The agreement must have included an undisclosed commission arrangement that led to you paying higher interest charges. The\u00a0<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/www.fca.org.uk\/consumers\/car-finance-complaints\">Financial Conduct Authority (FCA)<\/a>\u00a0is currently proposing a compensation scheme for affected customers, with payouts expected in 2026.\u00a0<\/p>\n<h2 class=\"wp-block-heading\"><strong>Eligibility criteria<\/strong><\/h2>\n<p>You are likely to be eligible if your finance agreement was affected by any of the following:<\/p>\n<ol class=\"wp-block-list\">\n<li><strong>Discretionary Commission Arrangements (DCA):<\/strong>\u00a0A model that allowed car dealers or brokers to increase your interest rate in exchange for a higher commission. DCAs were banned on January 28, 2021, so any DCA claims must be for agreements made before this date.<\/li>\n<li><strong>Undisclosed, unfairly high commission:<\/strong>\u00a0Your commission was excessive but not revealed to you. The FCA\u2019s guidance defines this as a commission greater than 35% of the total cost of credit and 10% of the overall loan.<\/li>\n<li><strong>Contractually tied arrangements:<\/strong>\u00a0The dealer claimed to search for the best finance deal but was actually tied to an exclusive arrangement with a single lender.\u00a0<\/li>\n<\/ol>\n<h2 class=\"wp-block-heading\"><strong>Important considerations<\/strong><\/h2>\n<p><strong>Who can claim:<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li><strong>Personal use only:<\/strong>\u00a0The vehicle must have been for personal use, though some business agreements may be covered if used primarily for non-business purposes.<\/li>\n<li><strong>Past agreements:<\/strong>\u00a0You can still claim even if the agreement is paid off, the car has been sold, or the vehicle was repossessed.<\/li>\n<li><strong>On behalf of a deceased person:<\/strong>\u00a0It is possible to claim for a person who has passed away.<\/li>\n<\/ul>\n<p><strong>Who is not eligible:<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li><strong>Leasing (PCH):<\/strong>\u00a0Personal Contract Hire (leasing) agreements are not included in the FCA\u2019s investigation.<\/li>\n<li><strong>Interest-free finance:<\/strong>\u00a0Deals with a genuine 0% interest rate are not covered.<\/li>\n<li><strong>Post-ban agreements:<\/strong>\u00a0Deals taken out after January 28, 2021, cannot have included a DCA.<\/li>\n<\/ul>\n<p><strong>How to check for eligibility:<\/strong><\/p>\n<p><strong>Contact your lender:<\/strong>\u00a0The FCA advises contacting your lender directly to see if you had a commission arrangement. Some lenders, like Volkswagen Financial Services and Santander Consumer, have specific online forms for this.<\/p>\n<p><strong>Review your documents:<\/strong>\u00a0Check your original finance paperwork for any mention of commissions.<\/p>\n<p><strong>Check your credit report:<\/strong>\u00a0If you no longer have your paperwork, your finance provider may still be listed on your credit file.<\/p>\n<p><strong>Action for potential claimants:<\/strong><\/p>\n<ol class=\"wp-block-list\">\n<li><strong>Complain to your lender:<\/strong>\u00a0If you believe you are eligible, submit a complaint directly to your finance provider. This is free and you do not need to use a claims management company.<\/li>\n<li><strong>Avoid claims management companies:<\/strong>\u00a0The FCA and consumer advocates like Martin Lewis advise against using claims firms, as they charge a significant fee for a process you can follow for free.<\/li>\n<li><strong>Wait for the compensation scheme:<\/strong>\u00a0Lenders will begin contacting customers once the FCA\u2019s redress scheme is finalized in early 2026.
