{"id":269780,"date":"2025-06-03T03:43:00","date_gmt":"2025-06-03T03:43:00","guid":{"rendered":"https:\/\/peraltafinancing.com\/alabama\/new-alabama-vape-law-bans-flavored-e-cigarettes-in-stores\/"},"modified":"2025-06-03T03:43:00","modified_gmt":"2025-06-03T03:43:00","slug":"new-alabama-vape-law-bans-flavored-e-cigarettes-in-stores","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=269780","title":{"rendered":"New Alabama vape law bans flavored e-cigarettes in stores"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p data-start=\"213\" data-end=\"327\"><span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">A sweeping new law set to take effect on June 1 will significantly alter how Alabama retailers sell vape and nicotine products.<\/span> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">The legislation imposes stricter permit requirements and bans the sale of popular flavored e-cigarettes in convenience stores, effectively eliminating a key profit center for many small businesses.<\/span><\/p>\n<p data-start=\"329\" data-end=\"447\"><span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">Passed by the Legislature and signed by Governor Kay Ivey, Act 2025-403 establishes two new retail permits: the ABC Tobacco Permit and the ABC Specialty Retailer of Electronic Nicotine Delivery System Permit.<\/span> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">The ABC Tobacco Permit, with an annual fee of $150, authorizes the sale of traditional tobacco products and certain electronic nicotine delivery systems that have been approved or remain under review by the FDA.<\/span><\/p>\n<p data-start=\"449\" data-end=\"567\"><span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">The more restrictive ABC Specialty Retailer permit, costing $1,000 annually, will be required for stores whose inventory or sales are primarily focused on vape products.<\/span> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">These specialty retailers must limit access to customers aged 21 and older and ensure that all products meet state and federal requirements.<\/span><\/p>\n<p data-start=\"569\" data-end=\"727\"><span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">In addition to the new permitting structure, the law imposes strict limits on what types of vape products can be sold in convenience stores.<\/span> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">Retailers will only be allowed to sell 34 tobacco- and mint-flavored e-cigarette products that have received FDA authorization.<\/span> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">Fruit- and candy-flavored vape products, popular with younger users, will be banned from convenience store shelves and can only be sold in licensed specialty vape shops.<\/span><\/p>\n<p data-start=\"729\" data-end=\"887\"><span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">Rep. Barbara Drummond, D-Mobile, the bill\u2019s sponsor, said the law was driven by concerns about youth vaping and the health risks associated with nicotine use.<\/span> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">\u201cThese products are harming our young people,\u201d Drummond said.<\/span> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">\u201cWe\u2019re not dealing with something that is a healthy product. This product is not a product that we should be inhaling into our lungs.\u201d<\/span><\/p>\n<p data-start=\"889\" data-end=\"1047\"><span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">However, for convenience store owners, the law will remove a significant source of revenue.<\/span> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">Industry groups have warned that alternative nicotine products make up a substantial portion of convenience store sales\u2014often accounting for 20-30 percent of profit margins.<\/span> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">The ban on flavored products and the new permitting requirements are expected to put a strain on small retailers across the state.<\/span><\/p>\n<p data-start=\"1049\" data-end=\"1207\"><span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">The Alabama Alcoholic Beverage Control Board is tasked with enforcing the new regulations.<\/span> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">Violations could result in fines, suspension or the revocation of retail permits.<\/span> <span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\">The law also requires that all vape products sold in Alabama be manufactured in the United States, adding another layer of compliance for retailers.<\/span><\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement.
