{"id":270101,"date":"2025-06-03T07:40:35","date_gmt":"2025-06-03T07:40:35","guid":{"rendered":"https:\/\/peraltafinancing.com\/agriculture\/endangered-species-act-may-be-redefined-in-post-chevron-environment-national-agricultural-law-center\/"},"modified":"2025-06-03T07:40:35","modified_gmt":"2025-06-03T07:40:35","slug":"endangered-species-act-may-be-redefined-in-post-chevron-environment-national-agricultural-law-center","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=270101","title":{"rendered":"Endangered Species Act may be redefined in post-Chevron environment \u2013 National Agricultural Law Center"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>By Mary Hightower<br \/>U of A System Division of Agriculture<\/p>\n<p>June 2, 2025<\/p>\n<p><strong>Fast facts:<\/strong><\/p>\n<ul>\n<li>FWS says definition \u2018runs contrary to best meaning of \u2018take\u2019<\/li>\n<li>Rollins: Case could be a post-Chevron test<\/li>\n<\/ul>\n<p>FAYETTEVILLE, Ark. \u2014 A proposal to rescind the definition of \u201charm\u201d in the Endangered Species Act has people talking \u2014 to the tune of more than 300,000 public comments.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/04\/17\/2025-06746\/rescinding-the-definition-of-harm-under-the-endangered-species-act\">proposal<\/a>, put forth April 17 by the U.S. Fish and Wildlife Service, had a public comment period that closed May 19. By May 14, there were more than 121,000 comments. When the comment period closed, that number had ballooned to 375,545.<\/p>\n<p>The original law prohibits anyone from \u201ctaking\u201d a protected species. \u201cTake\u201d is defined as \u201cto harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such conduct.\u201d<\/p>\n<p>At issue is how \u201charm\u201d is defined. Since the 1970s, harm has been defined through regulations as \u201can act which actually kills or injures wildlife. Such an act may include significant habitat modification or degradation where it actually kills or injures wildlife by significantly impairing essential behavioral patterns, including breeding, feeding or sheltering.\u201d<\/p>\n<p>The proposal says: \u201cThe existing regulatory definition of \u2018harm,\u2019 which includes habitat modification, runs contrary to the best meaning of the statutory term \u2018take.\u2019 We are undertaking this change to adhere to the single, best meaning of the ESA.\u201d<\/p>\n<p>\u201cThe general concern is that rescinding the definition of harm is going to make enforcing the ESA much harder,\u201d said Brigit Rollins, staff attorney for the National Agricultural Law Center.<\/p>\n<p>\u201cObviously the rest of the \u2018take\u2019 definition is there and it pretty clearly will continue to make hunting, pursuing, killing, and injuring listed species illegal, but without harm being defined to include destruction of habitat, the concern certainly from environmental groups is that it will essentially defang the ESA,\u201d she said.<\/p>\n<p>\u201cThat\u2019s part of why the proposal to fully rescind the harm definition has been so stunning to a lot of people,\u201d Rollins said. \u201cIt would be a massive change in ESA implementation.\u201d<\/p>\n<p><strong>Litigation ahead<br \/><\/strong>Rollins expects lawsuits right out of the box.<\/p>\n<p>\u201cThe second this becomes finalized \u2014 and maybe even before \u2014 we\u2019re going to see litigation,\u201d she said \u201cThere\u2019s probably going to be an immediate injunction and then we\u2019ll be off to the races.\u201d<\/p>\n<p>The action will \u201cpossibly be in the Washington, D.C., Circuit, but solid money is on the Ninth Circuit.\u201d<\/p>\n<p>The Ninth Circuit is comprised of Arizona, California, Idaho, Montana, New Mexico, Nevada and Oregon.<\/p>\n<p><strong>\u2018Chevron doctrine\u2019 test case<br \/><\/strong>Rollins said the proposal may be a significant test of agency reach following last year\u2019s Supreme Court\u00a0<a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-451_7m58.pdf\">decision<\/a>\u00a0on the Chevron doctrine. The June 28 ruling overturned a 40-year-old doctrine which said that courts should generally defer to federal agencies for the rules they make, with the assumption that the agencies are subject matter experts and that the rules are reasonable.<\/p>\n<p>In that case, the high court was explicit that its decision would not undo rulings made while Chevron was the guiding principle.<\/p>\n<p>In its proposal, the U.S. Fish and Wildlife Service pointed to a 1995 case \u2014 Babbitt v. Sweet Home Chapter of Communities for a Great Oregon\u201a in which the Supreme Court upheld FWS regulation under Chevron. FWS however, notes part of Justice Antonin Scalia\u2019s dissenting opinion in that case in which he says most of the definition of \u201charm\u201d indicates a direct action against a particular animal, and not an act or omission \u201cthat indirectly and accidentally cause[s] injury to a population of animals.\u2019\u2019<\/p>\n<p>FWS says \u201cthe ESA itself defines \u2018take,\u2019 and further elaborating on one subcomponent of that definition\u2014 \u2018harm\u2019 \u2014 is unnecessary in light of the comprehensive statutory definition.\u201d<\/p>\n<p>Rollins said, \u201cI think this is also kind of a way of testing the judiciary to see if it is willing to revisit some of these issues.\u201d<\/p>\n<p><strong>Cultural cachet<br \/><\/strong>The\u00a0<a href=\"https:\/\/www.fws.gov\/law\/endangered-species-act\">Endangered Species Act<\/a>\u00a0was passed with overwhelming support by Congress in 1973 and signed into law by President Richard Nixon.
