In their response brief, the school districts and unions\u00a0<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A1203\/363206\/20250613160402446_McMahon%20v.%20State%20of%20New%20York_Opp%20of%20Somerville.pdf\">told the justices<\/a>\u00a0that the order by U.S. District Judge Myong Joun \u201cis not superintending the Department\u2019s operations; the court is simply preserving the status quo to permit orderly adjudication.\u201d\u00a0<\/p>\n<p><span id=\"more-529278\"\/><\/p>\n<p>\u201cIf the dismantling of the Department is allowed to go forward now,\u201d the school districts and unions wrote, and the plaintiffs eventually obtain a final ruling in their favor, \u201cit will be effectively impossible to undo much of the damage caused.\u201d By contrast, if the government wins, \u201cit will be able to put its plans into operation merely slightly later than otherwise.\u201d\u00a0<\/p>\n<p>Secretary of Education Linda McMahon announced the RIF, which would affect nearly half of the department\u2019s workforce,\u00a0<a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/us-department-of-education-initiates-reduction-force\">in a press release<\/a>\u00a0on March 11. The RIF, she said, \u201creflects the Department of Education\u2019s commitment to efficiency, accountability, and ensuring that resources are directed where they matter most: to students, parents, and teachers.\u201d\u00a0<\/p>\n<p>Nine days later, President Donald Trump\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/03\/25\/2025-05213\/improving-education-outcomes-by-empowering-parents-states-and-communities\">issued an executive order<\/a>\u00a0that instructed McMahon to \u201ctake all necessary steps to facilitate the closure of the Department of Education and return authority over education to the States and local communities.\u201d\u00a0<\/p>\n<p>A group of 19 states, led by New York, along with the District of Columbia, two public school districts and several teachers\u2019 unions, filed two different lawsuits (which were later combined) in federal court, seeking to block the department from moving forward with the RIF. They contended that the mass firings violated both the Constitution and the federal laws governing administrative agencies.\u00a0<\/p>\n<p>On May 22, Joun ordered the department to reverse the RIF and reinstate the employees who had already been fired. He also barred the department from transferring its student loan and special needs programs to other agencies within the government. Joun concluded that the Trump administration\u2019s \u201ctrue intention is to effectively dismantle the Department\u201d even though there is no law giving it the power to do so.\u00a0<\/p>\n<p>After the U.S. Court of Appeals for the 1st Circuit declined to put Joun\u2019s order on hold while the government appealed, U.S. Solicitor General D. John Sauer came to the Supreme Court. He told the justices\u00a0<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A1203\/362486\/20250606104613590_McMahon%20Stay%20Application.pdf\">in a filing on June 6<\/a>\u00a0that the \u201cRIF effectuates the Administration\u2019s policy of streamlining the Department and eliminating discretionary functions that, in the Administration\u2019s view, are better left to the States.\u201d\u00a0<\/p>\n<p>The states emphasized in their filings on Friday that the Trump administration \u201cbarely attempt[s] to argue that their actions are lawful.\u201d Rather,\u00a0<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A1203\/363201\/20250613155147555_24A1203_State%20Plaintiffs%20Opp%20to%20Stay-pdfa.pdf\">the states wrote<\/a>, the administration contends that Joun\u2019s order should be put on hold even if, as the challengers have shown, \u201cthe RIF has decimated the Department, rendering it unable to perform its statutory functions.\u201d\u00a0<\/p>\n<p>The Trump administration raises a variety of other arguments instead \u2013 for example, that the challengers lack a legal right to sue, known as standing. But Joun made \u201cdetailed factual findings,\u201d the challengers say, that \u201ccatalog numerous other harms to the States\u201d giving them standing.\u00a0<\/p>\n<p>Nor does Joun\u2019s order require the department to bring back all of the fired employees, the challengers said.
