\/>\n<\/p>\n<div id=\"\">&#13;<\/p>\n<p>On May 28, the U.S. Court of International Trade (\u201cCIT\u201d) blocked President Trump\u2019s tariffs enacted under the International Emergency Economic Powers Act (\u201cIEEPA\u201d).<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a>\u00a0 The CIT held that the IEEPA does not authorize presidential tariffs for trafficking or for worldwide\/retaliatory purposes.<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a>\u00a0 A day later, the U.S. District Court for the District of Columbia issued a preliminary injunction staying the same tariffs on the same grounds.<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a><\/p>\n<p>In response to the adverse CIT ruling, the Trump administration filed an appeal with the U.S. Court of Appeals for the Federal Circuit.\u00a0 The Federal Circuit, which reviews CIT rulings on appeal, granted an immediate injunction preventing the ruling from taking effect while the case proceeds through the appellate process.\u00a0 However, if the CIT\u2019s decision is affirmed, it would eliminate the tariffs imposed on April 2, 2025 as part of the Trump administration\u2019s \u201cLiberation Day\u201d trade initiative.<\/p>\n<p>While the appeal is being decided, this post will explain the specialized role and jurisdiction of the CIT, which many readers may not be familiar with.\u00a0<\/p>\n<figure class=\"wp-block-image size-large is-resized\"><img fetchpriority=\"high\" decoding=\"async\" width=\"580\" height=\"430\" as a federal court with exclusive jurisdiction over the nation\u2019s international trade disputes.\u00a0 Seated in New York City, the CIT functions with the same legal authority as a U.S. district court but focuses exclusively on international trade matters.\u00a0 The court\u2019s jurisdiction extends to any civil action brought against the United States, its officers, or agencies involving international trade law.<a href=\"#_ftn4\" id=\"_ftnref4\">[4]<\/a>\u00a0 This broad mandate includes cases arising from:<\/p>\n<ul class=\"wp-block-list\">\n<li>U.S. Customs and Border Protection decisions regarding import disputes<\/li>\n<li>Antidumping and Countervailing Duties determinations<a id=\"_ftnref5\" href=\"#_ftn5\">[5]<\/a><\/li>\n<li>U.S. government actions to recover import-related penalties<\/li>\n<\/ul>\n<p>The CIT\u2019s evolution reflects the increasing complexity of international trade in the United States.\u00a0 Originally established as the Board of General Appraisers in 1890, it became the U.S. Customs Court in 1926 before taking its current form in 1980 under the Customs Courts Act.\u00a0 This legislation aimed to provide the international trade community, domestic interests, consumer groups, labor organizations, and concerned citizens with an improved judicial forum for reviewing government import-related actions.<a href=\"#_ftn6\" id=\"_ftnref6\">[6]<\/a><\/p>\n<p>The CIT is composed of nine life-tenured judges, appointed by the president and confirmed by the Senate.\u00a0 Importantly, no more than five judges may belong to the same political party, with a goal of ensuring balanced representation in international trade dispute adjudication.<a href=\"#_ftn7\" id=\"_ftnref7\">[7]<\/a>\u00a0 The case that struck down President Trump\u2019s IEEPA tariffs was decided by a three-judge panel, appointed by Presidents Reagan, Obama, and Trump.<a href=\"#_ftn8\" id=\"_ftnref8\">[8]<\/a><\/p>\n<p>The CIT\u2019s chief judge typically assigns cases to a single judge, unless a case involves the constitutionality of a congressional act, presidential proclamation, executive order, or an issue with significant implications for customs laws.\u00a0 In such cases, the chief judge may assign a three-judge panel, as here.<a href=\"#_ftn9\" id=\"_ftnref9\">[9]<\/a><\/p>\n<p>The Federal Circuit\u2019s eventual decision will likely establish important precedent for future presidential trade actions.\u00a0 If the CIT\u2019s interpretation of IEEPA is upheld, it could constrain how presidents utilize emergency powers to achieve trade policy objectives.<\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<p><a href=\"#_ftnref1\" id=\"_ftn1\">[1]<\/a> The International Emergency Economic Powers Act (IEEPA) provides the president authority in some circumstances to regulate a variety of economic transactions following a declaration of national emergency.\u00a0 President Trump declared a national emergency under the IEEPA on April 2, 2025 as part of his administration\u2019s \u201cLiberation Day\u201d trade initiative.\u00a0 <em>See <\/em>50 U.S.C. \u00a7 1702; <em>see generally <\/em><a
