts<\/a><\/span> to ascertain the full impact and if you need to make savings,\u00a0hike prices, increase sales, or a combination of all the above.<\/p>\n<p style=\"font-weight: normal;\"><span style=\"font-weight: bold;\">4. Explore tax efficient benefits<\/span> &#8211; are you making use of the Employment Allowance, if applicable? Have you looked into offering benefits to your staff that are exempt from NICS? Think:<\/p>\n<ul>\n<li style=\"font-weight: normal;\">Workplace training<\/li>\n<li style=\"font-weight: normal;\">Payments to an approved pension scheme<\/li>\n<li style=\"font-weight: normal;\">Low emission vehicles<\/li>\n<li style=\"font-weight: normal;\">Wellbeing initiatives<\/li>\n<\/ul>\n<p><strong>5. Manage your workforce needs <\/strong>&#8211; if you understand the impact of any changes, per point 3, you may then explore alternative options if you&#8217;re fearful of breaking your business budget. Can you:<\/p>\n<ul>\n<li>Outsource certain functions?<\/li>\n<li>Use freelancers for project work?<\/li>\n<li>Consider job-sharing arrangements?<\/li>\n<\/ul>\n<p>If you train and upskill existing employees, will there be a related uptick in productivity to make up for the rising cost in your payroll?\u00a0<\/p>\n<p><span style=\"font-weight: bold;\">6. Obtain professional advice<\/span> &#8211; consult your <a href=\"https:\/\/www.wellersaccountants.co.uk\/uk-payroll-services-request-a-meeting-lp\" rel=\"noopener\"><span style=\"font-weight: bold; color: #00bce4;\">accountant or tax advisor<\/span><\/a> to ensure you&#8217;re compliant, and not missing out on any potential savings!\u00a0<\/p>\n<p><a id=\"Mistakes\" data-hs-anchor=\"true\"\/><\/p>\n<h2>Common mistakes to avoid<\/h2>\n<p><span style=\"font-weight: bold;\">1. Incorrect employee classification<\/span> &#8211; check the ages of your employees carefully, it&#8217;s easy to miss a birthday, so make sure they&#8217;re still under 21 or under 25 as an apprentice to benefit\u00a0from reduced NICs.<\/p>\n<p><span style=\"font-weight: normal;\"><span style=\"font-weight: bold;\">2. Overlooking pay elements<\/span> &#8211; <\/span>NI calculations must take into account all forms of pay and benefits, such as overtime, bonuses, and specific benefits-in-kind such as company cars or accommodation (see our <span style=\"color: #00bce4;\"><a href=\"https:\/\/www.wellersaccountants.co.uk\/blog\/what-is-a-benefit-in-kind-tax\" rel=\"noopener\" style=\"font-weight: bold; color: #00bce4;\">blog post<\/a><\/span> on this for a full list). Overlooking these kinds of elements when determining NI contributions is a frequent error, risking potential\u00a0underpayment\u00a0and therefore\u00a0penalties.<\/p>\n<p>Of note, be sure t<span>o include any annual bonuses or commissions your employees earn as part of calculations of their NI contributions for the timeframe in which the payment is made.<\/span><\/p>\n<p><span><span style=\"font-weight: bold;\">3. Late or incomplete reporting<\/span> &#8211; you&#8217;re required to report relevant payroll information which includes NICs to HMRC in real-time. So, whenever your members of staff are paid, you have to complete a <span style=\"font-weight: bold;\">Full Payment Submission (FPS)<\/span> to HMRC. <\/span><\/p>\n<p><span>Do so late, incomplete, or incorrect then you&#8217;ll likely face penalties and complications reconciling your NI payments. Instead use payroll software that can set up a clear schedule to <span style=\"font-weight: bold;\">automatically submit FPS<\/span>.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: bold;\">4. Not adjusting for employee contributions<\/span> &#8211; you need to adjust employee contributions for NI should their circumstances change. Has your employee moved into a higher earnings bracket? Have you checked? Reasons for this range from a change in employment status, a salary increase, or participation in a <span style=\"font-weight: bold;\">salary sacrifice scheme<\/span>.\u00a0<\/p>\n<div class=\"hs-embed-wrapper\" data-service=\"youtube\" data-responsive=\"true\" style=\"position: relative; overflow: hidden; width: 100%; height: auto; padding: 0px; max-width: 560px; min-width: 256px; display: block; margin: 20px auto 10px;\">\n<div class=\"hs-embed-content-wrapper\">\n<p><iframe loading=\"lazy\" title=\"What are National Insurance Contributions?\" width=\"840\" height=\"473\" src=\"https:\/\/www.youtube.com\/embed\/f7pXcjq3xd4?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<\/div>\n<\/div>\n<p><span style=\"font-weight: bold;\">5. Miscalculating the earnings thresholds<\/span> &#8211; earnings thresholds can be subject to change from one <span style=\"color: #00bce4;\"><a href=\"https:\/\/www.wellersaccountants.co.uk\/blog\/end-of-tax-year-planning-strategies-for-2024\/25\" rel=\"noopener\" style=\"font-weight: bold; color: #00bce4;\">tax year<\/a><\/span> to the next. Employees start paying NI at the primary threshold and employers start paying at the secondary threshold. If you misallocate and miscalculate then there will be incorrect deductions.\u00a0<\/p>\n<p><span style=\"font-weight: bold;\">6. Errors related to Salary Sacrifice Schemes<\/span> &#8211; salary sacrifice means your employees can exchange part of their salary for various benefits. Doing so can reduce both employees&#8217; and employers&#8217; NICs. We find clients can forget to apply these adjustments to employee&#8217;s gross salary or miscalculate the salary sacrifice impact on NI calculations. Make sure your payroll system is updated and accurately reflects any adjustments.\u00a0<\/p>\n<p><span style=\"font-weight: bold;\">7. Forgetting NI for off-payroll workers<\/span> &#8211; if you use contractors who operate through a <span style=\"color: #00bce4;\"><a href=\"https:\/\/www.wellersaccountants.co.uk\/blog\/the-8-things-to-action-in-a-limited-company-formation\" rel=\"noopener\" style=\"font-weight: bold; color: #00bce4;\">limited company<\/a><\/span> you need to conduct a careful assessment as to whether they may actually be employees from a tax perspective. Known as IR35 rules, if a contractor falls within them then you&#8217;re responsible for deducting NI contributions.<\/p>\n<p>Don&#8217;t fail to apply NI where contractors are <span style=\"color: #00bce4;\"><a href=\"https:\/\/www.wellersaccountants.co.uk\/blog\/why-you-need-to-do-an-ir35-check-now-on-third-party-workers\" rel=\"noopener\" style=\"font-weight: bold; color: #00bce4;\">subject to IR35<\/a><\/span>. Be sure therefore to regularly assess the status of your off-payroll workers regarding IR35.
