She granted preliminary approval to their original agreement in <a href=\"https:\/\/www.housingwire.com\/articles\/judge-approves-mls-pin-settlement-in-nosalek-suit\/\" target=\"_blank\" rel=\"noreferrer noopener\">September 2023<\/a> only to have the <a href=\"https:\/\/www.housingwire.com\/tag\/department-of-justice\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Department of Justice <\/strong><\/a>(DOJ) file an amicus brief just weeks later stating that it had \u201c<a href=\"https:\/\/www.housingwire.com\/articles\/the-doj-intervenes-in-nosalek-buyer-broker-commission-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">significant concerns<\/a>\u201d about the settlement.<\/p>\n<p>Unlike other <a href=\"https:\/\/www.housingwire.com\/commission-lawsuits\/\" target=\"_blank\" rel=\"noreferrer noopener\">commission lawsuit<\/a> settlement agreements \u2014 like the one negotiated by the <a href=\"https:\/\/www.housingwire.com\/tag\/national-association-of-realtors\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>National Association of Realtors<\/strong> (<\/a>NAR) i<a href=\"https:\/\/www.housingwire.com\/articles\/nar-settles-commission-lawsuits-for-418-million\/\" target=\"_blank\" rel=\"noreferrer noopener\">n the Sitzer\/Burnett suit<\/a> \u2014 MLS PIN\u2019s original settlement did not ban <a href=\"https:\/\/www.housingwire.com\/articles\/the-cooperative-compensation-debate-rages-on\/\" target=\"_blank\" rel=\"noreferrer noopener\">offers of buyer broker compensation<\/a> from the platform. <\/p>\n<p>In later filings in the Nosalek suit, the DOJ argued that it did not want upfront offers of buyer broker compensation <a href=\"https:\/\/www.housingwire.com\/articles\/doj-offers-of-agent-compensation-should-not-be-made-anywhere\/\" target=\"_blank\" rel=\"noreferrer noopener\">displayed or shared anywhere<\/a>.\u00a0<\/p>\n<p>MLS PIN and the Nosalek plaintiffs have spent the past 20 months going back and forth over the settlement. This all changed last last month when the DOJ notified the court that it had \u00a0<a href=\"https:\/\/www.housingwire.com\/articles\/doj-withdraws-objection-mls-pin-nosalek-commission-suit-settlement\/\" target=\"_blank\" rel=\"noreferrer noopener\">officially withdrawn<\/a> its objections to the settlement.\u00a0<\/p>\n<p>The DOJ <a href=\"https:\/\/www.housingwire.com\/articles\/doj-nosalek-commission-lawsuit-mls-pin-real-estate-buyer-broker-compensation\/\">changed its tune<\/a> after MLS PIN agreed to remove upfront offers of buyer broker compensation from the site, bringing its settlement in line with NAR\u2019s settlement. Additionally, MLS PIN has agreed to pay $3.95 million, the same amount it would have paid had it bought into NAR\u2019s settlement.\u00a0<\/p>\n<p>During Tuesday\u2019s hearing, Saris expressed her skepticism that the settlement would ever reach this stage.\u00a0<\/p>\n<p>\u201cI wasn\u2019t sure I was going to approve it at the end. I\u2019ve received, as I think I put on the docket, several objections, so we may get objections even at the end,\u201d she said. \u201cI\u2019m not sure if this fixed it or not, but I did put them on the docket, the concerns.\u201d<\/p>\n<p>A final approval hearing for the settlement has been set for Sept. 29.<\/p>\n<\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>This is not the first time Saris has granted preliminary approval to a settlement between the two parties.
