Occasionally, the designers of the intersection are also blamed, <\/span><span data-preserver-spaces=\"true\">but<\/span><span data-preserver-spaces=\"true\"> proving that roads are a design flaw can be an uphill challenge. However, a new lawsuit seeks to use disability laws to promote pedestrian safety.\u00a0 \u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Mary Spitzer, 81 years old, was crossing the street in her electric scooter in <\/span><span data-preserver-spaces=\"true\">downtown<\/span><span data-preserver-spaces=\"true\"> DC when a truck missed a <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.legalmatch.com\/law-library\/article\/how-to-handle-a-traffic-stop.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">stop sign<\/span><\/a><span data-preserver-spaces=\"true\"> and struck her. <\/span><span data-preserver-spaces=\"true\">Spitzer was taken<\/span><span data-preserver-spaces=\"true\"> to Ascension Sacred Heart Bay Hospital, where she passed away. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Spitzer lived in a tower that served as a home to seniors and disabled residents. Elderly residents can often <\/span><span data-preserver-spaces=\"true\">be seen<\/span><span data-preserver-spaces=\"true\"> scooting around that portion of downtown. Neighbors contend that the intersection was known to be dangerous, including by Spitzer herself. <\/span><span data-preserver-spaces=\"true\">The neighbors have organized a protest <\/span><span data-preserver-spaces=\"true\">and argue<\/span><span data-preserver-spaces=\"true\"> that the stop signs <\/span><span data-preserver-spaces=\"true\">of<\/span><span data-preserver-spaces=\"true\"> the four-way stop are <\/span><span data-preserver-spaces=\"true\">hidden<\/span><span data-preserver-spaces=\"true\"> by trees or light poles.<\/span><span data-preserver-spaces=\"true\"> Two months earlier, 53-year-old Donna Santiago <\/span><span data-preserver-spaces=\"true\">was also killed<\/span><span data-preserver-spaces=\"true\"> after being struck by a car.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"attachment-266x266 size-266x266 alignright\" src=\"https:\/\/lawblog.legalmatch.com\/wp-content\/uploads\/2025\/06\/Untitled-design-10.png\" sizes=\"auto, (max-width: 266px) 100vw, 266px\" srcset=\"https:\/\/lawblog.legalmatch.com\/wp-content\/uploads\/2025\/06\/Untitled-design-10.png 1920w, https:\/\/lawblog.legalmatch.com\/wp-content\/uploads\/2025\/06\/Untitled-design-10-300x169.png 300w, https:\/\/lawblog.legalmatch.com\/wp-content\/uploads\/2025\/06\/Untitled-design-10-1024x576.png 1024w, https:\/\/lawblog.legalmatch.com\/wp-content\/uploads\/2025\/06\/Untitled-design-10-768x432.png 768w, https:\/\/lawblog.legalmatch.com\/wp-content\/uploads\/2025\/06\/Untitled-design-10-1536x864.png 1536w\" alt=\"Photo of a crosswalk.\" width=\"266\" height=\"150\"\/><\/p>\n<p><span data-preserver-spaces=\"true\">In May 2025, the DC Council of the Blind and five individual plaintiffs filed a class action against the District of Columbia. The lawsuit alleges that systemic barriers prevent blind and <\/span><span data-preserver-spaces=\"true\">low vision<\/span><span data-preserver-spaces=\"true\"> pedestrians from safely crossing the <\/span><span data-preserver-spaces=\"true\">vast majority of signalized intersections in the city. Although the District had installed visual pedestrian signals at about 1,600 intersections to ensure pedestrian safety, only a fraction of those intersections have devices with audio or tactile cues for the visually impaired. Intersections that <\/span><span data-preserver-spaces=\"true\">are equipped<\/span><span data-preserver-spaces=\"true\"> with such signals allegedly have installation or maintenance issues.<\/span><\/p>\n<h3>Disability Law Requirements<\/h3>\n<p><span data-preserver-spaces=\"true\">Most <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.legalmatch.com\/law-library\/article\/workplace-discrimination.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">discrimination laws<\/span><\/a> <span data-preserver-spaces=\"true\">forbid<\/span><span data-preserver-spaces=\"true\"> employers or businesses from taking <\/span><span data-preserver-spaces=\"true\">an action<\/span><span data-preserver-spaces=\"true\"> that <\/span><span data-preserver-spaces=\"true\">results<\/span><span data-preserver-spaces=\"true\"> in illegal discrimination against a person.<\/span> <span data-preserver-spaces=\"true\">Laws against sex or gender discrimination require <\/span><span data-preserver-spaces=\"true\">that<\/span> <span data-preserver-spaces=\"true\">businesses<\/span><span data-preserver-spaces=\"true\"> treat everyone equally, which means providing the same services <\/span><span data-preserver-spaces=\"true\">or<\/span><span data-preserver-spaces=\"true\"> employment benefits to <\/span><span data-preserver-spaces=\"true\">everyone<\/span><span data-preserver-spaces=\"true\"> regardless of their sex or gender.<\/span> <span data-preserver-spaces=\"true\">Laws against racial di<\/span><span data-preserver-spaces=\"true\">scrimination require <\/span><span data-preserver-spaces=\"true\">that<\/span><span data-preserver-spaces=\"true\"> businesses treat everyone equally regardless of race.<\/span> <span data-preserver-spaces=\"true\">In most instances, the company <\/span><span data-preserver-spaces=\"true\">is only forbidden<\/span><span data-preserver-spaces=\"true\"> from taking <\/span><span data-preserver-spaces=\"true\">an<\/span><span data-preserver-spaces=\"true\"> action rather than <\/span><span data-preserver-spaces=\"true\">having<\/span> <span data-preserver-spaces=\"true\">to actively address inequality<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\">\u00a0\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">However, there are subsets of discrimination laws that require businesses <\/span><span data-preserver-spaces=\"true\">to affirmatively provide services under certain conditions<\/span><span data-preserver-spaces=\"true\">. Under the <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.legalmatch.com\/law-library\/article\/ada-in-the-workplace.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-preserver-spaces=\"true\">Americans with Disabilities Act<\/span><\/a><span data-preserver-spaces=\"true\">, <\/span><span data-preserver-spaces=\"true\">businesses<\/span><span data-preserver-spaces=\"true\"> are required to provide reasonable accommodations for <\/span><span data-preserver-spaces=\"true\">disabled customers<\/span><span data-preserver-spaces=\"true\">. An accommodation is reasonable if <\/span><span data-preserver-spaces=\"true\">it can be implemented<\/span><span data-preserver-spaces=\"true\"> without causing undue hardship for the <\/span><span data-preserver-spaces=\"true\">business<\/span><span data-preserver-spaces=\"true\">. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">A \u201creasonable accommodation\u201d does not have to be one specific adjustment. <\/span><span data-preserver-spaces=\"true\">The law encourages businesses and employers to <\/span><span data-preserver-spaces=\"true\">compromise<\/span><span data-preserver-spaces=\"true\"> with <\/span><span data-preserver-spaces=\"true\">those<\/span><span data-preserver-spaces=\"true\"> who are impaired to <\/span><span data-preserver-spaces=\"true\">come up with<\/span><span data-preserver-spaces=\"true\"> a reasonable solution.<\/span><\/p>\n<h3>Failure to Accommodate Does Not Always Result in Injury<\/h3>\n<p><span data-preserver-spaces=\"true\">Cities should ensure that their intersections are safe for everyone. <\/span><span data-preserver-spaces=\"true\">Outfitting 1,600 intersections with audio signals <\/span><span data-preserver-spaces=\"true\">would be somewhat<\/span><span data-preserver-spaces=\"true\"> time-consuming and potentially costly, but saving lives is worth the money.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">However, Spitzer\u2019s death was arguably not caused by the lack of audio signals. The driver who hit her allegedly missed a stop sign.
