In contrast, complex societies,<br \/>\nbound by organic solidarity and characterized by functional interdependence,<br \/>\nadopted restitutive legal systems administered by specialized institutions\u00b2.<br \/>\nWhile these evolutionary models were later found to be empirically flawed, they<br \/>\ndeeply influenced subsequent anthropological debates on whether all societies<br \/>\npossess law and how it should be defined.<\/p>\n<p data-end=\"121\" data-start=\"84\" style=\"text-align: justify;\"><span class=\"relative\">Early<br \/>\ntheorists such as Sir Henry\u202fMaine and \u00c9mile\u202fDurkheim proposed that law evolves<br \/>\nalongside societal complexity: Maine suggested a shift from status-based law in<br \/>\nkinship groups to contract-based law in territorial societies\u00b9. Though<br \/>\ncriticized for oversimplification, these models remain foundational in<br \/>\nquestioning the universality of legal systems.<\/span><\/p>\n<p data-end=\"612\" data-start=\"177\" style=\"text-align: justify;\"><strong data-end=\"206\" data-start=\"177\">Institutional Perspective<\/strong>: Scholars like<br \/>\nRadcliffe\u2011Brown and Hoebel emphasized coercive authority as the essence of<br \/>\nlaw\u2014Radcliffe-Brown described law as &#8220;social control through the<br \/>\nsystematic application of the force of politically organized society&#8221;\u00b3,<br \/>\nwhile Hoebel defined it as \u201cthe legitimate use of physical coercion by a<br \/>\nsocially authorized agent\u201d\u2074. Comaroff and Roberts have since critiqued these<br \/>\nviews as culturally narrow\u2075.<\/p>\n<p data-end=\"968\" data-start=\"614\" style=\"text-align: justify;\"><strong data-end=\"643\" data-start=\"614\">Functionalist Perspective<\/strong>: Inspired by<br \/>\nMalinowski, this view considers law a system of social control\u2014encompassing<br \/>\nreciprocity, moral pressure, and informal sanctions\u2076. Critics like Redfield and<br \/>\nS. Moore argued that this broad interpretation risks including non-legal norms<br \/>\nlike gossip and ostracism\u2077.
