Garcia faces human smuggling charges in federal court in Tennessee. Garcia <\/span><span data-preserver-spaces=\"true\">was charged<\/span><span data-preserver-spaces=\"true\"> with \u201c<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.legalmatch.com\/law-library\/article\/criminal-conspiracy-lawyers.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">conspiracy<\/span><\/a><span data-preserver-spaces=\"true\"> to unlawfully transport illegal aliens for financial gain\u201d and \u201cunlawful transportation of illegal aliens for financial gain.\u201d The Trump administration had agreed to\u00a0pay El Salvador $6 million\u00a0to imprison about 300 people for a year.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Abrego Garcia was on his way home from a job in <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.legalmatch.com\/find\/md\/baltimore-lawyers.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">Baltimore<\/span><\/a><span data-preserver-spaces=\"true\"> with his child in the car when he <\/span><span data-preserver-spaces=\"true\">was pulled over<\/span><span data-preserver-spaces=\"true\"> on March 12. He <\/span><span data-preserver-spaces=\"true\">was detained<\/span><span data-preserver-spaces=\"true\"> in several different facilities. A federal judge in Maryland ordered the government to facilitate Garcia\u2019s return to the US. In April 2025, the Supreme Court upheld the order to have Garcia returned to the United States. <\/span><span data-preserver-spaces=\"true\">The administration resisted and delayed <\/span><span data-preserver-spaces=\"true\">by<\/span><span data-preserver-spaces=\"true\"> several months until a lower federal court in Maryland authorized Garcia\u2019s lawyers to seek sanctions against the federal government for their failure to return Garcia <\/span><span data-preserver-spaces=\"true\">back<\/span><span data-preserver-spaces=\"true\"> to the states.<\/span><img loading=\"lazy\" decoding=\"async\" class=\"attachment-266x266 size-266x266 alignright\" src=\"https:\/\/lawblog.legalmatch.com\/wp-content\/uploads\/2025\/06\/Untitled-design-10-2.png\" sizes=\"auto, (max-width: 266px) 100vw, 266px\" srcset=\"https:\/\/lawblog.legalmatch.com\/wp-content\/uploads\/2025\/06\/Untitled-design-10-2.png 1920w, https:\/\/lawblog.legalmatch.com\/wp-content\/uploads\/2025\/06\/Untitled-design-10-2-300x169.png 300w, https:\/\/lawblog.legalmatch.com\/wp-content\/uploads\/2025\/06\/Untitled-design-10-2-1024x576.png 1024w, https:\/\/lawblog.legalmatch.com\/wp-content\/uploads\/2025\/06\/Untitled-design-10-2-768x432.png 768w, https:\/\/lawblog.legalmatch.com\/wp-content\/uploads\/2025\/06\/Untitled-design-10-2-1536x864.png 1536w\" alt=\"Law Statue\" width=\"266\" height=\"150\"\/><\/p>\n<p><span data-preserver-spaces=\"true\">Garcia\u2019s lawyers have renewed their request for sanctions in Maryland. <\/span><span data-preserver-spaces=\"true\">Garcia\u2019s attorneys contend that their client\u2019s return to the United States reveals that the government always <\/span><span data-preserver-spaces=\"true\">had the ability to<\/span><span data-preserver-spaces=\"true\"> return him but <\/span><span data-preserver-spaces=\"true\">simply<\/span><span data-preserver-spaces=\"true\"> refused.<\/span><span data-preserver-spaces=\"true\"> His return is evidence of a \u201cdetermined stalling campaign to stave off contempt sanctions long enough to concoct a politically face-saving exit from its <\/span><span data-preserver-spaces=\"true\">own<\/span><span data-preserver-spaces=\"true\"> predicament.\u201d <\/span><\/p>\n<h3>Lawyers are Necessary to Exclude Inadmissible Evidence<\/h3>\n<p><span data-preserver-spaces=\"true\">If a party ignores a court order for several months, they <\/span><span data-preserver-spaces=\"true\">would<\/span><span data-preserver-spaces=\"true\"> most likely be held in contempt and<\/span><span data-preserver-spaces=\"true\">punished with<\/span><span data-preserver-spaces=\"true\"> sanctions, including monetary fines or jail time.<\/span><span data-preserver-spaces=\"true\"> Moreover, the sanctions can extend beyond money. Courts have the power to enter evidentiary or issue sanctions, which bar <\/span><span data-preserver-spaces=\"true\">certain<\/span><span data-preserver-spaces=\"true\"> evidence or issues from being admissible at trial. For instance, the trial court could <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.legalmatch.com\/law-library\/article\/suppression-of-evidence.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">exclude any evidence<\/span><\/a><span data-preserver-spaces=\"true\"> that <\/span><span data-preserver-spaces=\"true\">had been illegally obtained<\/span><span data-preserver-spaces=\"true\">. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Suppression of evidence is a standard pretrial proceeding <\/span><span data-preserver-spaces=\"true\">that occurs<\/span><span data-preserver-spaces=\"true\"> in a criminal case where a decision <\/span><span data-preserver-spaces=\"true\">is made<\/span> <span data-preserver-spaces=\"true\">as to<\/span><span data-preserver-spaces=\"true\"> whether <\/span><span data-preserver-spaces=\"true\">certain<\/span><span data-preserver-spaces=\"true\"> evidence may be introduced<\/span> <span data-preserver-spaces=\"true\">in a<\/span><span data-preserver-spaces=\"true\"> trial.<\/span><span data-preserver-spaces=\"true\"> The introduction or exclusion of <\/span><span data-preserver-spaces=\"true\">certain<\/span><span data-preserver-spaces=\"true\"> evidence can make or break a case. However, suppression of evidence can also <\/span><span data-preserver-spaces=\"true\">be used<\/span><span data-preserver-spaces=\"true\"> to sanction a party for wrongdoing. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Suppression of evidence may either be lawful or unlawful. Criminal prosecutors who intentionally hide or withhold evidence from the defendant\u00a0engage in <\/span><span data-preserver-spaces=\"true\">unlawful<\/span><span data-preserver-spaces=\"true\"> suppression of evidence. If prosecutors fail <\/span><span data-preserver-spaces=\"true\">to <\/span><span data-preserver-spaces=\"true\">properly<\/span><span data-preserver-spaces=\"true\"> disclose evidence<\/span><span data-preserver-spaces=\"true\">, <\/span><span data-preserver-spaces=\"true\">that evidence cannot then be used<\/span><span data-preserver-spaces=\"true\"> at trial.\u00a0<\/span><span data-preserver-spaces=\"true\">If the breach is egregious enough, a defendant can have<\/span><span data-preserver-spaces=\"true\"> a <\/span><span data-preserver-spaces=\"true\">case dismissed entirely, as with <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/lawblog.legalmatch.com\/2025\/02\/14\/dramatic-trials-are-not-a-basis-for-alec-baldwin-to-sue-for-malicious-prosecution-after-rust-trial-dismissal\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">Alec Baldwin<\/span><\/a><span data-preserver-spaces=\"true\"> after the Rust trial.<\/span><\/p>\n<h3>Grand Jury Indictments are Not Evidence of Guilt<\/h3>\n<p><span data-preserver-spaces=\"true\">Everyone is entitled to a presumption of innocence until a jury convicts them or they plead guilty. The fact that Garcia <\/span><span data-preserver-spaces=\"true\">was held<\/span><span data-preserver-spaces=\"true\"> in El Salvador for several months does not make him guilty of human trafficking. Nor does a grand jury indictment make Garcia or anyone else guilty of a crime. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Grand juries are a jury empowered to determine whether <\/span><span data-preserver-spaces=\"true\">criminal charges should be brought<\/span><span data-preserver-spaces=\"true\">. A grand jury is separate from a trial court, which <\/span><span data-preserver-spaces=\"true\">do<\/span><span data-preserver-spaces=\"true\"> not preside over a grand jury\u2019s functioning. Additionally, only prosecutors are allowed to present to a grand jury. The defendant is not represented before a grand jury, as there are no defendants <\/span><span data-preserver-spaces=\"true\">prior to<\/span><span data-preserver-spaces=\"true\"> a grand jury issuing an indictment.
