As reported by the <a href=\"https:\/\/washingtonstatestandard.com\/2025\/09\/29\/new-sales-tax-on-services-in-washington-takes-effect-wednesday\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Washington State Standard<\/a> (and republished on the <a href=\"https:\/\/idahocapitalsun.com\/2025\/09\/30\/repub\/new-sales-tax-on-services-in-washington-takes-effect-wednesday\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Idaho Capital Sun<\/a>):<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><a href=\"https:\/\/app.leg.wa.gov\/BillSummary\/?BillNumber=5814&amp;Year=2025&amp;Initiative=false\" target=\"_blank\" rel=\"noopener\" title=\"\">Senate Bill 5814<\/a> is one of the biggest moneymakers used to bring in an estimated $3.6 billion over the next two years to fill a shortfall in the operating budget. This law is expected to fuel $1.1 billion in the two-year budget that began July 1, and $2.6 billion over four years. Hundreds of millions of dollars will also flow to local governments, as they get a share of state sales tax proceeds.<\/p>\n<\/blockquote>\n<p>Advertising services are among those that will now be taxable, and is expected to bring in roughly $475 million over the next four years, according to the Washington State Standard. Comcast, however, believes the sales tax on advertising services is illegal, and is <a href=\"https:\/\/washingtonstatestandard.com\/2025\/09\/15\/comcast-lawsuit-argues-new-washington-tax-on-advertising-is-illegal\/\" target=\"_blank\" rel=\"noopener\" title=\"\">suing to get it overturned<\/a>.<\/p>\n<p>The <a href=\"https:\/\/dor.wa.gov\/forms-publications\/publications-subject\/special-notices\/advertising-services-now-subject-retail-sales-tax\" target=\"_blank\" rel=\"noopener\" title=\"\">Washington State Department of Revenue issued a release in July<\/a> outlining details:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Starting Oct. 1, 2025, businesses must collect retail sales tax on advertising services. Additionally, gross income from these activities is subject to business and occupation (B&amp;O) tax under the Retailing classification.<\/p>\n<p><strong>What are advertising services?<\/strong><\/p>\n<p>Advertising services means all digital and nondigital services related to the creation, preparation, production, or dissemination of advertisements, including, but not limited to:<\/p>\n<ul class=\"wp-block-list\">\n<li>Layout, art direction, graphic design, mechanical preparation, production supervision, placement, referrals, acquisition of advertising space, and rendering advice concerning the best methods of advertising products or services.<\/li>\n<li>Online referrals, search engine marketing, and lead generation optimization, web campaign planning, the acquisition of advertising space in the internet media, and the monitoring and evaluation of website traffic for purposes of determining the effectiveness of an advertising campaign.<\/li>\n<\/ul>\n<\/blockquote>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Advertising services do <strong>not <\/strong>include:<\/p>\n<ul class=\"wp-block-list\">\n<li>Web hosting services and domain name registration.<\/li>\n<li>Services rendered in respect to the following:\n<ul class=\"wp-block-list\">\n<li>    Newspapers as defined in RCW 82.04.214.<\/li>\n<li>    Printing or publishing under RCW 82.04.280.<\/li>\n<li>    Radio and television broadcasting within this state as defined in RCW 82.04 (section 1, chapter 9, Laws of 2025).<\/li>\n<\/ul>\n<\/li>\n<li>Services rendered in respect to out-of-home advertising, including:\n<ul class=\"wp-block-list\">\n<li>    Billboard advertising.<\/li>\n<li>    Street furniture advertising.<\/li>\n<li>    Transit advertising.<\/li>\n<li>    Place-based advertising, such as in-store display advertising or point-of-sale advertising.<\/li>\n<li>    Dynamic or static signage at live events.<\/li>\n<li>    Naming rights.<\/li>\n<li>    Fixed signage advertising.<\/li>\n<li>    Note: This does not include direct mail.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/blockquote>\n<p>It will be interesting to see what comes of this, particularly the Comcast lawsuit, and how it ultimately affects agencies in Washington.
