Caster, director at <a href=\"https:\/\/www.fennemorelaw.com\/\">Fennemore<\/a>, will discuss the implications of last year\u2019s <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-451_7m58.pdf\">decision<\/a> in Loper Bright Enterprises v. Raimondo during the third annual Western conference. The Supreme Court\u2019s decision in the case overturned the \u201cChevron doctrine,\u201d which said that courts should generally defer to a federal agency\u2019s own interpretation of its rules when a litigant challenges that agency\u2019s interpretation of its own rule.<\/p>\n<p>\u201cUnder Chevron, courts typically deferred to federal agencies\u2019 interpretations of statutes when parties challenged that agency\u2019s action in court,\u201d said Rollins. \u201cNow, courts are no longer required to defer to agency interpretations. Instead, judges will interpret statutes and agencies will not necessarily have the final say in how those statutes are interpreted.\u201d<\/p>\n<p>The session, \u201cAg, Food, and Federal and State Agency Deference in a Post-Chevron World,\u201d will explore the short and long-term implications of the Supreme Court\u2019s decision.<\/p>\n<p>\u201cProducers and agricultural stakeholders across the West will need to understand how\u00a0Loper Bright\u00a0affects judicial scrutiny of the agencies they interact with and the decisions those agencies make,\u201d said Caster. \u201cThe fog is beginning to clear.\u201d<\/p>\n<p>The conference will be held June 19-20 in Reno, Nevada.
