{"id":263460,"date":"2025-05-30T04:40:57","date_gmt":"2025-05-30T04:40:57","guid":{"rendered":"https:\/\/peraltafinancing.com\/alabama\/5th-circuit-reverses-injunction-against-texas-library-that-removed-challenged-books\/"},"modified":"2025-05-30T04:40:57","modified_gmt":"2025-05-30T04:40:57","slug":"5th-circuit-reverses-injunction-against-texas-library-that-removed-challenged-books","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=263460","title":{"rendered":"5th Circuit reverses injunction against Texas library that removed challenged books"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>The United States Court of Appeals for the Fifth Circuit ruled last week that plaintiffs cannot \u201cinvoke a right to receive information to challenge a library\u2019s removal of books.\u201d<\/p>\n<p>The ruling came Friday after a federal judge initially granted a preliminary injunction to plaintiffs who sued Llano County over the removal of 17 books from the library.<\/p>\n<p>A three-judge panel of the Fifth Circuit later reinforced that injunction 2-1, with conservative circuit judge Stuart Kyle Duncan dissenting. A month later, the Fifth Circuit vacated its decision and scheduled an en banc hearing \u2014 in front of the full court \u2014 in September 2024.<\/p>\n<p>In a 60-page <a href=\"https:\/\/www.publishersweekly.com\/binary-data\/ARTICLE_ATTACHMENT\/file\/000\/006\/6685-1.pdf\" target=\"_blank\" rel=\"noopener\">majority opinion<\/a> on May 23, written by Duncan, 10 members of the Fifth Circuit agreed that \u201cplaintiffs cannot invoke a right to receive information to challenge a library\u2019s removal of books.\u201d<\/p>\n<p>As part of that opinion, the majority overruled the circuit court\u2019s own precedent in <em>Campbell v. St. Tammany Parish School Board<\/em>, a 1995 First Amendment case in which a school board removed a book on voodoo from school libraries in a Louisiana parish. The judges wrote in their opinion that the 30-year-old precedent \u201cwas based on a mistaken reading of precedent\u201d and \u201cwrongly decided.\u201d<\/p>\n<p>Seven judges led by judge Stephen A. Higginson filed a 36-page dissent criticizing the majority opinion\u2019s treatment of the precedent.<\/p>\n<p>\u201cToday, a majority of our court sanctions government censorship in every section of every public library in our circuit,\u201d the dissenting judges write. \u201cAs counsel for Defendants acknowledged in oral argument, there is nothing to stop government officials from removing from a public library every book referencing women\u2019s suffrage, our country\u2019s civil rights triumphs, the benefits of firearms ownership, the dangers of communism, or, indeed, the protections of the First Amendment.\u201d<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p>The majority opinion took a derisive tone about the plaintiffs\u2019 arguments, calling them \u201cover-caffeinated.\u201d<\/p>\n<p>\u201cWe note with amusement (and some dismay) the unusually over-caffeinated arguments made in this case,\u201d the majority wrote. \u201cJudging from the rhetoric in the briefs, one would think Llano County had planned to stage a book burning in front of the library.\u201d As an example, \u201cone amicus intones, \u2018Where they burn books, they will ultimately burn people.\u2019 Take a deep breath, everyone. No one is banning (or burning) books.\u201d<\/p>\n<p>The dissenting judges took issue with that tone.<\/p>\n<p>\u201cThe majority\u2014apparently \u2018amuse[d]\u2019 by expressions of concern regarding government censorship\u2014disparages such concerns as \u2018over-caffeinated\u2019 because, if a library patron cannot find a particular book in their local public library, they can simply buy it,\u201d the judges write. \u201cThis response is both disturbingly flippant and legally unsound. First, as should be obvious, libraries provide critical access to books and other materials for many Americans who cannot afford to buy every book that draws their interest, and recent history demonstrates that public libraries easily become the sites of frightful government censorship.\u201d<\/p>\n<h3><strong>APLS officials already touting the decision<\/strong><\/h3>\n<p>That decision is already being touted by board members leading the Alabama Public Library Service, although Alabama falls in the 11th circuit, not the Fifth.\u00a0<\/p>\n<p>\u201cIt\u2019s so common sense, no library has every book that has ever been written,\u201d Wahl told Jeff Poor on the Jeff Poor Show Tuesday. \u201cEvery library has to choose which books are in its collections and which are not. This is not book banning, this is not book burning. This is literally just deciding what is most edifying, what is most beneficial for our readers \u2026 This is not about politics, this is about what is best for our children and what is best that we put in front of them.\u201d<\/p>\n<p>Wahl also said it would allow libraries to \u201clet children be children again\u201d and \u201cnot push a social agenda or sexualization on them.\u201d<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p>APLS board member Amy Minton sent the ruling to APR and stated that it is her \u201cstrong position \u2026 that we need to \u2018weed out\u2019- remove, any books that encourage going against Alabama State law and Federal Executive Order.\u201d<\/p>\n<p>\u201cYou know this has been my position since I first spoke to you 2 years ago and I have not changed,\u201d Minton wrote in a text to APR. \u201cTruly loving others is standing up for truth. The reason I take this stand is because I genuinely love everyone who struggles with gender or body dysphoria and I don\u2019t want them to accept something that isn\u2019t even settled science! I certainly don\u2019t think tax dollars should pay for books that encourage ideas against Alabama State Laws as well as put Alabama at risk of losing $3 million dollars of federal funds!\u201d<\/p>\n<p>Minton cited Alabama\u2019s recently passed \u201cWhat is a Woman Act,\u201d also known as the \u201cTrans Erasure Act\u201d by critics, and alluded to President Donald Trump\u2019s executive order requiring that no federal funds be used to promote gender ideology. Minton cites these more extensively in a document she introduced at the May APLS board meeting seeking to deem all books that promote the idea of gender transition as \u201cinappropriate\u201d under APLS code.\u00a0<\/p>\n<h2>Contradicting circuit rulings impact Prattville library suit<\/h2>\n<p>The decision by the Fifth Circuit bolsters the argument put forward by attorney Bryan Taylor representing the Autauga-Prattville Public Library against a lawsuit filed by patrons including members of Read Freely Alabama and the Alabama Library Association. Taylor cited Duncan\u2019s dissent as support for the library\u2019s position that patrons cannot challenge the library\u2019s removal of books, which is only strengthened by the court\u2019s en banc decision to follow Duncan\u2019s lead.<\/p>\n<p>The Fifth Circuit does not operate in a vacuum, however, and other circuit courts have taken an opposing stance to its decision.<\/p>\n<p>Read Freely Alabama recently filed its own notice in the court record advising the court of a decision in th e10th Circuit granting a preliminary injunction agains the removal of books in a Colorado school library.<\/p>\n<p>In\u00a0<em data-reader-unique-id=\"4\">Crookshanks et al. v. Elizabeth School District,\u00a0<\/em>a federal judge granted a preliminary injunction to the plaintiffs who argued the school system had violated students\u2019 first amendment rights by removing books due to \u201csensitive\u201d and political topics.<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p>\u201cIn granting a preliminary injunction that prohibits the removal of library books, the <em data-reader-unique-id=\"6\">Crookshanks<\/em> court concluded that defendants\u2019 \u2018argument\u2014that its decisions as to the library contents are government speech immune from First Amendment scrutiny\u2014finds little support in the caselaw,\u2019\u201d counsel for Read Freely wrote in a filing in the suit on May 8. \u201cThe court therefore \u2018reject[ed] the [defendant\u2019s] invitation to extend government-speech precedents . . . something the Supreme Court has expressly discouraged.\u2019 As the court explained, \u2018[n]o one would seriously argue that placing [Mein Kampf] in a school library constitutes government speech.<i data-reader-unique-id=\"7\">\u2018\u201d<\/i><\/p>\n<h2>The government speech argument<\/h2>\n<p>Seven of the 10 judges in the majority joined the opinion that library books are \u201cgovernment speech,\u201d which is not a majority of the 17 judges ruling on the case.<\/p>\n<p>In that opinion, the seven judges wrote that \u201clibraries curate their collections for expressive purposes\u201d and \u201ctheir collection decisions are therefore government speech.\u201d<\/p>\n<p>It\u2019s an argument that attorney for the Autauga-Prattville Public Library have followed, despite other circuits rejecting the idea at various levels.<\/p>\n<p>The Eight Circuit Court of Appeals recently ruled against the idea that library collections are government speech.<\/p>\n<p>\u201cContrary to Defendants\u2019 contention, the Supreme Court has not extended the government speech doctrine to the placement and removal of books in public school libraries,\u201d the appeals court decisions reads, adding that \u201cit is doubtful that the public would view the placement and removal of books in public school libraries\u201d as the government speaking.<\/p>\n<p class=\"article\">\u201cTake routine examples of historic tomes on political science. A well-appointed school library could include copies of Plato\u2019s <em>The Republic<\/em>, Machiavelli\u2019s <em>The Prince<\/em>, Thomas Hobbes\u2019 <em>Leviathan<\/em>, Karl Marx and Freidrich Engels\u2019 <em>Das Kapital<\/em>, Adolph Hitler\u2019s <em>Mein Kampf<\/em>, and Alexis de Tocqueville\u2019s <em>Democracy in America<\/em>,\u201d the court continued. \u201cAs Plaintiffs noted, if placing these books on the shelf of public school libraries constitutes government speech, the State \u2018is babbling prodigiously and incoherently.&#8217;\u201d<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement.
