The order is a recipe for abuse. The return to the overt embrace of mass incarceration through expanded funding and other support for police and prisons, coupled with the divisive underlying rhetoric of law-abiding citizens versus \u201cdangerous criminals,\u201d is concerning.<\/p>\n<p>Trump\u2019s order also promises \u201clegal resources and indemnification\u201d to officers accused of misconduct or police brutality. The threat against public officials who \u201cprohibit \u2026 law enforcement officers from carrying out duties necessary for public safety\u201d seemingly targets any state or local officials who attempt to hold law enforcement <a href=\"https:\/\/www.hrw.org\/news\/2025\/05\/07\/president-trumps-efforts-defy-accountability\" target=\"_blank\" aria-label=\"Link opens in new window (accountable for abuses)\">accountable for abuses<\/a> of power.<\/p>\n<p>This executive order echoes the shift of priorities within the executive branch\u2014especially at the Department of Justice, which has <a href=\"https:\/\/www.democracydocket.com\/opinion\/trump-administration-dismantles-protections-against-law-enforcement-abuses\/\" target=\"_blank\" aria-label=\"Link opens in new window (stopped)\">stopped<\/a> pursuing and withdrawn civil rights litigation, including <a href=\"https:\/\/www.cnn.com\/2025\/05\/21\/politics\/justice-department-consent-decree-police-department\" target=\"_blank\" aria-label=\"Link opens in new window (police reform cases and settlement agreements)\">police reform cases and settlement agreements<\/a>, ominously signaling that police misconduct will not bring consequences.\u00a0<\/p>\n<p>Equally troubling is Trump\u2019s call to mobilize federal resources, including the military, to fight crime domestically. As the nation observes the fifth anniversary of the murder of George Floyd by Minneapolis police, these policies and pronouncements raise further concerns that policing will be conducted in a racially discriminatory manner. Given the history of mass incarceration and the <a href=\"https:\/\/www.hrw.org\/news\/2009\/06\/19\/race-drugs-and-law-enforcement-united-states\" target=\"_blank\" aria-label=\"Link opens in new window (War on Drugs)\">War on Drugs<\/a>, this militarization will have profound class and <a href=\"https:\/\/www.hrw.org\/report\/2022\/08\/08\/racial-discrimination-united-states\/human-rights-watch\/aclu-joint-submission\" target=\"_blank\" aria-label=\"Link opens in new window (racial implications)\">racial implications<\/a>, targeting <a href=\"https:\/\/www.hrw.org\/report\/2024\/07\/15\/disrupt-and-vilify\/war-immigrants-inside-us-war-drugs\" target=\"_blank\" aria-label=\"Link opens in new window (immigrant)\">immigrant<\/a> and Black communities.\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Meanwhile, government lawyers with decades of experience litigating civil rights and public corruption, among other areas, have been <a href=\"https:\/\/www.npr.org\/2025\/01\/31\/nx-s1-5276871\/justice-department-fbi-upheaval\" target=\"_blank\" aria-label=\"Link opens in new window (ordered)\">ordered<\/a> to focus exclusively on immigration enforcement. Roughly <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/may\/01\/civil-rights-division-doj-trump\" target=\"_blank\" aria-label=\"Link opens in new window (70 percent)\">70 percent<\/a>\u00a0of the Justice Department lawyers within this division have left, resigned, been reassigned, or been forced out.<\/p>\n<p>Anyone with a cursory understanding of policing in the United States can predict the outcome\u2014more wrongdoing, less oversight, and plummeting community trust. Why would residents report crime or cooperate with police if they believe complaints will be ignored or suppressed? The administration\u2019s policies and promises will <a href=\"https:\/\/www.washingtonpost.com\/investigations\/2025\/05\/12\/doj-prosecutions-predatory-officers\/\" target=\"_blank\" aria-label=\"Link opens in new window (lead)\">lead<\/a> to lower rates of solving crimes and less effective policing.<\/p>\n<p>Not only has the president decimated <a href=\"https:\/\/www.hrw.org\/news\/2025\/05\/07\/president-trumps-efforts-defy-accountability\" target=\"_blank\" aria-label=\"Link opens in new window (oversight agencies)\">oversight agencies<\/a>, but he also wants police and sheriffs to answer to him by demanding they serve as an auxiliary arm of federal immigration enforcement. Toward this end, he has <a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/04\/fact-sheet-president-donald-j-trump-protects-american-communities-from-criminal-aliens\/\" target=\"_blank\" aria-label=\"Link opens in new window (threatened)\">threatened<\/a> to yank grants from \u201c<a href=\"https:\/\/www.hrw.org\/news\/2025\/02\/20\/ten-harmful-trump-administration-immigration-and-refugee-policies\" target=\"_blank\" aria-label=\"Link opens in new window (sanctuary&#x201D; jurisdictions)\">sanctuary\u201d jurisdictions<\/a> and <a href=\"https:\/\/www.cbsnews.com\/news\/ice-partnerships-local-law-enforcement-trump-immigration\" target=\"_blank\" aria-label=\"Link opens in new window (tripled the number)\">tripled the number<\/a> of U.S. Immigration and Customs Enforcement (ICE) partnerships through agreements with state or local law enforcement agencies.<\/p>\n<p>Federal immigration enforcement is a heavy and often unwelcome burden on local departments. Deputizing local patrol officers as immigration agents <a href=\"https:\/\/www.americanprogress.org\/article\/negative-consequences-entangling-local-policing-immigration-enforcement\/\" target=\"_blank\" aria-label=\"Link opens in new window (strains local budgets)\">strains local budgets<\/a> by increasing coordination, training, and infrastructure costs. And it blurs the bright line between local and federal priorities, creating a climate of confusion and fear.<\/p>\n<p>The international human rights group Human Rights Watch, for which I work, has reported on the consequences of pushing local police into immigration work\u2014including <a href=\"https:\/\/www.hrw.org\/news\/2025\/02\/13\/us-texas-vehicle-pursuits-kill-least-106-injure-301\" target=\"_blank\" aria-label=\"Link opens in new window (high-speed car chases)\">high-speed car chases<\/a> that kill citizens and immigrants alike, immigrants being <a href=\"https:\/\/www.hrw.org\/news\/2014\/05\/19\/nashville-immigrants-too-scared-call-police\" target=\"_blank\" aria-label=\"Link opens in new window (afraid to call 9-11)\">afraid to call 9-11<\/a>, and noncitizen crime victims and witnesses rarely receiving the necessary protection to help police and prosecutors do their jobs. In such a climate, why would noncitizens \u201csay something\u201d if they \u201csee something\u201d?<\/p>\n<p>Loosening accountability while expanding federal influence creates a perverse incentive structure at odds with <a href=\"https:\/\/www.hrw.org\/news\/2020\/08\/12\/roadmap-re-imagining-public-safety-united-states\" target=\"_blank\" aria-label=\"Link opens in new window (rights-respecting policing)\">rights-respecting policing<\/a>. When officers face fewer consequences for misconduct alongside more pressure to work in alignment with the priorities set in Washington, the communities they police shoulder the resulting legal, financial, and human toll.<\/p>\n<p>Policing does not happen in a vacuum; its legitimacy rises or falls with the public\u2019s trust. An agenda that shields officers from accountability while drafting them into federal immigration dragnets breaks that trust twice over.
