The same day, <\/span><a href=\"https:\/\/diaztradelaw.com\/tariffs-and-trade-deals\/\"><span style=\"font-weight: 400;\">CBP published guidance<\/span><\/a><span style=\"font-weight: 400;\"> implementing the increase. All imports of steel and aluminum and their derivative products from all countries (except those from the UK) are subject to the 50% Section 232 Tariffs effective June 4, 2025.<\/span><\/li>\n<\/ul>\n<p><b>Customs and Border Protection (CBP)\u00a0\u00a0<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">New HQ <\/span><a href=\"https:\/\/rulings.cbp.gov\/ruling\/H317599\"><span style=\"font-weight: 400;\">ruling<\/span><\/a><span style=\"font-weight: 400;\">: CBP ruled that an importer is liable for duties on merchandise that it sought to import, despite arguing that it didn\u2019t consent to having its broker designate it as an importer of record.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">CBP <\/span><a href=\"https:\/\/www.cbp.gov\/newsroom\/national-media-release\/cbp-issues-withhold-release-order-zhen-fa-7\"><span style=\"font-weight: 400;\">issued a WRO<\/span><\/a><span style=\"font-weight: 400;\"> against Zhen Fa 7 based on information that reasonably indicates the use of forced labor. Effective May 28, 2025, CBP personnel at all U.S. ports of entry will detain seafood, including but not limited to squid, harvested by Zhen Fa 7.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">CBP\u2019s Commercial Customs Operations Advisory Committee (COAC) will be holding its <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/06\/05\/2025-10227\/commercial-customs-operations-advisory-committee\"><span style=\"font-weight: 400;\">quarterly meeting<\/span><\/a><span style=\"font-weight: 400;\"> on June 18, virtually, from Washington, D.C.<\/span><\/li>\n<\/ul>\n<p><b>Department of Commerce\u00a0<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Commerce Secretary Howard Lutnik <\/span><a href=\"https:\/\/www.appropriations.senate.gov\/hearings\/a-review-of-the-presidents-fiscal-year-2026-budget-request-for-the-department-of-commerce\"><span style=\"font-weight: 400;\">testified<\/span><\/a><span style=\"font-weight: 400;\"> before the Senate Appropriations Committee. Topics of discussion included trade deals, reciprocal tariffs, and trade barriers.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Commerce published a <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/06\/04\/2025-10158\/determining-and-applying-unaffiliated-reseller-assessment-rates-modification-or-removal-of\"><span style=\"font-weight: 400;\">Federal Register Notice<\/span><\/a><span style=\"font-weight: 400;\"> seeking comment on its proposals to revise the current policy of assessing entries of unaffiliated resellers at the all-others antidumping duty rate and to eliminate expedited countervailing duty reviews. Comments are due by July 7.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A new antidumping and countervailing duty action has been filed against Steel Concrete Reinforcing Bar imported from Algeria, Bulgaria, Egypt, and Vietnam. The subject merchandise covered by this petition is steel concrete reinforcing bar, which is widely used for nonresidential and infrastructure construction.<\/span><\/li>\n<\/ul>\n<p><b>United States Trade Representative (USTR)<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">USTR <\/span><a href=\"https:\/\/ustr.gov\/about\/policy-offices\/press-office\/press-releases\/2025\/may\/ustr-extends-certain-exclusions-china-section-301-tariffs\"><span style=\"font-weight: 400;\">announced<\/span><\/a><span style=\"font-weight: 400;\"> the extension of exclusions in the Section 301 Investigation of China\u2019s Acts, Policies, and Practices Related to Technology Transfer, Intellectual Property, and Innovation. The exclusions were previously scheduled to expire on May 31 but have now been extended to Aug. 31.<\/span><\/li>\n<\/ul>\n<p><b>U.S. Food and Drug Administration (FDA)<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The FDA <\/span><a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-launches-agency-wide-ai-tool-optimize-performance-american-people\"><span style=\"font-weight: 400;\">launched<\/span><\/a><span style=\"font-weight: 400;\"> Elsa, a generative AI tool designed to help employees work more efficiently.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The FDA issued draft <\/span><a href=\"https:\/\/www.fda.gov\/regulatory-information\/search-fda-guidance-documents\/replacing-color-additives-approved-or-marketed-drug-products?utm_medium=email&amp;utm_source=govdelivery\"><span style=\"font-weight: 400;\">guidance<\/span><\/a><span style=\"font-weight: 400;\"> providing drug manufacturers with recommendations on replacing color additives in drugs.<\/span><\/li>\n<\/ul>\n<p><b>Federal Maritime Commission (FMC)<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A FMC judge <\/span><a href=\"https:\/\/www2.fmc.gov\/readingroom\/docs\/23-01\/(148)%2023-01%20Initial%20Decision.pdf\/\"><span style=\"font-weight: 400;\">ordered<\/span><\/a><span style=\"font-weight: 400;\"> ocean carrier SM Line Corp. to pay consumer goods company Samsung Electronics $1.9 million in reparations for unfair demurrage and detention fees.<\/span><\/li>\n<\/ul>\n<p><b>Congress\u00a0<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The nonpartisan Congressional Budget Office (CBO) <\/span><a href=\"https:\/\/www.cbo.gov\/system\/files\/2025-06\/61389-Tariff-Effects.pdf\"><span style=\"font-weight: 400;\">estimates<\/span><\/a><span style=\"font-weight: 400;\"> that there would be $2.5 trillion collected in tariffs in the next 10 years if the global 10% reciprocal tariff remained, de minimis was still curtailed, and tariffs on most Chinese products and some Mexican and Canadian products, as well as 25% tariffs on the auto sector, steel and aluminum, continue during that period.\u00a0<\/span><\/li>\n<\/ul>\n<p><b>Industry News\u00a0<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The U.S. trade deficit in goods and services <\/span><a href=\"https:\/\/www.bea.gov\/news\/2025\/us-international-trade-goods-and-services-april-2025\"><span style=\"font-weight: 400;\">narrowed significantly<\/span><\/a><span style=\"font-weight: 400;\"> in April, falling to $61.6 billion compared with $138.3 billion in March.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The U.S. District Court for the Northern District of California <\/span><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.448087\/gov.uscourts.cand.448087.62.0.pdf\"><span style=\"font-weight: 400;\">ruled<\/span><\/a><span style=\"font-weight: 400;\"> that the Court of International Trade (CIT) has exclusive jurisdiction to hear California\u2019s challenge to all tariff action taken under IEEPA. The judge dismissed the case rather than transfer it to CIT, allowing the state to appeal the decision to the U.S. Court of Appeals for the 9th Circuit.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The District Court for the District of Columbia <\/span><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.279804\/gov.uscourts.dcd.279804.42.0_2.pdf\"><span style=\"font-weight: 400;\">stayed<\/span><\/a><span style=\"font-weight: 400;\"> its decision, finding that IEEPA doesn\u2019t confer tariff-setting authority and declaring that all tariff action taken under IEEPA is illegal. The judge suspended his preliminary injunction on the collection of tariffs from the plaintiffs. The ruling is stayed pending the government\u2019s appeal of the decision to the U.S. Court of Appeals for the D.C. Circuit.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Importer FCMT <\/span><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cit.15680\/gov.uscourts.cit.15680.16.0.pdf\"><span style=\"font-weight: 400;\">filed<\/span><\/a><span style=\"font-weight: 400;\"> three complaints at the CIT challenging CBP\u2019s appraisement of its apparel entries.
