Nallammal<\/em> v. <em>State<\/em>, [Criminal Appeal No. 2489 of 2025].<\/p>\n<p class=\"has-text-align-justify\">Our disagreement is on culpability of <em>P. Nallammal<\/em>, Wife of since deceased <em>A.M Paramasivam<\/em>. There is no doubt, mere registration of \u2018disproportionate assets\u2019 in name of a Public Servant\u2019s Relative or Friend does not make such person guilty of abetment of offence of Section 13(1)(e) of The Prevention of Corruption Act, 1988. Where there is abetment by a Close Relative in corruption matters, such as a Spouse as in present case, culpability of such a Relative has to be tested by surrounding circumstances and his\/her overall conduct.<\/p>\n<p class=\"has-text-align-justify\">It is very hard to believe <em>P. Nallammal<\/em> was not aware, assets which were in her name were not acquired from <em>A.M Paramasivam\u2019s<\/em> \u2018legitimate sources of income\u2019. It was never <em>P. Nallammal\u2019s<\/em> case, she was not aware <em>A.M Paramasivam<\/em> had been purchasing properties in her name by using funds gained from \u2018illegitimate sources\u2019. <em>P. Nallammal<\/em> intentionally aided <em>A.M Paramasivam<\/em> in accumulation of \u2018disproportionate assets\u2019.<\/p>\n<p class=\"has-text-align-justify\"><span style=\"text-decoration: underline\">I make it clear, my delivery has taken more time than usual. But then, I was handed over <em>Justice Ahsanuddin Amanullah\u2019s<\/em> opinion only a fortnight back.<\/span><\/p>\n<p class=\"has-text-align-justify\">\u2013 <strong>Hon\u2019ble Justice Sudhanshu Dhulia<\/strong>, <em>P.
