Not with Perplexity, or Google \u2014\u00a0and definitely not with OpenAI or Microsoft \u2014 but with Amazon.<\/p>\n<p>The agreement will allow Amazon products, like Alexa speakers, to use summaries and short excerpts from NYT stories and recipes, as well as to incorporate this content in the training of its proprietary AI models.<\/p>\n<div id=\"piano-meter-offer\">\n<p>It\u2019s a sign of the times: even The New York Times, long known for its staunch defense against illegal content scraping and its<a href=\"https:\/\/digiday.com\/media\/openai-the-new-york-times-debate-copyright-infringement-of-ai-tech-companies-in-first-trial-arguments\/\"> high-profile legal battle with OpenAI<\/a>, has signaled that it\u2019s open to an AI licensing deal \u2014 if the terms are right.<\/p>\n<p>The deal, announced by NYT last Thursday, is akin to both Amazon and the publisher openly declaring they too are all-in on the AI race.\u00a0<\/p>\n<p>The New York Times is signaling to other AI tech companies, \u201cWe\u2019re open to being at the table, if you\u2019re willing to come to the table,\u201d one former NYT executive told Digiday on condition of anonymity. \u201cUntil [this] announcement, they\u2019ve been sort of hiding in the shadows. Now they\u2019re saying, \u2018we\u2019re open for business under the right terms and conditions.\u2019\u201d<\/p>\n<p>The same exec said they believe the agreement with Amazon represents a \u201cnew wave\u201d of deals between large digital publishers and AI licensing deals to come. Digiday understands that at least one other publisher cut a licensing deal with Amazon last year, and that more will emerge in the coming months. But Amazon has kept its negotiations with publishers under lock and key.<\/p>\n<p>Amazon\u2019s courting of news publishers for potential AI licensing partnerships to feed quality content into a smarter version of Alexa, Amazon\u2019s voice assistant product, was <a href=\"https:\/\/www.axios.com\/2024\/12\/03\/amazon-news-partners-revamped-ai-alexa-voice-assistant\">first reported<\/a> last December. Alexa currently provides answers to news queries from sources like Reuters, Associated Press and The Wall Street Journal, but not in real time.<\/p>\n<p>But The New York Times\u2019 announcement was vague on whether its content would help power <a href=\"https:\/\/digiday.com\/marketing\/amazon-launches-alexa-and-marketers-want-ads\/\">the new Alexa+<\/a>.<strong> <\/strong>\u201cAmazon\u2019s use of editorial content from The Times could extend to the Alexa software found on its smart speakers,\u201d it read.\u00a0<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-what-enticed-nyt-to-go-with-amazon-nbsp\">What enticed NYT to go with Amazon?\u00a0<\/h2>\n<p>The fact that The New York Times\u2019 content will now be used to train Amazon\u2019s AI models could strengthen its copyright case against OpenAI. It implies that using this content without a deal in place \u201cmay not be a fair use,\u201d according to Aaron Rubin, partner in the Strategic Transactions &amp; Licensing group at law firm Gunderson Dettmer.<strong><em>\u00a0<\/em><\/strong><\/p>\n<p>\u201cIt also further establishes that there\u2019s a market for licensing this content for model training purposes, so any party that trains its model with [The Times\u2019] content without licensing it is undercutting that market,\u201d he said.<\/p>\n<p>The New York Times declined to answer questions about the differences between its differing associations with OpenAI and Amazon, and why it would sign with Amazon and sue OpenAI. Amazon also declined to comment.<\/p>\n<p>Amazon may seem like an unlikely partner for The New York Times\u2019 first AI licensing deal. The New York Times is arguably in a league of its own, with <a href=\"https:\/\/digiday.com\/media\/buzzfeed-news-corp-and-new-york-times-push-back-on-tariff-fears-in-earnings-calls\/\">a large and growing subscription and digital advertising business<\/a>. And Amazon\u2019s large language model Nova isn\u2019t exactly a household name \u2013 at least not as popular as OpenAI\u2019s GPT, Google\u2019s Gemini, Anthropic\u2019s Claude and Meta\u2019s LLama. (Amazon <a href=\"https:\/\/www.geekwire.com\/2025\/amazon-deepens-anthropic-ties-with-equity-conversion-adding-billions-to-q1-profit\/\">has invested $8 billion<\/a> in Anthropic.)\u00a0<\/p>\n<p>Naturally, without further detail being disclosed, it\u2019s hard to say for sure. But Amazon uses its AI models primarily for voice products like Alexa, and for its Amazon shopping assistant Rufus \u2013 not text-based products like Google or OpenAI\u2019s search products, said a publishing exec at a large digital publisher who requested anonymity. Whereas, Google\u2019s AI Mode or ChatGPT \u201care both more likely to cannibalize material traffic,\u201d for The New York Times, they said.<\/p>\n<p>The New York Times has a lawsuit against OpenAI and Microsoft, so a partnership with either of those companies would\u2019ve been quite the one-eighty. Perplexity has been actively pursuing deals with publishers, but for a wider range of publishers, such as its revenue share agreements with Time to Blavity.\u00a0<\/p>\n<p>Google would have made sense as an AI licensing partner for The New York Times, given it\u2019s <a href=\"https:\/\/www.reuters.com\/business\/media-telecom\/new-york-times-get-around-100-million-google-over-three-years-wsj-2023-05-08\/\">already signed large, multi-year deals<\/a> with The New York Times and made an agreement in January with The Associated Press to <a href=\"https:\/\/techcrunch.com\/2025\/01\/15\/google-inks-deal-with-the-associated-press-to-bring-more-real-time-info-to-gemini\/\">bring its news to Google\u2019s Gemini chatbot<\/a>.<\/p>\n<p>The New York Times isn\u2019t the only publisher to offer a carrot in one hand and a stick in the other. News Corp signed a licensing deal with OpenAI in May 2024. Five months later, its Dow Jones and the New York Post businesses filed a lawsuit against Perplexity<\/p>\n<p>In an earnings call in November 2024, News Corp CEO Robert Thomson said the company would \u201cseek to challenge AI companies misusing and abusing our trusted journalism.\u201d<\/p>\n<p>\u201cWe have indicated in the past that we would prefer to woo rather than sue artificial intelligence companies, hence the alliance with OpenAI, but we have reached a point where litigation is also essential,\u201d he continued. \u201cPerplexity\u2026 is selling products based on our journalism, and we are diligently preparing for further action against other companies that have ingested our archives and are synthesizing our intellectual property.\u201d News Corp did not respond to a request for comment before publishing time.<\/p>\n<p>Regardless, The New York Times is no longer in the increasingly short list of large digital publishers that haven\u2019t signed an AI licensing deal yet. Bustle Digital Group, CNN and Bloomberg to name a few.<\/p>\n<p>\u201cI think that the bigger picture is that everyone\u2019s open for business at the right price.
