EPA<\/em>, the Supreme Court ruled that an agency action qualifies as arbitrary or capricious if it is not \u201creasonable and reasonably explained\u201d.<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> The decision was 5-4, with Justice Gorsuch writing for the majority and Justice Barrett writing the dissent. In the dissent, Justice Barrett explained that the Court did not conclude that the EPA\u2019s actions were substantively unreasonable. Rather, the primary basis for the Court\u2019s decision is the argument that EPA failed to provide a \u201csatisfactory explanation for its action\u201d and a \u201creasoned response\u201d to comments. Justice Barrett noted that the Court should, as it has most often done in the past, \u201cuphold a decision of less than ideal clarity if the agency\u2019s path may reasonably be discerned.\u201d<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a> Thus, under Justice Barrett\u2019s view, a reasonable result can save a poorly-explained decision from an Administrative Procedure Act challenge; Justice Gorsuch and the majority rejected this conclusion.<\/p>\n<p>Likewise, a day prior to the Supreme Court\u2019s ruling in <em>Ohio v. EPA<\/em>, the Fifth Circuit issued its opinion in <em>National Association of Manufacturers v. SEC<\/em> and held that the SEC had acted arbitrarily and capriciously in two ways: 1) the agency failed to adequately explain its decision to disregard its prior factual finding; and 2) the agency failed to provide a reasonable explanation regarding the significance of certain risks at issue in the matter.<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a> The panel\u2019s criticism focused on the agency\u2019s rationale and its decision-making process, rather than the final resulting rule.<\/p>\n<p>In each of the decisions, the courts cite <em>FCC v. Prometheus Radio Project<\/em>,<a href=\"#_ftn4\" id=\"_ftnref4\">[4]<\/a> which had reformulated the arbitrary and capricious inquiry. In that case the Supreme Court ruled that \u201c[a] court simply ensures that the agency has acted within a zone of reasonableness, and in particular, has reasonably considered the relevant issues and reasonably explained the decision.\u201d<a href=\"#_ftn5\" id=\"_ftnref5\">[5]<\/a> Per this language, the agency\u2019s decision-making process, along with its final determination, will be scrutinized by the courts if a rulemaking is challenged.<\/p>\n<p>Thus, it appears the \u201czone of reasonableness\u201d test has usurped previous iterations of the arbitrary and capricious analysis. Combined with the overturning of <em>Chevron <\/em>deference also announced by the Court last year,<a href=\"#_ftn6\" id=\"_ftnref6\">[6]<\/a> the likely overall effect of this new precedent will be greater scrutiny over agency action and a more restricted scope for permissible agency action.<\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n<p><a href=\"#_ftnref1\" id=\"_ftn1\">[1]<\/a> <em>Ohio v. Env\u2019t Prot. Agency<\/em>, 603 U.S. 279, 292 (2024) (quoting <em>FCC v. Prometheus Radio Project<\/em>, 592 U.S. 414, 423 (2021)).<\/p>\n<p><a href=\"#_ftnref2\" id=\"_ftn2\">[2]<\/a> <em>Id. <\/em>at 311 (Barrett, J., dissenting) (quoting <em>Motor Vehicle Mfrs. Ass&#8217;n of U.S., Inc. v. State Farm Mut. Auto. Ins. Co.<\/em>, 463 U.S. 29, 43 (1983)).<\/p>\n<p><a href=\"#_ftnref3\" id=\"_ftn3\">[3]<\/a> <em>Nat\u2019l Ass\u2019n of Manufacturers v.
